BEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFIELD COUNTY, COLORADO
PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101(10)(d) as amended, and the
Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972
and amended April 14, 1975, Sections 1.02.17(d) and 3.02.01, the undersigned
Stephen M. Stewart and Thomas M. Stewart respectfully petitions the Board
of County Commissioners of Garfield County, Colorado, to exempt by resolution
20 acres of the 23 -acre parcel shown on Exh. A attached on West Elk Creek.
8.3 miles North of New Castle , more fully hereinafter described, from the
definitions of "subdivision" and "subdivided land" as the terms are used and
defined in C.R.S. (1973) Section 30 -28 -101(10)(a) -(d) and the Garfield County
Subdivision Regulations, for the reasons stated below:
My wife and I are planning to move to Oklahoma to attend school. My wife
would like to complete her education and obtain a teaching certificate. I
plan to enter law school at Oklahoma University. In order to finance these
goals it is necessary for us to sell our home and 20 acres. We would like to
keep 3 acres inthe southeasterly part of said 23 -acre parcel for a future
homesite and therefore request this exemption.

Please find enclosed the Subdivision Summery Form for each of
the above referenced applications requesting an exemption from Senate
Bill 35.
Atlantic Richfield's request was heard and approved on September
26, 1977. The other four requests were heard and approved by the
Board of County Commissioners on October 3, 1977.
