Dear Andrew,
We have reviewed the above referenced proposal for comments on a subdivision exemption
on a 20 acre parcel to be split into two 10 acre lots. Currently there is an existing well, Permit
Number 132035, serving one single-family dwelling on the property. The applicants wish to use
this well as the source of water for the second lot.
Upon approval from the County of this exemption, the permit must be changed to reflect that
the well is not the only well on 40 acres, but rather the only well on 20 acres. There is a $60 fee
and application required for this change. Based on this, we have no objections to this proposal.

second of time is hereby awarded to Geners WeII, for clomestic, house-
hold purposes, livestock.water, fire protection and lawn and garden
irrigation purposes, with appropriation date of the 16Lh day of September,

The above described underground water right meets the criteria
for an exempt. domestic well pursuant to c.R,s. 1973, 37-92-602(1) (b),
so long as it is used for the purposes set forth herein, and by. statute.
It is accordingly ORDERED that this ruling .shall be filed with
the Water Clerk and shall become effective upon such filing, subject
to Judlciar review pursuant, to section 37-92-304 c.R.s. Lg73

This unit is 60 Percent Atencio sandy loam and 30 percent Azeltine
gravelly sandy loan. The conponenEs of this unit are so intricately

inches thick' The subsoil is sandy clay loau I0 inches thick over gravelly
sandy loau 4 inches thick. The upper 6 inches of the substratum is gravelly
sandy loam. The lower psrt to a depth of 60 inches is very gravelly sand.
The soil is noncalcareous to a depEh of 20 inches and calcareous below that
depth' In sone areas the surface layer is gravelry or cobbry.
Perueability of the Atencio soil is noderace to a depth of 30 inches
and rapid belors this depth. AvailabIe water capaciEy is row. EffecEive
rooting depEh is 60 inches or Eore. Runoff is slow, and Ehe hazard of ,,a.er
erosioo is slighc.

The potentiar pIanE cor,r-uniEy on this unit is mainry western
wheatgrass, rndian ricegrass, needleandthread, big sagebrush, and Douglas
rabbitbrush. Nevada bluegrass, prairie junegrass, and bottlebrush
squirreltail are also present in the potential plant corr-unity. The average
annual production of air-dry vegetat,ion is about g00 pounds per acre.
Management practices suitable for use on this unit are proper grazing use
and a planned grazing systeo.

The main Iiuitations for seeding are cobbles and stones. For successful
seeding, prepare a seedbed and drirl Ehe seed. Brush tran&ger'enE improves

The Azeltine soil is deep and well drained. Ic fonned in alh-nritnr
derived dominantly from sandstone and shale. Tlpically, the surface layer
is reddish gray gravelly sandy loar 9 inches thick. The upper 7 inches of
che turderlying macerial is gravelly loam. he lower part to a depth of 60
inches is extrmely gravelly sand. The soil is calcareous throughouc che
profile. In scrne areas che surface rayer is cobbly,Ioam or sandy roam.

If this r:nic is used for hay and pasture, the main limitations are low
available water capacicy and small stones. Grasses and legunes grow well if
adeqr:ate fertilizer is used. Using managsnent thac maincains optimrm vigor
and quality of forage plants is a good praccice. Ijecause Ehese soils are
droughcy, applications of irrigation water should be lig,hc and frequent.

Your application for a Subdivision Exemption, located off of County Road 162, has been scheduled
for a public meeting before the Board of County Commissioners on October 14, 1991, at 3:00 p.m.,
in the Commissioners' Meeting Room, Suite 301, Garireld County Courthouse, 109 8th Street,
Glenwood Springs, CO 81601. It is suggested that you be present at the time of the meeting.
Copies of the enclosed exemption public notice form need to be mailed by certihed return-receipt to
all property owners adjacent to or within 200 ft. of your property at least l5 days, but not more than
30 days, prior to the meeting. In addition, the notice needs to be mailed by certified return-receipt to
owners of mineral rights, or lessees of mineral owners ol record of the land proposed for exemption,
at least 15 days, but not more that 30 days, prior to the meeting. The certificates of mailing and
return-receipts from these mailings need to be presented at the time of the meeting or submitted to the -- -
Planning Department prior to the meeting. The exemption site must also be posted with the enclosed
Notice poster, visible from a County Road, at least 15 days, but not more than 30 days, prior to the
meeting.

The above erititled application was filed on April 6, I9B4
and was referred to the undersigned as lrTater Referee for Iriater
Division No..5, State of Colorado, by the l{ater Judge of said
Court on the 3rd day of l,lay , 1984, in aciordance with Article
92 of Chapter 31, Colorado Revised Statutes 1973, known as The
I{ater niqht Determination and Administration Act of 1969.
And the undersigned Referee having made such investigations
as are necessary to determine whether or not the staternents in
the application are true and having become fully,advised with
respect to the subject matter of the application does hereby
make the following determination and ruling as the Referee'in
this matter, to-wit:
The statements in the application are true.
The name of the structure is Stirling Well No. 5.
3. The name of the'claimant and address is:
0488 County Road L62; Carbondale, Colorado.
Ruth Stirling;
4. The source of the water is a well having a completed
depth of I73 feet and being tributary to the Roaring Fork River.
5. (a) Stirling WelI No. 5, as decreed in Case No- 79CI'I383,
is located in the NELNwk of Section 2?, T. 7 S., R., 87 I't7. of the
6th P.lU. at a point 660'feet South of the North line and I,980
feet East of the West Iine of said Section 29.
(b) The actual location of Stirling Well No. 5, as
constructed- and in p1ace, is in the NEkNWk of Section 29 , T . 7
s., .R. 87 W. of the 6th P.1.1. at a point 982 feet south of the
North line, and 2,326 feet East of the l{est line of said Section 29-
6. On June 29 , I98O in Case No. 79CI{383, the V,trater Ref eree
for tnlater Division No. 5 awarded tto Stirling Ir]e1l No. 5, a condi-
tional water right for 0.033 cubic foot of water per second of
time to be used for domestic, household purposes, livestock water,
f ire protect-i-on and lawn and garden irrigation purposes, with
appropriation date of May 15, L979. The claimant was directed to
file in application for quadrennial finding of reasonable diligence
in the aev-topment of this conditional water right in June of 1984

above, to the actual location of the well as constructed, and as
described in paragraph 5 (b) above; and further, claimant requeststhat the 0.033 cubic foot of water per second of time previousllr

8. The change of water right requestecl rvill not injuriouslyaffect the owner of or persons entitled to use water under a
vested water right or a decreed conditional water right, and theapplication for change of water rigtrt should be approved pursuant
to C.R.S. L973, 37-92-305(3).
9. The well was completed and the water was fj.rst diverted
and applied to beneficial use in Februarlz 1984
The Referee does therefore conclude that the above entitledapplication should be granted and the location of Stirling Well
No. 5 is hereby changed from the location as descrj-bed in para-
graph 5 (a) above to the locat.ion as described in paragraph 5 (b)
above.
The Referee does further conclude that the 0.033 cubicfoot of water per second of time previously awarded conditionallyto Stirling Well No. 5 in Case No. 79CW383, should be and herebyis made absolute and unconditional.
It is accordingly ORDERED that this ruling shall be filedwith the I{ater C1erk, subject to judicial review.
It is further ORDERED that a copy of this ruling shall.befiled with the appropriation Division Engineer and the State
Engineer.
