Sunlight Inn Property

Dear Con'rnissioners:
On behalf of the Sunlight Inn Partnership, a Colorado Corporation, Irespectfully submit the attached petition for exemption and supplenentalinfornation. The 5.26 acre parcel is located jrnrediatly north of the Ski
Sunlight parking 1ot. Four l4i1e Creek flows through the paroel. The SunlightInn is located north of the Creek adjacent to County Road 117.
The petition requests the division of the parcel into two lots of
approxinrately 1.76 acres and 3.5 acres. The dividing lotline generally
follcnvs the course of Four Mile Creek. The property is zoned
Cornercial/Linrited.
The boundary survey for the existing 5.26 acre tract is dated July of 7972.If this is not sufficient proof of the property's qualification for o<anption,varification by a tilte company can be provided.
Soils:
SCS soils rnapping is presently being prepared but is not yet available forthis si-te. Attached are desaiptions of soil types found a short distance
dovmstream and anti-cipated to be sjmilar to the soils whj-ch nay characterizethe Sunlight Inn site. With appropnate precautions regarding high watertable, lotv strengith and shrjnk-swell potentral, soils should not createlinitations to construction on the site. Floodinq appears to be ljrnited to
confined areas within the steeper banks of the stream channel.

Water:
lVater is available from two existing adjudicated weIls. See the attached
Water Court Decrees. "The Ranch WeIl" is located west of the Inn on Iot 1.
"The Main WeII" is located south of the Creek on Lot 2. The well water rightswill be transfered with the lots on vfiich the wel1s are located.
Wastewater Treatnent:
The pro6:erty is presently served by a treatnent plant dcx/snstream on ski areaproperty. A joint use agreenent (attached) al1ows for e>pansion of the plant
by any of the parties to the agreement. The terms of this agreenent are
transferable to the newly created lots.
Easenents:
The final plat will include appropriate notes regarding access, utility andpedestrian eassnents.

Flwaquents are stratified and vary widely in to(ture and depuh to sand,
gravel and cobbles. The surface layer ls lomry sand Eo fine sandy Ioam and
silty loam to clay loam. the underlying layers are generally sandy loam or
loam stratified with sand, gravel, and cobbres. rn scrne areas, graver and
cobbles are on or near the surface.
The water table fluctuates between depths of 0.5 and 2 feet, during
spring and stnrner. Ihese soils are subject to brief, occasional flooding
late in spring and early in strnner.
Included in mappin8 are small isolated areas of Redrob soils. $nall,
isolated areas virere water stands at or near the surface a1l year are
identified by wet spot and marsh spot syrnbors. These areas make up 15
percent of che map r,:niu.
These soils are used for wildlife habitat, recreation, and grazing.

The vegetation in areas noc cultivateci is mainly woody shrubs, grasses,
and forbs.
This unir is 5U percent Jerry and 40 percent Millerlake. The ccruponents
of rhis unit are so intricately intermingled that it raas not practical to
map thsCI separately at the scale used.
Included in this unit are snrall areas of Cochecopa, Antrobr:s, Arrvik,
skylick, sligting, Yeljack, and callings soils. rncluded areas make up
about 10 percent of the fotal acreage.
The Jerry soil is deep and well drained. It formed in alluvirm derived
dominantly from sandstone and shale. Tlpicaliy, the surface layer is dark
grayish brosn loar 1 1 inches thick. the subsoil is channery clay loam 23
inches thick. The substrat\.rn to a deprh of 60 inches is very channery clay
Ioam. Coarse fragment content ranges frorn 1 5 to 35 percent by volune in a
major part of the B and C horizons.
Permeability of the Jerry soil is moderate. Available vrater capacity is
moderate. Effective rooting, depth is 40 to 60 inches. Runoff is rapid, and
the hazard of water erosion is very high.
The Millerlake soil is deep and vreIl drained. It formed in allwitrn
derived domi.nantly frour sedinrentary bedrod<. Tlpically, the swface layer
is dark gray loam 18 inches tirick. The subsoil is clay loarn 1 1 inches
thick. The upper 14 inches of the substratun is clay loan. the lo^rer parc
to a depth of 60 inches is very cobbly loam. Depth to secondary calciun
carbonate ranges frcrn 15 to 40 inches.

brome, elk sedge, mouncain snowberry, Gambel oak, and saskatoon
serviceberry. Other less extensive grasses thaE characterize this unit are
slender wheatgrass, needlegrasses, and wheatgrasses. The average annual
production of air-dry vegetation is about 2,000 pounds per acre. rf the
condition of the range deteriorates, Gambel oak, mountain snowberry, and
Saskatoon serviceberry increase.
The potential plant community on the Millerlake soil is nainly bluebunch
wheaEgrass, Indian ricegrass, needlegrass, and Saskatoon serviceberry.
Ocher less numerous plants.that characterize this site are muttongrass,
Idaho fescue, antelope bitterbrush, and mountain big sagebrush. The average
annual producEion of air-dry vegetation is about Ir200 pounds per acre. If
the range condition deEeriorates, mouncsin big sagebrush, mountain snowberry
and forbs -increase. These plants are dominant when the range is in poor
condition; therefore, grazing should be managed so that the desired balance
of species is mainEained in the plant community. If the condition of the
range deterioraEes, Canada thistle, cheatgrass, stickseed, knotweed, tarweed
and hounds tongue increase. The suirability of chis unit for rangeland
seeding is poor.

If this unic is used for hcrnesite developnenc, the main limitations are

resulted in increased conscruction of homes on this unit. Renroval of gravel
and cobbles in disturbed areas is needed for best results v*ren landscaping,

Dear Mr. Bean:
As you are aware, Ski SunIight, Inc.; the Brettelberg
Condominium Association and the owners of the Sunlight Inn, areparties to an agreemenL which provides for the parties mutual
useage of a sewage facility and defines the rights andobligations of the parties with respect thereto. Pursuant to the
agreement, the sewage facility is located upon real property
owned by Ski Sunlight and Ski Sunlight has supervisory authority
over the operation of the system. As attorney for Ski Sunlight,I am familiar with the agreement and the operation of the system.
Please be advised that it is my opinion that pursuant to
the agreement the parties have agreed that any of them may make
additional use of the sewage facilities by the addition,
expansion or modification of the improvements located upon their
respective properties, provided that the party making suchadditional use bears the expense of any necessary improvement tothe sewage system and pays his increased proportionate share ofthe operating expenses after the addition. The right to increase
the use of the sewage systern would be further limited by theterms of the Colorado Department of Hea1th, Colorado Wastewater
Discharge Permit, pursuant to which the facility is operated.
