GARFIELD COUNTY, COLORADO
PETITION FOR EXEMPT]ON
Pursuant to L973 C.R.S. 30-28-101(f0)(a)-(d), as amended,
and the Subdivision Regulations of Garfield County, Colorado,
adopted January 2, L979, Sections 2.02.2f(d) and 3.02.01, the
Petitioner, Stephens Land Company, a limited partnership, by and
through its attorneys, Petre & Zimmerman P.C., respectfully
petitions the Board of County Commissioners of Garfield County,
Colorado to exempt by resolution the splitting off of a tract of
land containing approximately 4.483 acres, more or less, from the
Petitioner's adjacent real property holdings in Garfield County,
from the definitions of "subdivision" and "subdivided land" as
the terms are used and defined in L973 C.R.S. 30-28-101(10)(a)-
(d). Said holdings, including the 4.483 acre tract, are more
particular1-y described in ExhibiL "A" which is attached hereto
and incorporated by reference herein.
The requested exemption should be granted for the following
reasons:
1. The 4.483 acre tract created by the proposed
division contains a dwelling that has long been used
as a single-family residence and the surrounding land
necessary and convenient for small-scale agricultural
purposes. It is anticipated that this tract will be
conveyed to one of the partners of the Petitioner,
James E. Stephens, and that the tract will continue
to be used for such purposes.
2. Physically, the 4.483 acre tract is cut off from
the remainder of the Petitioner's property by the
Sweetwater Creek on the south and Sweetwater Road on
the north. As such, the proposed division is con-
sonant with, and largely dictated by, existing
physical features of the land and established natural
and man-made boundaries.
3. The 4.483 acre tract created hereby has readily
available access by way of the Sweetwater Road which
bounds said tract on the north.
4. A spring and pipeline in use and in place fot a
number of years has been, and will continue to be,
the source of domestic waLer for the 4.483 acre
tract. sewage disposal for the residents of Ehat
tract has been, and will continue to be, by means of
a septic tank and leaching field.
5. Sweetwater Creek adjoins the tract to be divided.
In support of this Petition, Petitioner also submits, as
Exhibit rtBtr aEtached hereto and incorporated by reference herein
a map drawn to scale showing the proposed tract created hereby,
the stream and the access.>k A vicinity map depicting Petitioner's
holdings as divided is attached hereto and incorporated by ref-
erence herein as Exhibit "C".

This napping unit consists of shar--r-ow ancl moderately deep, wet
alluvial- soils on stream terraces , floodolains, oxbows, and swales .
They have thin sunfaces and are highry stratified roams to sand
and become very gravelly and cobbry at clepths of 6 to 40 inches.
The water table is high enough duning at least part of the year to
support mainly willows and water toler.ant grasses and scattened
cottonwood trees. Most of these al^eas are subject to flooding duning
high water spring runoff.
These soils are used as wir-d1ife habitat and for rimited. grazing.
t'Iildlife includ.e mourning clove, htrmmingbirds, ducks, skunks, and
geese. rf there is sma-r-l gnain on adjoining drien soils, Dheasants
use the vegetation on this unit as cover. This unit provides adequate
masqui'toes fon mantins, but nesting facirities would encoura€Je them. rn
the more isolated areas bald Eagres use these soirs whire they d.o
thein winter fishing.
The flooding and high water table render these soirs irl-suited fo.
engineering and sanitary uses. The deposits ,are generalry too stnati-
fied to be a gor:d source of sancl or gravel .
