I. BACKGROUND. PROCESS
A request was received on September 28,2016 for Administrative Review of an Accessory
Dwelling Unit (ADU) to be located approximately 5 miles east of Glenwood Springs at727
County Road 120 (Lot 17 of Lookout Mountain Ranches). The ADU has been constructed
without necessary Building or Land Use Permits and has been issued a Notice of Violation.
This application for a Land Use Change Permit is to correct this zoning violation.
A request for an ADU in the Rural Zone District is an Administrative Review pursuant to
Section 4-103 of the Garfield County 2013 Land and Development Code, as amended
(LUDC). This process grants the decision-making authority to the Director of Community
Development. This process also allows for call-up of that decision for review by the Board
of County Commissioners.
A Director Decision of approval with conditions was issued on December 12,2016 and a
request for call-up was received from Wayne Rudd, an adjacent property owner, on
December 22,2016. Due to certain water rights issues identified during the application
review, the approval requires that adequate and legal water be obtained. As a result, the
approval includes one Condition of Approval to be satisfied prior to lssuance of the Land
Use Permit, which is to obtain a new well permit, drill a new well and test the water from
that well in accordance with the requirements of the LUDC.
The Board of County Commissioner's considered the question of whether to call up the
request at their January 3'd meeting. ln accordance with Section 4-112 of the Land Use
and Development Code, the Board exercised its option to call up the request for review.
The Board set the date for the public hearing on March 6th,2oll.
Public notice for the hearing is required consistent with the original notice outlined by the
Code forthe Director's Decision. ln this case the notice required is a mailing notice 15
days prior to the hearing. Public notice pursuant to the Code has been completed by the
Community Development Department (Exhibit 5 and 6) and has been reviewed by the
County Attorney's Office.
Through a conversation with Mr. Leable, it has been represented that Mr. Leable has
reached out to Mr. Rudd since the scheduling of the call-up hearing. As of the writing of
this report, however, the two parties have not yet been able to speak to make headway
on a resolution. ln addition, it is understood that a solution is now being sought to purchase
the property where the well is located instead of drilling a new well on the subject parcel.
While this may be a workable solution from the standpoint of the County, Condition number
1 of the Directors Determination issued December 12,2016 would need to be modified to
allow for such an arrangement.
II. DIREGTOR'S DECISION - STAFF REPORT
Copies of the Director's Decision letter and Staff Report are attached and included as
,!, exhibits for the public hearing (Exhibits 2 and 3 respectively).
The Director's Decision letter was for a Approval with Conditions. Staff concluded that the
proposed ADU is not in conformance with the Comprehensive Plan of 2030 and as a result
does not and cannot meet the standards as outlined in Section 7-1\2of the Land Use and
Development Code.
More specifically, the Staff Report (Exhibit 3) states:
comments were received from wayne Rudd (see Exhibit 6), an adjacent
property owner, indicating that the subject well is lzowned by Ranch 17
(Leable property) andrzowned by Ranch 14 (Rudd property). As a result
of this letter, Staff research found a Quitclaim Deed to Rudd Aviation, lnc.
(See Exhibit 8) which provides "An undivided one-halt (1t2) interest in the
water well located on Ranch 17, Lookout Mountain Ranches, Lookout
Mountain Ranch, in Garfield county colorado, said well having been
constructed under Monitoring Hole Notice MH-30367 and being the subjectof well Permit No. 202863, together with any and all water rights
appurtenant thereto." ln addition, a well sharing Agreement (see Exhibit
9) was located which states that the "Purchaser shall be entitled to not more
than 5 gpm, or onethird of the actual well capacity, whichever is less, and
Purchaser may use such water only for in-house domestic use in one single
family dwelling located upon the Property, and for the irrigation of not more
than 5000 square feet in the aggregate of lawn and garden on the
Property." This ownership documentation and weil sharing agreement
combined with the letter from Mr. Rudd (Exhibit 6) stating that "l strongly
object to the approval of a second dwelling on Ranch 17 Lookout Mountain
Ranches... " leads Staff to the conclusion that the Subject Property owner,
Leable, does not own enough water rights in the well identified as Well
Permit Number 202863 for two dwelling units and the owner of the other lz
of the well rights, Rudd, is not supportive of allowing additional use of the
well. As a result, it is Staff's opinion that the Subject Property owner does
not have adequate legalwater rights to serve the proposed ADU.
Through conversations with the Applicant, it is understood that the
Applicant wishes to pursue drilling a new well on the property in order to
serve the ADU. Should the ADU be served by a different well than the one
analyzed as a part of this application, then a new pump test and water
quality test will need to be provided. ln addition, the Applicant will need to
provide an approved well permit for the new well from the Division of Water
Resources and represent how each of the dwelling units on the property
will be served by water (new well or existing well).
Staff finds that while the Applicant does not currently have sufficient legal
water to serve the proposed use and as a result is not in compliance with
Secfion 7-104: Sufficient, Adequate, Legal and Physical Source of Water,
should the Applicant obtain a well permit to drill a new well that can legally
serve the ADU and has adequate water quantity and quality, then a finding
of conformance with the Code may be made. Since the existing ADU is a
Code violation, the deadline to obtain legal and adequate water for the ADU
is recommended to be limited to 6 month.
As the above excerpt from the Staff Report issued on December 5,2016 explains, issues
related to legal water availability were identified during the application review process.
Once these issues came to light, the Applicant desired to pursue drilling a new well on the
property to serve the primary and accessory dwelling units. ln order to accommodate this
request, a Determination was made that the property owner could have up to 6 months to
obtain legal and adequate water for the property. Should the property owner not be able
to rectify the water issues within 6 month, the Determination would be withdrawn and the
ADU would need to be removed from the property.
III. PUBLIC COMMENTS
As documented in the call up request, Tim Thulson on behalf of Wayne Rudd has stated
submitted the following objections to the Directors Determination issued December 12,
2016 (Exhibit 1):
l. Mr. Rudd is the owner of property adjacent to the property parcel constituting the
subject ofthe above permit ("the Subject Parcel";
2. As previously documented to the County, the additional water usage presented by the
illegally constructed ADU will in fact injure the water supplies properly developed by
Rudd and as such cannot possibly satisfu the "adequacy" standard set forth under
Section 7-104.A. and construction of the illegal ADU violates the protective covenants
proscribing such use and the well sharing restrictions which are appurtenant to the
Subject Parcel and both of which were imposed to address the limited water resources
in the area; and
3. Given the construction completed to date on the ADU, it is impossible to see how the
inspections necessarily required for issuance of a Certificate of Occupancy can now
adequately be performed.
No further public comment was received as a result of the initial application or the call-up
hearing notification.
IV. BOARD OF COUNTY COMMISSION ACTION
Option A: Uphold the Director Decision for Approval with Gonditions
The Board can direct staff to prepare a resolution upholding the Director's Decision for
Approvalwith Conditions, including the findings and conditions of approval outlined below.
Suggested Findings
1. That proper public notice was provided as required for the hearing before the
Board of County Commissioners.
2. The hearing before the Board of County Commissioners was extensive and
complete, that all pertinent facts, matters and issues were submitted and that
all interested parties were heard at a the meeting.
3. That for the above stated and other reasons the proposed Land Use Change
Permit for the Leable Accessory Dwelling Unit is in the best interest of the
health, safety, convenience, order, prosperity and welfare of the citizens of
Garfield County.
4. That the proposed Accessory Dwelling Unit is in conformance with the
Comprehensive Plan of 2030, as amended.
Suggested Conditions of Approva!
Conditions Prior to lssuance of the Land Use Chanqe Permit:
1. Within 6 months from the date of the Directors Determination, the Applicant shall
obtain a well permit and drill a new well as permitted by the State of Colorado
Division of Water Resources for the proposed ADU per Garfield County
regulations. Prior to issuance of the Land Use Change Permit, the Applicant shall
provide the following information and documents. This information and documents
shall be reviewed and accepted by the Community Development Department and
designated engineer.
a. An explanation as to how each dwelling unit on the property will be
served by water and how these wells are impacted by any well
sharing agreements and/or split ownership.
b. The approved well permit for the well to serve the ADU from the
Division of Water Resources.
c. A 4-hour pump test for the new well in conformance with Section 4-
203(M)(1XbX5)
d. A water quality test for the new well in conformance with Section 4-
203(MX1Xb)(5)
Conditions of Approval:
2. All representations of the Applicant contained in the application shall be considered
conditions of approval unless specifically modified by the Board of County
Commissioners.
3. The Applicant shall comply with Additional Standards for Residential Uses
contained in Section 7-701, Accessory Dwelling Units, of the Land Use and
Development Code of 2013, as amended.
4. The Floor Area for the Accessory Dwelling Unit shall not exceed 3,000 square feet.
5. The ADU shall be subject to all Garfield County Building Code Requirements. The
property owner shall obtain any necessary Garfield County Building Permits for
modifications and/or expansions to the ADU structure.
6. All exterior lighting shall be downcast and shielded and comply with SectionT-304,
Lighting Standards, of the Land Use and Development Code o12013, as amended.
7. An ADU is restricted to leasehold interest in the dwelling unit and is for residential
or Home Office/Business use only, as described in the Land Use and Development
Code of 2013, as amended.
8. Approval of a Land Use Change Permit for this use is in no way intended to
supersede any other requirements placed on this property such as a matter of
private covenant or otherwise.
Option B: Modify the Director's Determination Conditions of Approval
Should the Board wish to modify any Conditions of Approval from the Directors
Determination, the Board may do so through an affirmative vote. Such a modification
would retain the Suggested Findings identified in Option A.
Should the Board wish to offer an alternative for Mr. Leable to purchase the adjacent
property owned by Mr. Rudd in order to rectify the issues with legal water or provide
another alternative method for securing legal water, such a solution would need to be
accommodated in Condition number 1 identified in the Directors Determination issued
December 12,2016. The suggested modified condition of approval is as follows:
1.Within6monthsfromthedateoftheMien-BoardDecision,the
Applicant shall:a. Obtain a well permit and drill a new well as permitted by the State of
Colorado Division of Water Resources for the proposed ADU per Garfield
County regulations. Prior to issuance of the Land Use Change Permit, the
Applicant shall provide the following information and documents. This
information and documents shall be reviewed and accepted by the
Community Development Department and designated engineer.
i. An explanation as to how each dwelling unit on the property will be
served by water and how these wells are impacted by any well
sharing agreements and/or split ownership.
ii. The approved well permit for the well to serve the ADU from the
Division of Water Resources.iii. A 4-hour pump test for the new well in conformance with Section 4-
203(MX1Xbxs).iv. A water quality test for the new well in conformance with Section 4-
203(MX1)(bxs)
b. Acquire Ranch 14 and appurtenant water rights, thereby obtaining
full rights to the supplying water well, identified under Well Permit No.
202863. Prior to issuance of the Land Use Change Permit, proof of
ownership of Ranch 14 and ap.purtenant water rights will need to be
provided to the Community Development Department and accepted
by the County Attorney's Office. ln addition, a legal instrument will
need to be provided and accepted by the County Attorney's Office
prior to execution (e.9. well sharing agreement, deed, etc.) that
provides legal and adequate water for the primary and accessory
dwelling unit on Ranch 17. This legal instrument must be fully
executed and recorded prior to issuance of the Land Use Change
Permit.
c. Provide for an alternative means to legally obtain water for the
proposed ADU (e.9. modified quitclaim deed for well, well sharing
agreement, etc.). This alternative shall be reviewed and approved by
both the Community Development Department and the County
Attorney's Office.
Option C: Overturn the Director's Decision in Whole
Should the Board wish to overturn the Director's Decision, the Board may formalize a
motion for denial. Should the Board wish to overturn the Director's Decision, Staff
recommends the following findings.
Suggested Findings
1. That proper public notice was provided as required for the hearing before the
Board of County Commissioners.
2. The hearing before the Board of County Commissioners was extensive and
complete, that all pertinent facts, matters and issues were submitted and that all
interested parties were heard at a the meeting.
3. That for the above stated and other reasons the proposed Land Use Change
Permit for the Leable Accessory Dwelling Unit is NOT in the best interest of the
health, safety, convenience, order, prosperity and welfare of the citizens of Garfield
County.
4. That the proposed Accessory Dwelling Unit is NOT in conformance with the
Comprehensive Plan of 2030, as amended.
5. That the application does not and cannot reasonably meet the standards as
outlined in Section 7-104, Source of Water, of the Land Use and Development
Code, as amended.

with no request for review or public hearing, the decision shall be final.

I. DESCRIPTION OF THE PROPOSAL
The Applicant is requesting a permit for an Accessory Dwelling Unit (ADU) on a 35.87
acre parcel located within the Rural zone district. As the property is over 4 acres, the ADU
is limited to 3,000 square feet. The Glenwood Springs Comprehensive Plan identifies the
propertyas Low Density Residential (.tO acres/dwelling unit). Access to the site is an
existing driveway and private roadways from County Road 120. The site has adequate
areas for off-street parking and snow storage for the proposed ADU and other existing
uses on the property.
The ADU to be permitted is an existing 1,134 square foot single family home. A separate
primary single family home exists on the property as well. Documentation for legal and
adequate water, access, and an adequately sized Onsite Wastewater Treatment System
(OWTS) have been provided for the ADU.
A letter from Wayne Rudd, an adjacent property owner, was submitted on October 14,
2016 (See Exhibit 6). This letterexpressed concerns regarding a restriction on ADUs in
the Lookout Mountain Ranches Covenants, Conditions, and Restrictions (See Exhibit 7)
as well as ownership of the water well located on the subject parcel.
II. DESCRIPTION OF THE SITE
The site is currently developed with one single family primary dwelling unit and one single
family ADU. The ADU was built without the necessary Land Use Permit, which this
application is intended to rectify. The property appears to have positive drainage and is
a mix of graded areas and native vegetation with moderate slopes. Uses within 1500 feet
include primarily residential and agricultural.

III. WAIVER REQUESTS FROM STANDARDS
The Applicant has not requested any waivers from the Standards.
IV. AUTHORITY - APPLICABLE REGULATIONS
A. The Land Use Tables contained in Section 3-403 of the Land Use and
Development Code, designates an Accessory Dwelling Unit within the Rural zone district
as requiring Administrative Review.
B. Section 4-103 of the Land Use and Development Code sets forth the
Administrative Review Procedures by which the current Application is being considered.
C. The Application submittal requests two waivers from submittal requirements.
These waiver requests are from submittal requirements included an improvements
agreement and development agreement. Submittal waivers have been accepted as part
of the completeness review.
D. Article 7 of the Land Use and Development Code sets forth General approval
standards in Division 1, General Resource Protection Standards in Division 2 and Site
Planning and Development Standards in Division 3. Accessory Dwelling Units are also
subject io Section 7-701. The standards are addressed in the Application submittals and
in the Staff Analysis section of the Staff Report.
V. PUBLIC AND REFERRAL COMMENTS
The Applicant has provided documentation that all required notice mailings have been
completed in accordance with the LUDC. One letter of Public Comments was received
for this application, which is outlined below. Referral Comments received on the
Application are attached as Exhibits and summarized below:
A. Garfield County Consulting Engineer, Chris Hale, Mountain Cross Engineering
(Exhibit 4): Mr. Hale noted that "The review generated no comments."
B. Colorado Division of Water Resources (DWR) (Exhibit 5):
According to our records, Well Permit No. 202863 uras tssued on June 27,
1997, for an existing well located in the NE1/4 of the NW1/4 of Section 19,
Twp. 6 South, Rng. 88 West. The use of groundwater from the well was
approved for ordinary household purposes inside 3 single family dwellings,
the irrigation of 1 acre of home gardens and lawns, and the watering of
domestic animals. The pumping rate of this well shall not exceed 15 gpm.
Per our records, the wetl was constructed on 5/8/1997 to a depth of 453
feet, under monitoring hole notice MH-30367, and the current permit is valid.
The applicant's land use change request indicates that the well currently
serues a single family residence and ADU. The ADU would be considered,
forthe purposes of well permitting, to be an additional single family dwelling.
As long as the uses of the well do not exceed fhose allowed under the
permit, this office has no obiection to the well also seruing the ADU.
C. Garfield County Road and Bridge (Exhibit 3): Road and Bridge has no concerns
with the request.
D. Wayne Rudd, Adjacent Property Owner (Exhibit 6): This letter expresses concerns
regarding a restriction on ADUs in the Lookout Mountain Ranches Covenants, Conditions,
ani Restrictions (See Exhibit 7) as well as ownership of the water well located on the
subject parcel (See Exhibits 8, 9, and 10).
VI. STAFF ANALYSIS
Article 7, Division 1: General Standards
1. Section 7-10| Compliance with Zone District Use Regulations
The development on the property is in general conformance with the dimensional
standards for the Rural zone district.
The property currently has one primary dwelling unit on the property. The Applicant
constructed the ADU without proper Land Use Permits and has submitted this application
in hopes of correcting this violation.
2. Section 7-102: Conformance with Comprehensive Plan and compliance with lGAs
The County Comprehensive Plan identifies the property as Low Density (<10 acres per
dwelling unit). As the property is over 30 acres, the residential density identified within the
Comprehensive Plan would be satisfied including the ADU.
Please see SectionT-104, below, regarding legalwater.
3. Section 7-103: CompatibilitY
The proposed use is located in a rural area and is unlikely to significantly alter or impact
this character of the area. The areas surrounding the subject property are predominantly
residential and agricultural in nature.
A letter was received from Mr. Rudd, an adjacent property owner, indicating that the
Lookout Mountain Covenants, Conditions and Restrictions (CCRs) do not permit ADUs.
Staff subsequently located the CCRs for this portion of Lookout Mountain Ranches (See
Exhibit 7) and there does appear to be a restriction on such development within this
subdivision. While it appears that such a restriction exists, the County does not enforce
private covenants. As a result, such an infringement on these CCRs is a private civil
matter.
4. Section 7-104: Sufficient, Adequate, Legal and Physical Source of Water
The ADU is to be served by an existing well on the property. This well, Permit Number
202863, states that "The use of ground water from this well is limited to fire protection,
ordinary household purposes inside 3 single family dwellings, the irrigation of not more
than one (1) acre of home gardens and lawns, and the watering of domestic animals".
Referral comments received from the Division of Water Resources (See Exhibit 5)
indicate that "The applicant's land use change request indicates that the well currently
serves a single family residence and ADU. The ADU would be considered, for the
purposes of well permitting, to be an additional single family dwelling... As long as the
uses of the well do not exceed those allowed under the permit, this office has no objection
to the well also serving the ADU."
The Applicant submitted a water quality test from the well in use for the ADU. This well
test was analyzed by Michael Erion of Resource Engineering in January 2016. As a result
of the water quality testing, Mr. Erion concluded that "the laboratory results for the water
quality analysis indicate that the water meets all primary and secondary drinking water
standards. The well water quality is suitable for domestic uses and outside irrigation."
A pump test was also conducted on the subject well. This well pump test, conducted by
J & M Pump lnc. on September 2,2015, shows that the well produced 15 gallons per
minute with a l\Ooh recovery in 14 minutes. As a result, it appears that the quantity of the
water being produced by the subject well is adequate.
Comments were received from Wayne Rudd (See Exhibit 6), an adjacent property owner,
indicating that the subject well is /, owned by Ranch 17 (Leable property) and Y, owned
by Ranch 14 (Rudd property). As a result of this letter, Staff research found a Quitclaim
Deed to Rudd Aviation, lnc. (See Exhibit 8) which provides "An undivided one-half (112)
interest in the water well located on Ranch 17, Lookout Mountain Ranches, Lookout
Mountain Ranch, in Garfield County Colorado, said well having been constructed under
Monitoring Hole Notice MH-30367 and being the subject of Well Permit No. 202863,
together with any and all water rights appurtenant thereto." ln addition, a Well Sharing
Agreement (See Exhibit 9)was located which states that the "Purchaser shall be entitled
to not more than 5 gpm, or one-third of the actual well capacity, whichever is less, and
Purchaser may use such water only for in-house domestic use in one single family
dwelling located upon the Property, and for the irrigation of not more than 5000 square
feet in the aggregate of lawn and garden on the Property." This ownership documentation
and well sharing agreement combined with the letter from Mr. Rudd (Exhibit 6) stating
that "l strongly object to the approval of a second dwelling on Ranch 17 Lookout Mountain
Ranches..." leads Staff to the conclusion that the Subject Property owner, Leable, does
not own enough water rights in the well identified as Well Permit Number 202863 for two
dwelling units and the owner of the other lzot the well rights, Rudd, is not supportive of
allowing additional use of the well. As a result, it is Staff's opinion that the Subject Property
owner does not have adequate legal water rights to serve the proposed ADU.
Through conversations with the Applicant, it is understood that the Applicant wishes to
pursue drilling a new well on the property in order to serve the ADU. Should the ADU be
served by a different well than the one analyzed as a part of this application, then a new
pump teit and water quality test will need to be provided. ln addition, the Applicant will
need to provide an approved well permit for the new well from the Division of Water
Resources and represent how each of the dwelling units on the property will be served
by water (new well or existing well).
5. Section 7-105: Adequate CentralWater Distribution and Wastewater Systems
The Applicant is proposing to utilize an existing Onsite Wastewater Treatment System
(OWTS) for the proposed ADU. The Applicant has provided evidence that the existing
OWTS is adequate to serve the existing ADU.
6. Section 7-106: Adequate Public Utilities
Adequate public utilities currently exist at the subject parcel'
7. Section 7-107: Access and Driveways
a. The application was referred to the Garfield County Road and Bridge
Department (see attached). Wyatt Keesbery of Garfield County Road and Bridge
indicated Road and Bridge has no concerns with the proposed ADU, but did not
that CR 120 is a limited maintenance County Road'
b. The Applicant has stated that the driveway and private access roads meet the
design standards found in Section 7-107.
8. Section 7-108: Natural Hazards
No natural hazards have been identified on the subject parcel.
9. Section 7-109: Fire Protection
The impact area within the subject parcel has been identified as having a Very High level
of Wildfire Susceptibility in accordance with Map 7 of the Community Wildfire Protection
Plan. The parcel is located within the Garfield County Sheriff's service area. The
application was referred to the Sheriff's Office, however no comments were received.
Article 7, Division 2: General Resource Protection Standards
10. Section 7-20l Agricultural Lands
The proposed development is an existing dwelling unit on the subject property' lt is not
anticipaied that the proposed development would adversely affect neighboring
agricultural uses or agricultural uses on the subject parcel'
11. Section 7-202 Wildlife Habitat Areas
The ADU is expected to have impacts on wildlife similar to a single family dwelling unit.
As a result, no significant impact to wildlife habitat is expected.
12. Section 7-203 Protection of Waterbodies
No waterbodies have been identified on the property.
13. Section 7-204 Drainage and Erosion
The Applicant has provided a topographic map of the subject property that shows general
positive drainage from the property. As the driveways are currently in place, no significant
change to the topography or drainage from the property is expected.
14. Sections 7-205 Environmental Quality
No water or air quality issues are anticipated from the proposed project.
15. Section 7-206 Wildfire Hazards
The impact area of the subject property is identified as Very High according to Map 7,
Wildland Fire Susceptibility lndex of the Community Wildfire Protection Plan (CWPP). ln
addition, no slopes over 30% have been identified and no fire chimneys are known to
exist on the property. The parcel is located within the Garfield County Sheriff's service
area. The application was referred to the Sheriff's Office, however no comments were
received.
16. Section 7-207 Natural and Geologic Hazards
As noted in Section 8 of this Staff Report, no natural and geologic hazards have been
identified on the subject property.
17. Section 7-208 Reclamation
Minimal disturbance is anticipated as a result of the proposed ADU. The driveways are in
place and the dwelling unit to be designated as the ADU is existing'
Article 7, Division 3, site Planning and Development standards
18. Section 7-30l Compatible Design:
The ADU use is generally compatible with surrounding residential land uses.
19. Section 7-302 Off- Street Parking and Loading Standards:
The Applicant has demonstrated through site plans that adequate off-street parking exists
for the ADU and primary dwelling unit.
20. Sections 7-303 Landscaping Standards:
The LUDC specifically exempts ADUs from Section 7-303.
21. Section 7-304 Lighting:
Staff recommends a condition of approval that any exterior lighting comply with the
Standards outlined in Section 7-304.
22. Section 7-305 Snow Storage Standards:
The property has adequate snow storage areas that are in compliance with County
standards.
23. Section 7-306 Trail and Walkway Standards:
No recreational or community facility access areas are proposed.
Article 7, Division 7, Accessory Dwelling Unit
24. Maximum Floor Area:
As the property is over 4 acres, the ADU is required to be limited to 3,000 square feet.
Staff suggests a condition of approval that the ADU be limited to 3,000 square feet or less
in size.
25. OwnershipRestriction:
The Applicant and Owner understand that the ADU is restricted to leasehold interests and
may be used for residential or Home Office / Business use only'

26. Compliance with Building Code:
The ADU was built without Land Use or Building Permits. The Applicant has submitted
this application to obtain the necessary Land Use Permit. ln addition, the Applicant has
submitted documentation to the Building Department to obtain the necessary Building
Permits. Staff recommends a Condition of Approval requiring the Applicant to obtain all
necessary building permits from Garfield County for future development.
27. Minimum Lot Area:
The Applicant has 35.59 acres and as a result the minimum lot area requirement of at
least 2 acres in the Rural zone district is satisfied.
28. Entrance to Dwelling Unit:
The Applicant is proposing the ADU to be a separate building from the primary dwelling
unit. As a result, the ADU as it exists will comply with this standard.
VII. SUGGESTED FINDINGS AND RECOMMENDATION
Staff recommends a finding that the proposed Accessory Dwelling Unit is in conformance
with the Comprehensive Plan of 2030 and the Land Use and Development Code.
Specifically, Staff finds that while the Applicant does not currently have sufficient legal
water to serve the proposed use and as a result is not in compliance with Secfion 7-104:
Sufficient, Adequate, Legal and Physical Source of Water, should the Applicant obtain a
well permit to drill a new well that can legally serve the ADU and has adequate water
quantity and quality, then a finding of conformance with the Code may be made. Since
the existing ADU is a Code violation, the deadline to obtain legal and adequate water for
the ADU is recommended to be limited to 6 month. Staff, therefore, recommends Approval
with Conditions of the Leable ADU application.
Suggested Findings
1. That proper public notice was provided as required for the Administrative Review
Land Use Change Permit.
2. That with the adoption of conditions, the application is in general conformance with
the 2030 Comprehensive Plan, as amended.
3. That with the adoption of conditions, the application has adequately met the
requirements of the Garfield County Land Use and Development Code of 2013, as
amended.

1. Within 6 months from the date of the Directors Determination, the Applicant shall
obtain a well permit and drill a new well as permitted by the State of Colorado
Division of Water Resources for the proposed ADU per Garfield County
regulations. Prior to issuance of the Land Use Change Permit, the Applicant shall
provide the following information and documents. This information and documents
shall be reviewed and accepted by the Community Development Department and
designated engineer.
a. An explanation as to how each dwelling unit on the property will be
served by water and how these wells are impacted by any well
sharing agreements and/or split ownership.
b. The approved well permit for the well to serve the ADU from the
Division of Water Resources.
c. A 4-hour pump test for the new well in conformance with Section 4-
203(MX1XbX5)
d. A water quality test for the new well in conformance with Section 4-
203(MX1XbX5)
Conditions of Approval:
2. All representations of the Applicant contained in the application shall be considered
conditions of approval unless specifically modified by the Board of County
Commissioners.
3. The Applicant shall comply with Additional Standards for Residential Uses
contained in Section 7-701, Accessory Dwelling Units, of the Land Use and
Development Code of 2013, as amended.
4. The FloorArea for the Accessory Dwelling Unit shall not exceed 3,000 square feet'
5. The ADU shall be subject to all Garfield County Building Code Requirements. The
property owner shall obtain any necessary Garfield County Building Permits for
modifications and/or expansions to the ADU structure.
6. All exterior lighting shall be downcast and shielded and comply with SectionT-304,
Lighting Standards, of the Land Use and Development Code of 2013, as amended.
T. An ADU is restricted to leasehold interest in the dwelling unit and is for residential
or Home Office/Business use only, as described in the Land Use and Development
Code oI 2013, as amended.
8. Approval of a Land Use Change Permit for this use is in no way intended to
supersede any other requirements placed on this property such as a matter of
private covenant or otherwise.

Dear Planning Departrnent,
I sfiongly objeet to the approval of a second dwelling on Ranch l7 Lookout Mountain Ranches
for two reasons.
l. The parcel is in the Lookout Mountain Home Owners Association which has covenants
restricting a second dwelling. The real reason for this was due to the area's arid
conditions and an attempt to not over use the available water supplies.
2. I agree that there is an existing well, but Ranch 16 only owns % of that exempt well.
Ranch 14 Red Ridge Ranches (I4RRR) owns the other Yzof that well. Ranch l7 does not
own water to serve the second dwelling. I happen to own Ranch l4 Red Ridge Ranches.
Additionally,l own Ranch 13 south of Ranch 17. I have allowed minimal use of my
exempt well on Ranch 13. A neighbor who is % mile south has no water, so I allow him
to fill a smalltruck from the Ranch l3 well. About six weeks ago that well went dry,
and further water challenges will come to this area- Zancanella and Associates
Engineers has a log of all former water levels in the six wells that are within about 1,000
feet of this wellon Ranch 17. I know it is dry. All wells should be tested to see how
much depletion has occurred. I Ranch l7 wants a second house, a lot line adjusbnent
should be done, and Ranch l7 should have to drill a new well 600+ feet from the current
well and Ranch l5's well.

I. GENERAL INFORMATION
A request was received on September 28,2OLG for Administrative Review of an Accessory Dwelling Unit
(ADU) to be located approximately 5 miles east of Glenwood Springs at727 County Road 120 (Lot 17 of
Lookout Mountain Ranches). The ADU has been constructed without necessary Building or Land Use
Permits and has been issued a Notice of Violation. This application for a Land Use Change permit is to
correct this zoning violation.
A request for an ADU in the Rural Zone District is an Administrative Review pursuant to Section 4-103 of
the Garfield County 2013 Land and Development Code, as amended (LUDC). This process grants the
decision-making authority to the Director of Community Development. This process also allows for call-
up of that decision for review by the Board of County Commissioners. A decision that is called up requires
scheduling of a public meeting so that the Board may determine whether to reconsider the Director
Decision in a noticed public hearing.
A Director Decision of approval with conditions was issued on Decembe r 72,2076 and a request for call-
up was received from Wayne Rudd, an adjacent property owner, on December 22,201,6. Due to certain
water rights issues identified during the application review, the approval requires that adequate and legal
water be obtained' As a result, the approval includes one Condition of Approval to be satisfied prior to
issuance of the Land Use Permit, which is to obtain a new well permit, drill a new welland test the water
from that well in accordance with the requirements of the LUDC.
