SUBJECT: Steele Subdivision Exemption

The Board will recall the necessity in continuing this exemption petition was predicated on issues
surrounding the new bridge across Mitchell Creek, providing access to the proposed exemption
parcel, emergency vehicle and fire protection access and development issues relative to the slope of
the parcel. Since the last continuance, the applicant has submitted the following information:
1] An engineering analysis of the new bridge, which has examined the structure and construction
of the bridge, concluding that the Inventory Level of the bridge (capacity) is rated at 22 tons.
Simply put, a 22 ton vehicle could be parked on the bridge for an indefinite period of time
without danger of collapse. The analysis concludes with a recommendation that the running
boards be attached to the decking for even distribution of the live load. See attached letter,

2l Sopris Engineering has studied the slope of the proposed exemption parcel, concluding that
with the slight adjustment of a lot line, the parcel would have I 48 acres of land with slope
of 30oh or less. According to County and State regulations, this amount of land should 6e
sufficient to develop a single family residence with adequate 4om-for placement of an
individual sewage disposal system. See letter and map, pages Jj L ;

on this information, staffsuggests the following findings are appropriate.
That proper posting and public notice was provided as required for the meeting before the
Board of County Commissioners.
That the meeting before the Board of County Commissioners was extensive and complete,
that all pertinent facts, matters and issues were submitted and that all interested parties were
heard at that meeting.
That for the above stated and other reasons, the proposed exemption is in the best interest of
the health, safety, morals, convenience, order, prosperity and welfare of the citizens of
Garfield County.

Staffrecommends APPROVAL of the petition, pursuant to the following conditions.
1. That all representations of the applicant, either within the application or stated at the meeting
before the Board of County Commissioners, shall be considered conditions of approval.
2. A Final Exemption Plat shall be submitted, indicating the legal description of the property,
dimension and area of the proposed lots, access to a public right-of-way, and uny p.opor.a
easements for setbacks, drainage, irrigation, access or utilities.
3. That the applicant shall have 120 days to present a plat to the Commissioners for signature,
from the date of approval of the exemption. The Board may grant extensions of up to one
(1) year from the original date of approval.
4. That the applicant shall submit $200.00 in School Site Acquisition Fees for the creation of the
exemption parcel.
6. That, prior to the authorization of an exemption plat, the applicants receive an approved
driveway permit, for the proposed access, from the Garfield County Road and
-Bridge
Department.
7 . That the well be drilled and purnp-tested for four (4) hours with the results presented to the
Planning Department along with a statement by the individual conducting the pump test that
the well is capable of supplying the intended uses. Additionally, the *ut.. qualiiy shall be
tested for nitrate, nitrite and fecal coliform bacteria content.
8. That the recording fees for the exemption plat and all associated documents be paid to the
County Clerk and Recorder prior to the signing of a Final Plat by the Board of County
Commissioners and a copy of the receipt be provided to the Planning Departrnent.
9. That the exemption plat submittal include a copy of a computer disk of the plat data,
formatted for use on the County Asiessor's CAD systern.
10' The applicant shall abide by the recommendations contained in the Oddo Engineering letter
dated February 3, 1997.
1 l. That all proposed lots shall comply with the Garfield County ZoningResolution of 197g, as
amended, and any building shall comply with the 1994 Uniform Building Code, as adopted.
12. That the following plat notes be included:
"Prior to issuance of a building permit, the owner shall prepare and submit a soils and
foundation report, an I.S.D.S. design, and a grading and drainage plan prepared and certified
by a professional engineer. All improvements shall be constructed in acCordance with such
measures, which shall be a condition of the building permit."

"The minimum defensible space distance shall be 30 feet on level terrain, plus appropriate
modificationto recognizethe increased rate of fire spread at sloped sites. The methodtlogy
described in "Determining Safety Zone Dimensions, Wildfire Safety Guidelines for Rural
Homeowners," (Colorado State Forest Service) shall be used to determine defensible space
requirements for the required defensible space within building envelopes in areas exceeding
five (5) percent grade.
"The individual lot owners shall be responsible for the control of noxious weeds."
"One (1) dog will be allowed for each residential unit within an exemption and the dog shall
be required to be confined within the owner's property boundaries, with enforcement
provisions allowing for the removal of a dog frorn the area as a final rernedy in worst cases.,,
"No open hearth solid-fuelfireplaces willbe allowed anywhere within an exemption. One (l)
new solid-fuel burning stove as defined by C.R.S. 25-7-401, et. seq., and the regulations
promulgated thereunder, will be allowed in any dwelling unit. All dwelling units will be
allowed an unrestricted number of natural gas burning stoves and appliances.',
"AIl exterior lighting shall be the minimum amount necessary and that all exterior lighting be
directed inward, towards the interior of the subdivision, except that provisions may be made
to allow for safety lighting that goes beyond the property boundaries. "

RE:Steel Residence Access Bridge Crossing Mitchell Creek

Dear Rudy
On January 27, Lg97, Oddo Engineering, Inc. personnel observed the existing condition of the
Steel Residence Access Bridge spanning across the Mitchell Creek in Garfield County. Colorado.
The scope of our observation was to cletermine the capacity of the existing bridge.
The bridge superstructure is made up of four W21x62 rolled beams spaced at 3'-0,, o.c. ,nd clear
spanning 32'-O". The main deck is 13'-3" out to out, consisting of 4x12 timbers attachecl to the
beams with Vz" diameter machine bolts at 24" o.c. Perpendicular to the main deck are ZxlZ
running boards for each wheel line. The beams are laterally braced with angle cross bracing at7'-0" o.c. The abutments consist of a concrete stem wall and spread footing. The sieel
reinforcing is unknown but was mentioned to be #5 at 16,' o.c.
This bridge was inspected and analyzecl in accorclance with the standards published by the
American Association of State Highway and Transportation Officials (AASHTOi anri analyied in
accordance with the standards of the Colorado Department of .Transportation (CDOT). No
existing drawings are available to verify the above description of the bridge. but it was mentionecl
that the bridge was built in June 1996.
The capacity of the bridge is 22 Tons at the Inventory Level. The Inventory Level will result in a
load level which can safely utilize the bridge for an inciefinite period of time.
We do recorlmend attaching tlrc 2x72 running boarrls to the 4x12 clecking with 16d nails at4" o.c. staggered for even distribution of the Live Loacl.

Wc have reviewed the topographic iufornration that was supplied by Rivcr City Surveys, LLC at five foot
contour intervals for your two-lot exemptiou subdivision along Mitchell Creek, just above the Colorado
Division of Wildlife's fish hatchery, It is also our undetstauding that the contours are from the City of
Glenwood Springs aerial photographic mapping. The southeur lot has au existing house so no buildilrg site
was reviewed for this lot. Attachcd is a drawing shorving a 1.48 acrc building sitc on the northcnr lot with
3Ooh or less slope. This building site is easily accessed with the existing driveway cut. The building site is
large enough that the ISDS can be placed within the building site also. I would recorruirend that the ISDS .
be designed by a Ilegistered Iingineer at thc timc of your building perrnit process, so the site specifics are
known and the ISDS can be sizcd and designed propcrly.

RELATIONSIIIP TO THE COMPREEENSTVE PLAN
The subject tract of land is located within the Medium Density Residential and Low Density
Residential Proposed Land Use Districts, as designated in the Garfield County Comprehensive
Plan for Study Area I (1995).
DESCRIPTION OF THE PROPOSAL
A. Site Description: This9.22 acre tract is situated immediately nofth of the Glenwood
Springs Fish Hatchery on the east side of County Road 132. There is an existing
single family dwelling and garage on the tract and a new bridge spanning Mitchell
Creek has been constructed in conjunction with a new access road. The lower portion
of the tract is relatively level; however, the raajority of the tract consists of slopes in
excess of 4Oo/o. See vicinity map, page t 12- t '

B Adjacent Land Uses: Land uses within the vicinity of the subject tract range widely
from agricultural, the fish hatchery, a bed and breakfast and residential land uses. The
Bureau of Land Management owns a sizeable portion of land adjacent to this tract.
Proposal: The applicant is proposing to subdivide, by exemption, the 9.22 acre tract
into two (2) parcels of 4.6t acres each. One parcel would consist of the existing
residence and staffpresumes the other tract would eventually be developed as a single
family homesite. See sketch map, page t , t,
C.
Itr.MAJOR ISSUES AND CONCERNS
Subdivision Regulations. Section 8.52 of the Garfield County Subdivision
Regulations states that "No ruore than a total of four (4) lots, parcels, inlerests or
dwelling unils will be createdfrom uny parcel, as that parcel was described in the
records rf the Garfield County Clerk arul Recorder's Office rtn January l, 1973, and
is not a part of a recorded subdivision; however, any parcel to be divided b1t
exemplion that is split by a public right-of-way (Stcrte or ?-ederal higlnuay, County
road or railroad) or natural.feahffe, preverrting joirtt use of the proposed tracts, and
the division occurs along the public right-of-way or naturalfeature, such parcels
thereby created nruy, in the discretion of the lJoard, not be considered to have beert
created by exemption with regcvcl lo lhe four (4) lot, parcel, interest or dwelling unil
limitation otherw ise app licah le ; "
The petitioner obtained the tract iq March, 1992, which apparently consisted of two
(2) farcels. See deed, paget l{.lJ According io the ZoningResolution's
definition of "Lot," since these parcels are contiguous and are held in common, then
the parcels would be considered as a singular parcel no later than May, 195% the {ate
the deed between Cannafax and Warren was recorded. See d""d, page le t 17
Given this interpretation, it appears this request complies with Section 8:52 (A) of the
Subdivision Regulations. Incidentally, this application was received prior to the
recent changes to Section 8:00 ofthe Subdivision Regulations and is being considered
under the earlier criteria.
Zorung. The tract is within the A/R/RD zone district and both proposed lots are in
excess of the two (2) acre minimum lot size requirement. Given the location of the
tract of land, it would appear that slope may be a significant constraint to
development. The petitioner has submitted a map that staffhas utilized to calculate
slope, and it appears there is sufficient area to rneet tlle provisions of Section 5.04.02
of the ZoningResolution. See slope map, page t ll I The line that bisects the
7.716 acre area has been calculated to have a slope of 15olo, which should allow
sufficient area to construct a single farnily dwelling and ISD system. However, slope
ofthe access road has been calculated to be approximately 15.8%, which may be too
steep for emergency vehicle access. Likewise, the radius of the switchback at 6T90
feet has been calculated to be no greater than20 feet. Additionally, the bridge over
Mitchell Creek has been constructed in a manner that creates two (2) 90 degree turns

that rnust be negotiated to access the proposed tract. Pursuant to Section 5 04 02 of
theZoningResolutioq staffrecommends the applicant demonstrate that the proposed
building site consists of at least one ( I ) acre of contiguous land that is less than 40o/o
slope, within this area demonstrate there is at least 1000 square feet of land less than
30% slope (for the placement of an ISD system) and demonstrate the access road
does not exceed the 14o/o maximum grade allowed by variance.
Water Supply: It appears the existing dwelling is served by a spring; however, no
information regarding this spring has been submitted for review. The proposed lot is
the subject of a receqtly issued, household use only, well permit No. 195412. See
*"il p.,-it , page2/E'o Additional information concerning wells recently drilled
in the area has been submitted, which appears to attest to a physical supply of-water,
perhaps as much as 25 gprn. See pump-test information, pages tAO i2l Stut
recommends that, if approved, the proposed well be drilled and pump-tested, prior to
final approval. Staffhas concern that the conditions of approval of the well perrnit
may not provide for a sufficient amount of water for fire fighting purposes.
Sewer/Soils: The method of waste water treatment fbr the proposed lot would be the
use of an individual sewage disposal system. According to the Soil Conservation
Service, the soils on-site where the new dwelling could logically be built are a Jerry
loam, considered to be lirnited by high shrink-swell potential, steep slopes and low
strength. Additionally, the SCS states that building sites and roads need good
drainage and that the soil slurnps when saturated or if cut deep. When used for
placement of ISD systems, the soil has severe constraints due to slow percolation and
slope. Staffrecornmends the inclusion of a plat note to address these limitations.
Access: Access to the existing dwelling is directly from CR 132, which would also
provide access to the proposed lot. As discussed previously, this access would be via
a new bridge across Mitchell Creek that would offer significant challenges to large
vehicles. Staffrecommends that the applicant demonstrate the access road meets the
provisions of Section 5 04.OZ of the ZoningResolution and further recommends that
the Glenwood Springs Department of Emergency Services specifically approve the
dimensions and adequacy of the road.
Fire Protection: The Glenwood Springs Department of Emergency Services has
commented on the proposal, indicating the tract is within its district and emergency
response would continue to be provided. The Department states that if further
development is proposed, requirements of the Uniform Fire Code may apply,
including: adequate water supply for fire flows; adequate road grades, widths and
surfaces; and wildfire mitigaiion plans. See the letter, page.a/' Staff
recommends the inclusion of a plat note to address wildfire mitigation. Additionally,
staff suggests the Department specifically approve the adequacy of a water supply for
fire flows.

G. Easements: All required easements for access, utilities, water supply, etc.,would be
required to be shown on an exemption plat.
H. School Site Acquisition Fees: The applicant will be required to pay the $200 school
impact for the creation of the exemption parcel.

The Board will recall the necessity in continuing this petition was tt
demonstrate compliance with certain exemption requirements. The staf- -
from the original staffreport, stated the following:
"Staff recommends a continuance to allow the petitioner time to demonstrate the various issues
raised within this report can be met. Specifically, thot the access road has been constructed to
allowable tlimensions, that there is a sfficient building site.for the construction of a dwelling and
ISD system, that adequate fire protection exists, including adequate access for emergency equipment
and water for /ire flows."
The applicant has apparently consulted with the Glenwood Springs Department of Emergency
Services regarding tle fire protection requirements, who has provided the letter attached to this
addendunr, i*" " 2 . issentially, the Depart ment "recommentls" that the applicant do certain
things; however, it appears the Department may not have the authority to require the applicant to
comply with the recommendations.
To date, no additional information requested of the applicant has been submitted for review.
In regard to exemption requirements, Section 8:52 states: "The Board shall not grant an exemption
unless the division proposed for exemption has satisfied the following criteria:"
Item G: "Fire protection has been approved by the appropriate fire district."
This provision creates a dilemma in that the standard letters received for exemptions do not
necessarily state specific approval by the fire district. These letters usually state that the property is
within a particular district and that emergency response would continue to be provided. When asked
for specific approval, the fire district generally cannot give its consent due to the fact that most lots
are not being proposed for specific development. It is generally inferred that the creation of the lot
would eventually result in the construction of a single family dwelling, sometime in the future. In
other words, the fire district will not approve a plan until specific development is proposed, which
may be years later. Therefore, this determination ultimately rests on the Board.
Still remaining to be addressed are the issues concerning the new bridge's ability to provide adequate
and safe access to emergency vehicles, as noted in the staffreport and the attached letter, and the
determination that the proposed lot, which staffcontemplates would be developed as a single family
residential lot, can meet applicable requirements. Without this information, staffcannot recommend
approval of the petition and suggests that either the application be denied or continued, again, to a
date certain.

I have read your letter to Rudy Steele in reference to the subdivision exemption and your
comments about the fire protection. I agree with you that these fire protection items should be
installed. Unfortunately, according to our codes, we cannot require that these items be furnished
without knowing what is going to take place on the site. Our codes specify that the mentioned
requirements be installed when there are two or more R-3 units proposed. At this time, there is
no proposal for what will eventually be on the site, Mr. Steele has stated that no more than one
dwelling unit will be built on the site and that this could be years away.
I have requested that Mr. Steeie provide us with an engineers analysis of the bridge to
insure that our apparatus will be able to use it. If the bridge is to be used to provide emergency
vehicle access (only access to the site) it will have to slrpport the loads of the fire apparatus. As
'far as water supply and the access road, we strongly recommend that when construction takes
place, that the roads meet county standards and that some form of fire protection water supply is
firrnished to the site. Again, we cannot require these items until we know what will be placed on
the site.
We highly recommend that any structures that are built within our jLrrisdiction be
provided with adequate access, water for fire flows and that the wildland fire threat is taken into
consideration when constructing buildings. Please make the Board aware of our concerns. If you
have any questions, or need more information, please give me a call.

SUGGf,STED FINDINGS
1. That proper posting and public notice was provided as required for the meeting before
the Board of County Commissioners.
2. That the meeting before the Board of County Commissioners was extensive and
complete, that all pertinent facts, matters and issues were submitted and that all
interested parties were heard at that meeting.
3. That for the above stated and other reasons, the proposed exemption is in the best
interest of the health, safety, morals, convenience, order, prosperity and welfare of the
citizens of Garfield County.
RECOMMENDATION
Sta.ffrecommends a continuance to allow the petitioner time to demonstrate the various issues
raised within this report can be met. Specifically, that the access road has been constructed
to allowable dimensions, that there is a sufficient building site for the construction of a
dwelling and ISD system, that adequate fire protection exists, including adequate access for
emergency equipment and water for fire flows.

RELATIONSHIP TO TIIE COIVIPREHENSTVE PLAN
The subject tract of land is located within the Medium Density Residential and Low Density
Residential Proposed Land Use Districts, as designated in the Garfield County Comprehensive
Plan for Study Area I (1995).
DESCRIPTION OF THE PROPOSAL
A. Site Description. Thrs9.22 acre tract is situated immediately north of the Glenwood
Springs Fish Hatchery on the east side of County Road 132. There is an existing
single family dwelling and garage on the tract and a new bridge spanning Mitchell
Creek has been constructed in conjunction with a new access road. The lower portion
of the tract is relatively level; however, the y)aJority of the tract consists of slopes in
excess of 40o/o. See vicinity map, page __b__

B. Adiacent Land Uses: Land uses within the vicinity of the subject tract range widely
from agricultural, open space, the fish hatchery, a bed and breakfast and other
residential land uses. The Bureau of Land Management owns a sizeable portion of
land adjacent to this tract.
C. Proposal: The applicant is proposing to subdivide, by exemption, the 9.22 acre tract
into two (2) parcels of 4.61 acres each. One parcel would consist of the existing
residence and staff would assume the other tract would be developed as a single
family homesite. See sketch map, page 7
MAJOR ISSUES AND CONCERNS
A. Subdivision Regulations: Section 8'.52 of the Garfield County Subdivision
Regulations states that "No more than o total of four (1) lots, parcels, interests or
dwelling uttits will be createdfrom any parcel, us that parcel was described in the
recorcls of the Garfield Llounty Clerk and Recorder's Office on Jarumry I , I97 3, and
i.s not ct pqrt of a recorded subdivision; however, any parcel to be divided by
exemption that is sptit by a ptblic right-of-way (State or Federal higlway, ('owrty
road or railroad) or naturalfeature, preventing joint use of the proposed tracts, and
the division occurs along the prblic right-o/-way or natural feature, sttch parcels
thereby created moy, in the discretion of the Board, not be considered to have beert
created by exemption with regard to the four Q) lot, parcel, interest or tfivelling unit

The petitioner obtained the tract in M41ch, 1992. which apparently consisted of two
(2) parcels. See deed, paget *. ? According io the Zoning Resolution's
definition of "Lot," rin.. th.r. p#..iiur. .ontiguous and are held in common. then
the parcels would be considered as a singular parcel no later than May. 1959. the date
the deed between Cannafax and Warren was recorded. See deed. iage fi'4
Given this interpretatioq it appears this request complies with Section 8 52 (A) of the
Subdivision Regulations. Incidentally, this application was received prior to the
recent changes to Section 8:00 of the Subdivision Regulations and is being considered
under the earlier criteria.
B. Zoning'. The tract is within the A/RED zone district and both proposed lots are in
excess of the two (2) acre minimum lot size requirement. Given the location of the
tract of land. it would appear that slope may be a significant constraint to
development. The petitioner has submitted a map that staffhas utilized to calculate
slope, and it appears there is sufficient area to meet the provisions of Section 5 04.02
of the Zoning Resolution. See slope map. page I L The line that bisects the
1.716 acre area has been calculated to have a slope of l5%, which should allow
sultrcient area to construct a single family dwelling and ISD system. However, slope
of the access road has been calculated to be approximately I 5.8o/o. which may be too
steep fbr emergency vehicle access. Likewise. the radius of the switchback at 6190
feet has been calculated to be no greater than 20 feet. Additionally. the bridge over

Mitchell Creek has been constructed in a manner that creates two (2) 90 degree turns
that must be negotiated to access the proposed tract. Pursuant to Section 5 04 02 of
the Zoning Resolution, staffrecommends the applicant demonstrate that the proposed
building site consists of at least one (l) acre of contiguous land that is less than 40o/o
slope, within this area demonstrate there is at least 1000 square feet of land less than
30% slope (for the placement of an ISD system) and demonstrate the access road
does not exceed the l4o/o maximum grade allowed.
C. Water Supply: It appears the existing dwelling is served by a spring, however, no
information regarding this spring has been submitted for review. The proposed lot is
the subject of a recently issued, household use only, well permit No. 195412. See
well permit, page I 2 Additional information concerning wells recently drilled
in the area has been submitted, which appears to attest to a physical ypplyrcf water,
perhaps as much as 25 gpm. See pumptest information, pages 14- i( Staff

recommends that, if approved, the proposed well be drilled and pump-tested, prior to
final approval. Staffhas concern that the conditions of approval of the well permit
may not provide for a sufficient amount of water for fire fighting purposes.
Sewer/Soils: The method of waste water treatment for the proposed lot would be the
use of an individual sewage disposal system. According to the Soil Conservation
Service, the soils on-site where the new dwelling could logically be built are a Jerry
loam, considered to be limited by high shrink-swell potential, steep slopes and low
s;rcngth. Additionally, the SCS states that building :ites and roads ner:d good
drainage and that the soil slumps when saturated or if cut deep When used for
placement of ISD systems, the soil has severe constraints due to slow percolation and
slope. Staff recommends the inclusion of a plat note to address these limitations.
Access: Access to the existing dwelling is directly from CR 132. which would also
provide access to the proposed lot. As discussed previously, this access would be via
a new bridge across Mitchell Creek that would offer significant challenges to large
vehicles. Staffrecommends that the applicant demonstrate the access road meets the
provisions of Section 5.04.02 of the Zoning Resolution and further recommends that
the Glenwood Springs Department of Emergency Services specifically approve the
dimensions and adequacy of the road.
Fire Protection: The Glenwood Springs Department of Emergency Services has
commented on the proposal. indicating the tract is within its district and emergency
response would continue to be provided. The Department states that if further
development is proposed, requirements of the Uniform Fire Code may apply.
including: adequate water supply for fire flows; adequate road gradesrwidths and
surfaces. and wildfire mitigation plans. See the letter, page / 5 Staff
recommends the inclusion of a plat note to address wildfire mitigatio'n. Additionally.
staf suggests the Department specifically approve the adequacy of a water supply for
fire flows.
G.Easements: All required easements for access, utilities, water supply, etc.,will be
required to be shown on an exemption plat.
School Impact Fees: The applicant willbe required to pay the $200 school impact for
the creation of the exemption parcel.
Potential Road Impact Fees: Upon adoption of a road impact fee by the County, the
lots created by this exemption will be subject to paying that fee; paid at time of
building permit application, paid by the building permit applicant. This provision shall
be included as a plat note.

he has no objections to this request. See letter, page J+-
SUGGESTED FINDTNGS
l. That proper posting and public notice was provided as required for the meeting before
the Board of County Commissioners.
That the meeting before the Board of County Commissioners was extensive and
complete, that all pertinent facts. matters and issues were submitted and that all
interested parties were heard at that meeting.
That for the above stated and other reasons, the proposed exemption is in the best
interest of the health. safety, morals. convenience. order, prosperity and welfare of the
citizens of Garfield County.
RECONIMENDATION
Staffrecommends a continuance to allow the petitioner time to demonstrate the various issues
raised within this report can be met. Specifically. that the access road has been constructed
to allowable dimensions. that there is a sufficient building site for the construction of a
dwelling and ISD system. that adequate fire protection exists, including adequate access for
emergency equipment and water for fire flows. If the Board determines that all questions are
adequately answered, then staff recommends approval of the application, pursuant to the
following conditions
That allrepresentations of the applicant. either within the application or stated at the
meeting befbre the Board of County Commissioners, shall be considered conditions
of approval.
A Final Exemption Plat shall be submitted, indicating the legal description of the
property, dimension and area of the proposed lots. access to a public right-of-way,
and any proposed easements for setbacks, drainage. irrigation, access or utilities

That the applicant shall have 120 days to present a plat to the Commissioners for
signature, from the date of approval of the exemption. The Board may grant
extensions of up to one (l) year from the original date of approval.
That the applicant shall submit $200.00 in School Impact Fees for the creation of the
exemption parcel.
That the following plat notes be included:
"Prior to issuance of a building permit, the owner shall prepare and submit a soils and
foundation report, an I.S.D.S. design, and a grading and drainage plan prepared and
certified by a professional engineer. All improvements shall be constructed in
accordance with such measures, which shallbe a condition of the building permit."
"The minimum defensible space distance shall be 30 feet on level terrain. plus
appropriate modification to recognize the increased rate of fire spread at sloped sites.
The methodology described in "Determining Safety Zone Dimensions. Wildfire Safety
Guidelines for Rural Homeowners," (Colorado State Forest Service) shall be used to
determine defensible space requirements for the required defensible space within
building envelopes in areas exceeding five (5) percent grade.
"IJpon adoption of road impact fees by the Board of County Commissioners, the lots
created by this exemption shall be subject tc. paying the fees, paid at time of building
permit application. paid by the building permit applicant."
"The individual lot owners shall be responsible for the control of noxious weeds."
That, prior to the authorization of an exemption plat, the applicants receive an
approved driveway permit, fbr the proposed access, from the Garfield County Road
and Bridge Department.
That the wellbe drilled and pump-tested for four (4) hours with the results presented
to the Planning Department along with a statement by the individual conducting the
pump test that the well is capable of supplying the intended uses
That the recording fees for the exemption plat and all associated documents be paid
to the County Clerk and Recorder prior to the signing of a Final Plat by the Board of
County Commissioners and a copy of the receipt be provided to the Planning
Department.
That the exemption plat submittal include a copy of a computer disk of the plat data.
formatted for use on the County Assessor's CAD system.
That the Glenwood Springs Department of Emergency Services specifically approve

ISSUANCE OF THIS PERMIT DOES NOT CONFER A WATER RIGHT
CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of the
permit does not assure the applicant that no injury will occur to another vested water right or preclude another
owner of a vested water right from seeking relief in a civil court action.
2) The conslruction of this well shall be in compliance with the Water Well Construction and Pump lnslallation
Rules 2 CCR 402-2, unless approval oi a variance has been granted by the State Board of Examiners of Wate:
Well Construction and Pump lnstallation Contractors in accondance with Rule 18.
3) Approved pursuant to CRS 37-92-602(3)(b)(llXA) as the only well on a residential site MORE PARTICULARLY
DESCRIBED ON THE AfiACHED EXHIBIT A.
4) The use of ground water from this well is limited to ordinary household purposes inside a single family
dwelling. The ground water shall not be used for inigation or other purposes.
5) The maximum pumping rate shall not exceed 15 GPM.
6) The retum flow from the use of this well must be through a non-evaporative waste water disposal system
where the water is retumed to the same stream system in which the well is located.
7) This wellshall be constructed not more that 200 feet from the location specified on this permit.
