PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) -(d) as amended, and
the Subdivision Regulations of Garfield County, Colorado, adopted September 1,
1972 and amended April 14, 1975, Section 1.02.17 (d) and 3.02.01 the undersigned

petitions the Board of County Commissioners of Garfield County, Colorado, to

Dear Mr. Baldwin:
We have reviewed the material submitted for the above referenced
applications for exemption. The developers propose to use individual wells
for the water supply which would intercept ground water tributary to the
Colorado River at a point where there is still water available for appropriation.
This office can issue individual domestic well permits to individual lot pur-
chasers and we recommend approval of Spevere, Stevens and Wassenaar
Exemptions.

CONTRACT OF SALE AND PURCHASE
THIS AGREEMENT, made and entered into this
day ofA.D. 1979, by and between Joseph Canto,
Mary Conto, and Darlene Kay Dodo, Newcastle, Colorado (here-
inafter referred to as "Sellers") and James E. Stevens and
Billie Rae Stevens, Box 663, Carbondale, Colorado (hereinafter
referred to as "Buyers"), WITNESSETH:
WHEREAS, the Sellers are the owners of a certain
tract of real property, consisting of 40 acres more or less,
together with a residence,,,and other improvements situate
thereon; and
WHEREAS, the Sellers have agreed to sell said real
property and the Buyers have agreed to purchase the,same
upon the terms and for the consideration hereinafter expressed;
NOW, THEREFORE, for!and in consideration of the
premises and agreements and considerations herein contained,
the parties hereto do hereby agree as follows:
REAL PROPERTY Sellers hereby agree to sell
and convey and the Buyers hereby agree to purchase'the
following described real property situate in Garfield County,
State of Colorado, to -wit:

with, which are appurtenant to the above
described property.
Prior to convey
a survey will be conducted

the Sellers and the Buyers, as
the boundary and the boundary
fence enclosing the above-described property. The resulting
legal description shall be composed of the surveyed boundary
of the NE4 of the SWk of Section 1 wherever such boundary

linas lie entirely within the boundary fence, or in the
event the property boundary fence shall lie within the
surveyed boundary line of the NE4 SW4 such description
shall, in such instance, include the boundary fence, the
intention being to arrive at a description which includes
the NE4 of the SWk, or that portion thereof, which lies
wholly within the property boundary fences.
The water rights above described shall be included
within the Warranty Deed but will be conveyed without warranty
therefore.
2. PURCHASE PRICE: The Buyers agree to pay to
the Sellers for all of the above-described property the
total purchase price of

a. By the payment by the Buyers to the Sellers of
an earnest money deposit in the amount of -

this agreement, the receipt of which is hereby acknowledged

note shall be secured by a Deed of Trust to be executed at
closing by the Buyers in favor of the Sellers, Joseph Conto
and Mary Conto. A legal description of the security which
shall be included in such - 'Deed of Trust shall consist of the
property as described in the Warranty Deed, minus a parcel
of not more than 10 acres which shall include the residence
improvements,'which such 10 acres shall be described by
survey to be conducted prior to closing.
3. SURVEY: Prior to closing the parties shall
procure a boundary survey of the NE4 of the SW4 in accordance
with the conditions set forth in Section 1 of this Contract.
Thecost of.'tch boundary survey-shall`be'divided equally
between the Buyers and the Sellers. The Buyers shall also
procure a survey of a 10 acre parcel, including the residence
improvements on the described property, which such 10 acre
parcel shall be located around the residence improvements in
the Northwest corner of the property. The survey shall be
conducted so that the remaining 30 acre parcel shall have
access to the nearest public road. Such survey shall be
completed on or before September 1, 1979..
4. CLOSING: This sale shall be closed on October
1, 1979. At the closing the Sellers shall convey all of the
real property to the Buyers by Warranty Deed, save and
except the water rights which shall be conveyed free of
warranty. The Buyers shall pay to the Sellers the balance
of the down payment as described in Section 2(b) above, plus
or minus customary closing costs and prorations. The Buyers
