Cerlse Earl Rhodes Mildred Alsdorf when the following proceedings, among others were had and Cone, to-wit: Resolution No. 83-51 A RESOLUTION CONCERNED WITH AN EX},IVIPT'ION I'ROI'I FULL SUBDIVISION REVIEW FOR ALLEN AND ELAINE SUNDMACHER. WHEREAS, Al1en ano Elaine Sundmacher have petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption from the definition of the terms "suboivision" and "subdivioed lano" under C.R.S. (in the State of Coloraoo and County of Garfield); and VIHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that the proposed division does not fall within the purposes of Part 1, Article 28, fi-t1e 30, Colorado Revised Statutes 1973r ds amended, for the reason that the impact created does not warrant further suboivision reviewr dDd WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County Commissioners of Garfielo County, Colorado, that there is a reasonable piobability of locating oomestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks wiff be permitteo by the Colorado Department of Health, that the requested division is not part of an existing or larger oevelopment and doeJ not faIl within the general purposes and intent of the su[aivision regulations of the State of Colorado and the County of Garfielor dDd should, therefore, be exempted from the oefinition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. L973, 30-28-101 (10) (a) -(d) , as amended; NOW, THEREFORE, BE IT RESOLVED that the ciivision of the above described tracts rrArr and rrBrr from the above 51.06 acre tract is hereby exempted from such definitions and said tract may be divided into tracts ,'A:' and "B", aII as is more fully describeci above, and saio divided tract lray be conveyed in the form of such smaller tracts without further ccmptiance ,itf, the aforesaici suboivisron statutes ano regulations; proviCeaT lrrw€Ve f 7 that this e::::.;'-::n is granted on the '-ondition and *itf, the express understanding and agreement of the Petitioners that no further exemptions be allowed oh said tracts rrArr and "B", and that a coPy of the instrument or instruments of conveyance when recorded sha1l be filed with this Resolution.
