when the following proceedings, among others were had and done, to-wit:
RESOLUTION NO. 80-105
RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE GARFIELD COUNTY
SUBDIVISION REGULATIONS FOR STEPHENS LAND COMPANY
WHEREAS, Stephens Land Company has petitioned the Board of County
Commissioners of Garfield County, Colorado, for an exemption from the definition of
the terms "subdivision" and "subdivided land" under C.R.S. 1973, 30-28-101 (10)
(a) -(d), as amended, and the Subdivision Regulations of Garfield County, Colorado,
adopted January 2, 1979, Sections 2.02.21 (d) and 3.02.01 for the division of a
2,100 acre tract described as follows: a portion of Sections 20, 21, 22, 23, 24,
25, 26, 27, and 28 in Township 3S, Range 87 W of the 6th P.M. into 2 tracts of
approximately 4.483 and 2095.517 acres each, more or less, which proposed divided
tracts are more particularly described as follows:
Tract A: A parcel of land located in the W 1/2 of Section 24,
Township 3 South, Range 87 blest of the 6th Principal Meridian,
also being adjacent and parallel to the apparent southerly
right-of-way of Sweetwater Road and northerly of the centerline
of Sweetwater Creek. Said parcel being more specifically
described as follows:
Beginning at a brass cap properly marked and set for the west
one-quarter (1/4) corner to said Section 24, thence S.00016'00"I'l.,
55.00 feet to the centerline of Sweetwater Creek, thence along
the centerline of Sweetwater Creek S.54054126" E., 140.57 feet,
thence along the centerline of said Sweetwater Creek S.32015'32" E.,
102.99 feet, thence N.37048'41" E., 18.00 feet to a Witness Corner,
thence N.37048'41" E., 482.23 feet to a point on the apparent
southerly right-of-way of Sweetwater Road, thence N.51012'08" W.,
130.j9 feet along the apparent southerly right-oF-.,.ay of Sweet-
water Road, thence N.54'17'11 " td., 458.40 feet along the apparent
southerly right-of-way of Sweetwater Road, thence S.00016'00" W.,
521.71 feet along the west line of said Section 24, to the place
of beginning. Said parcel contains 4.4;'3 acres, more or less,
in the State of Colorado and County of Garfield; and
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
of County Commissioners of Garfield County, Colorado, that the proposed division
does not fall within the purposes of Part 1, Article 28, Title 30, Colorado
Revised Statutes 1973, as amended, for the reason that the impact created to the
County is not so great as to warrant a full subdivision procedure; and
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
of County Commissioners of Garfield County, Colorado, that there is a reasonable
probability of locating domestic water on each of said tracts, that there is
adequate ingress and egress to said tracts, that the location of septic tanks will
be permitted by the Colorado Department of Health, that the requested division is
not part of an existing or larger development and does not fall within the general
purposes and intent of the subdivision regulations of the State of Colorado and
the County of Garfield, and should, therefore, be iipted from the definition of
the terms "subdivision" and "subdivided land" as sec forth in C.R.S. 1973, 30-28-101
(10) (a) -(d), as amended;
NOW, THEREFORE, BE IT RESOLVED that the division of the above described tract
"A" from the above described 2,100 acre tract is hereby exempted from such definitions
and said tract may be divided into tract "A", all as is more fully described above,
and said divided tract may be conveyed in the form of such smaller tracts without
