WATER WELL USE CLARIFICATION AT BABY BEANS SUBDIVISION
(GARIIELD COUNTY)
l)er review of a replacement application for Water Well Permit No. I09240 (.lohn's Well, Water Courl Case
No. 79CW383) it was noted that this well was servicing 4 single family dwellings in the Baby Beans
SLrbdivision. This is an expansion of use which was not approved by the Office of the State Engineer. The

'l-he property where the Baby Beans Subdivision is located was originally owned by John Stirling. Tr,vo well
permits were issued to Mr. Stirling, each providing separate legal descriptions describing 35-plus acre tracts
ot'land. The two well permits issued are Permit No.94226 (Baby Beans Well) and lO924O (John's Well)
ri hich were both decreed in Water Court Case No. 79CW383.
In 1980 John Stirling, the then property owner, split the properfy through Garfield County's exemption
process (plat signed February 26, 1980). The split created a total of seven (7) lots: two of the lots (lots 5 & 6)
arc located on the south side of County Road 113 and five of the lots. lots 1,2,3.4, &7 are north of County
Iload 1 13.
Currently a total of 5 homes have been constructed at Baby Beans Subdivision (Exemption). Single family
dri'ellings are located on lot 6 (south of the county road) and lots 2, 3,4 &.7 (north of the county road). Lots
1 and 5 are currently vacant.
It appears that the intent for water supply was to be individual wells on lots 5 &.6 and shared wells on the 5
lots located north of the county road. Currently an individual well is located on lot 6 and identifies a well
easement noting "GYM WELL". Additionally two wells exist on lot 7 which are identified by two separate
r.vell easements, per the recorded plat. One well is John's Well (Permit No. 109240, Water Court Case No.
79CW383) and is the most easterly well. The second well is Baby Beans Well (Permit No.94226, Water
Court Case No. 79CW383) and is the most westerly well. Historically John's Well has been the better
producing well and the Baby Beans Well has been marginal. Per conversation with residents in the Baby

Beans Subdivision, John's Well serves all four existing homes, north of County Road I l3 (lots 2,3,4 &7)
and the Baby Beans Well is not used much. Currently both John's Well and the Baby Beans Well are tied into a central system and storage tank . Additionally a well sharing agreement is recorded at the Garfield
County Clerk and Recorder Book 544Page 426 (Baby Beans Road And Water Covenants) giving properry
owners l/5 interest in water system. "The road and water system are intended by Stirling to serve Lots1r2,3,4, and 7 only.,,
Currently John's Well (Permit No. 109240) is experiencing production problems and the Baby Beans
Homeowners are requesting a replacement well permit for John's well. Due to the illegal expanded use ofPermit No. 109240, action must be taken in order tc bring this well and the Baby Beans Well into
compliartce . Options reviewed to bring the well(s) in to compliance are as follows:
I ) Limit water use from each well to a maximum of three single family dwellings. one acre oflawn arltl garden and watering of domestic. Operating each,"vell as independent systems. Thus complyingwith thc original conditions of approval for each well.
2) Request a Temporary Substitute Water Supply Plan and file a plan ol- Augnrentation in water
court to lesalize the current use of John's Well and the Baby Beans Well.
3 ) Because the property was split by the county exemption process, each property owner mighttry for inclividual exempt Household Use Only (HUo) well permits. this may be an option but not a
guarantee that individuai HUO permits could be issued.
At this time the property owners choose item (l) above and will come into compliance with the originalconditions of approval of both John's well and the Baby Beans well.
Per verbai conversation with Jerry Young, representative for the Baby Beans homeowners, John,s WellPermit No. 109240 (pending replacement application) will service Lots 2, 3, & 4. Lot 7 will be limited toservice from the Baby Beans Well Permit No.94226-4 and will disconnect from the central well system,
thus not using any water from John,s Well.

The Baby Bean Ilomeowners of Lots 1r 2,3, 4 & 7 operating under Water Covenants
(1/5 interest) must submit information and documentation showing that John,s Well
and the Baby Beans Well have come into compliance. In order for John's Well and the
Baby Beans Well to comply with the original conditions of approval the maximunr \\ ell
use' per CRS 37-92-602(3)(bXII), would be limited to: three single family dwellings,
one acre of lawn and garden irrigation and the watering of domestic animals, for cach
rvell. If the well use is to continue for both of these wells through the central system
servicing Lots lr 21 3, 4, & 7, a plan of augmentation must be approved in the Division 5
Water Court.
Please note, due to the emergency situation with 4 homes (north of County Road l13) being out of
water, verbal approval was given to construct a replacement well for John's Well on July 25,1997.
The replacement number given was Permit No. lOgZ40-A.
