Board of County Commissioners of Garfield County, Colorado, to exempt by resolu-
tion the division of I/0 acre tract of land into V tracts of

"subdivision" and "subdivided land" as the terms are used and defined in C.R.S.
(1973) Section 30-28-101 (10) (a) -(d) and the Garfield County Subdivision Regulations,

At your request, I am writing to advise you of the water
rights to be used by Ruth Stirling for a domestic water supply
on the property located in the NE1/4 of the NW1/4 of Section 29,
Township 7 South, Range 87 West of the 6th P.M.
On September 1, 1980, the Water Court entered a decree in
Case No. 79CW383 awarding 0.033 c.f.s. (15 gpm) for domestic
purposes, including up to one acre of lawn irrigation to the
Stirling Well No. 5. The well will be located on the above -
referenced property. A copy of the decree is enclosed.

GENE STIRLING, also known as GENE M. STIRLING, and
REBECCA B. STIRLING, also known as REBECCA BIRCH STIRLING, whose
address is Sarasota, State of Florida, for the consideration of
Ten Dollars and Other Valuable Considerations, in hand paid,
hereby sell and convey to JOHN M. STIRLING, whose address is
Carbondale, State of Colorado, an undivided two-thirds interest
in and to the following real property in the State of Colorado,

entire interest in the Bull Frog Reservoir and in Priority No. H-22
for 140 acre feet of water awarded to said Reservoir; and entire
interest in Enlargement of the Bull Frog Reservoir, undecreed, but
represented by Sworn Statement and Plat dated April 16, 1947 for •
an additional 38 acre feet of water for storage purposes. Also
entire interest in Little Monitor Reservoir No. 1 and its Priority
No. H-46 for 130 acre fedt of water for irrigation purposes; also
entire interest in Little Monitor Reservoir No. 2 and its Priority

subject to existing rights of way for roads and ditches and any
other existing easements. Except the following described parcel:
Beginning at a point on the North line of the NE of said Section
26 820 feet East of the Northwest corner of said NEk, thence along
the North line West 820 feet to the Northwest corner of said NES,
thence along the West line of said NEk South 1320 feet, thence
East 500 feet, thence Northeasterly in a straight line to the point
of beginning. And except all rights in a spring and the water
therefrom that rises on the foregoing excepted parcel. And except
undivided one-half interest in all oil, gas and mineral rights
reserved by Earl D. White, together with the right to prospect
for, mine and remove the same in customary manner. SUBJECT TO a
right of way 30 feet in width across said NWk of NEk of said
Section 26 for the purpose of access to and from a public road

This map unit is on alluvial fans, high terraces
and valley sides. Slope is 15 to 25 percent.
Elevation is 7,000 to 8,500 feet. The average
precipitation is 14 to 16 inches.
The Andreeson soil is deep and well drained.
Typically the surface is covered with 10-15%
stones, 5% cobble, and 10% gravel. The surface
layer is brown very stony loam 8" thick. The
subsoil is cobbly clay loam and very cobbly
clay. Permeability is slow, runoff is medium
and water erosion hazard is moderate. Effec-
tive rooting depth is 60 inches or more.
The Norval soil is deep and well drained. The
surface layer is a brown loam 7" thick. The
subsoil is a clay lcasm. Permeability is
moderate, runoff is medium, and water erosion
hazard is slight. Effective rooting depth is
60 inches or more.
This unit is used for rangeland, hayland, and
homesite development with the limitations
being stones on surface, steep elopes and
alow permeability.

The above dntitled application was filed on December 31, 1979, and was'
referred to the undersigned as Water Referee for Water Division No. 5, State
of Colorado, by the Water Judge of said Court on the 12th day of January, 19
in accordance with Article 92 of Chapter 37, Colorado Revised Statues 1973,
known as the Water Right Determination and Administration Act of 1969.
And the undersigned Refree having made such investigations as are neces
sary to determine whether or not the statments in the application are true
and having become fully advised with respect to the subject matter of the ap
plicaton does hereby make the following determination and ruling as the
Referee in this matter, to -wit:
1. The statements in the application are true.
2. The name of the structure is Stirling Well No. 5.
j. The name of the claimant and address is John Stirling;

2030; Glenwood Springs, Colorado 81601.
4. The source of the water is a well having a depth of 250
feet and tributary to the Roaring Fork River.
5. The well is located in the NE NWa of Section 29, T. 7 S.
R. 87 W. of the 6th P.M. at a point 660 feet South of the North line and 1,9
feet East of the West line of said Section 29.
6. The use of the water is domestic, household purposes,
livestock water, fire protection and lawn and garden irriagation.
7. The date of initiation of appropriation is May 15, 1979.
8. The amount of water claimed is 0.033 cubic foot of water
per second of time, conditional.
9. The well has not been completed and the water has not yet
been diverted and applied to beneficial use.
10. On September 6, 1979, Permit No. 110078 was issued by th
Office of the State Engineer, subject to the following "Conditions of
Approval":
This well shall be used in such a way as to cause
no material injury to existing water rights. The
issuance of the permit does not assure the applicant
that no injury will occur to another vested water
right or preclude another owner of a vested water
right from seeking relief in a civil court action.

OF NOT OVER ONE ACRE OF HOME GARDENS AND LAWNS.

11. On Febua ,' 29, 1980 Statement of Opposition was filed by
the Park Ditch Company and John Sutey; however, on March 14, 1980, this
Statement of Opposition was withdrawn.
The Referee does therefore conclude that the above intitled application
should be granted and that 0.033 cubic foot of water per second of time with
appropriation date of May 15, 1979, is hereby awarded conditionally to Stirl
Well No. 5 for domestic, household purposes, livestock water, fire protection
and lawn and garden irrigation purposes, provided always that said 0.033 cubi
foot of water per _Second of time is on the condition that said quantity of w..
be applied to beneficial use within a reasonable time.
The above described underground water right meets the
criteria for an exempt domestic well pursuant to C.R.S.
1973, 37-92-602 (1) (b), so long as it is used for the
purpose set forth herein, and by statute; and subject
to the "conditions of approval" set forth in paragraph
10 above.

long as claimant desires to maintain this conditional water right or until a
absoulte water right by reason of the conpletion of the appropriation.
It is accordingly ORDERED that this ruling shall be filed with the Water
Clerk and shall become effective upon such filing, subject to Judicial review
pursuant to Section 37-92-304 CRS 1973.
It is further ORDERED that a copy of the ruling shall'be filed with the
appropriate Division Engineer and the State Engineer.
