HHEREAS, CHARLES F. STEHART, has petitioned the Board of county comnrissioners
of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30-
2g-lOl (tO) (a) - (d) as anBnded, and. the Subdivision Regulations of Garfield
County, Colorado, adopted September 1,1972 and anended ApriI .l4,.l975' Sections
l.0Z.l7 (d) and 3.02.01 for the exemption o'F a five acre tract of land from a
larger tract of land, and said larger tract of land is described as follows:
Township 6 South, Range 89 West of the 6th P'M'

Together with any and all water and water rights, ditches
and ditch rights belonging to or used in connection with
the above deicribed land; and together with the easements
ana righis-of-way aescribed in Ddc. No. 249107 'in Book 4'17
at eagi SS1 and
-Doc. No. 249108 in Book 417 at Page 352
of the Garfield County, Colorado records'
There is excepted from the real property qlgYg described
the tracts of'land described in Doc. No. 240400 in Book
392 at Page 58] and Doc. No. 249189 in Book 417 at Page
512 of th6 Garfield County, Colorado records, reservations
in patents and previous conveyances, and easements and
rights-of-way of a public or private nature.
1IFIEREAS, the Petitioner has demonstrated to the satisfaction of the Board
of County Conrmissioners of Garfield County, Colorado, that he desires said
exemption for the purpose of construction of a cabin in a renpte location;
and,
IIHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
of County Commissioners that there is a reasonable probability of locating
domestic water on each of said tracts, that ingress dnd egress to said tracts'
is in the form of a private easement which is not maintained by the County'
that the location of septic tanks will be permitted by the Colorado Department
of Health, that the requested division wil'l result in the creation of a tract
of Iand which will not have any public utilities available and should be
exempted from the definition of the terms "subdivision" and "subdivided land"
as set forth in C.R.S.(1973) Secti,on 30-28-10l (10) (a) - (d) as amended;

Iand is hereby exempted'from such definition; said exemption is conditioned
upon the Petitioner obtaining a proper'tegal description for said five acre
tract prior to conveyance. A copy of the instrurnent(s) of conveyance when
recorded shal'l be filed with this Resolution.
