I. RELATIONSHIP TO THE COMPREHENSIVE PLAN:
The parcel is located in District C (Rural Areas with Minor Environmental
Constraints). The proposed split does not conflict with the Comprehensive
Plan.
II. STAFF COMMENTS:
1. The applicant has owned the parcel for over five years with her
ex-husband and is a part of a divorce settlement. The 40 acre parcel
presently has an older single family dwelling that will be on one of
the proposed 20 acre parcels. The applicant proposes to build a new
house on the remaining parcel.
2. The proposed water source for the new parcel is a domestic well permit
No. 110078, which was adjudicated for .033 cfs (14.8 gpm) on June 29,
1980. The existing house has a well in existence.
3. Legal access to the new parcel should be describes as a perpetual
access easement through Lot 1.
4. The applicant should be aware of the fact that an engineered
foundation and septic system may be required due to the severe
limitations noted on the Soil Conservation Service soils information
sheet.
III. RECOMMENDATION:
Approval with the following conditions:
1. That an access easement to Lot 2 be legally described in the deed and
on a plat.
2. That the applicant submit a $200.00 school assessment fee to the
Department of Development prior to the signing of the exemption
resolution.

when the following proceedings, among others were had and done, to -wit:
RESOLUTION NO. 83-301
A RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE GARFIELD COUNTY
SUBDIVISION REGULATIONS FOR Ruth R. Stirling.
WHEREAS, Ruth R. Stirling has petitioned the Board of County
Commissioners of Garfield County, Colorado, for an exemption from the
definition of the terms "subdivision" and "subdivided land" under C.R.S.
1973, 30 -28 -101(10)(a) -(d), as amended, and the Subdivision Regulations of
Garfield County, Colorado, adopted January 2, 1979, Section 2.02.21(d)
for the division of a 40 acre tract described as follows:
NE 1/4, NW 1/4 of Section 29, Township 7 South, Range 87 West of the
6th Principal Meridian, Garfield County, Colorado; into 2 tracts of
approximately 20 acres each, more or less, which proposed divided tracts
are more particularly described as follows:
TRACT A: W 1/2, NE 1/4, NW 1/4 of Section 29, Township 7 South, Range 87,
West of the 6th Principal Meridian, Garfield County, Colorado.
TRACT B: E 1/2, NE 1/4, NW 1/4 of Section 29, Township 7 South, Range 87
West of the 6th Principal Meridian, Garfield County, Colorado; and
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
of County Commissioners of Garfield County, Colorado, that the proposed
division does not fall within the purposes of Part 1, Article 28, Title
y.30, Colorado Revised Statutes 1973, as amended, for the reason that said
petitioner has owned the above described parcel for more than five (5)
years, and
WHEREAS, the Petitioner has demonstrated to the satisfaction of the
Board of County Commissioners of Garfield County, Colorado, that there is
a reasonable probability of locating domestic water on each of said tracts
and there is adequate ingress and egress to said tracts, that the location
of septic tanks will be permitted by the Colorado Department of Health,
that the requested division is not part of an existing or larger
development and does not fall within the general purposes and intent of
the subdivision regulations of the State of Colorado and the County of
Garfield, and should, therefore, be exempted from the definition of the
terms "subdivision" and "subdivided land" as set forth in C.R.S. 1973,
30-28-101 (10) (a) -(d), as amended;
NOW, THEREFORE, BE IT RESOLVED that the division of the above
described tracts "A" and "B" from the described 40 acre tract is hereby
exempted from such definitions and said tract may be divided into tracts
"A" and "B", all as is more fully described above, and said divided tract
may be conveyed in form of smaller tracts without further compliance with
the aforesaid subdivision statutes and regulations; provided, however,
that this exemption is granted on the condition and with the express
understanding and agreement of the Petitioner that no further exemptions
he allowed on said tracts "A" and "B", and that a copy of the instrument

or instruments of conveyance when recorded shall be filed with this
