WHEREAS, SPRING VALLEY RANCH, LTD. by Lyle W. Beattie, General Partner,
has petitioned the Board of County Commissioners of Garfield County, Colorado,
for an exemption under C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended,
and the Subdivision Regulations of Garfield County, Colorado, adopted September
1, 1972 and amended April 14, 1975, Sections 1.02.17 (d) and 3.02.01, for the
division of a 2,900 acre tract of land into five (5) tracts of 5, 5, 5, 5, and
2,880 acres, more or less, and said 2,900 acre tract is more particularly
described as follows:
All of the following described real property situate, lying
and being in the County of Garfield and State of Colorado,
to -wit:

250138, 239150, 239151, 239218, 239219, 238860, 25952.5, and
259529 of the records of Garfield County, Colorado.
Together with all of the Seller's interest in and to all water
and water rights, ditches and ditch rights, reservoirs and
reservoir rights; springs and seeps appurtenant to or used upon
or in connection with all of the above described lands, including
but not by way of limitation, the following:

Together will all easements and rights-of-way appurtenant to
or used in connection with said real property, including
without limitation the easements described in warranty deed
recorded as Document No. 230466 of the records of Garfield
County, Colorado, and including specifically an easement
for ingress and egress to and from said lands to and from
the Hopkins Reservoir located in Section 15, Tp. 6 S., R.
88 W., 6th P.M. over and across the roadway presently constructed
and in place.
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
of County Commissioners of Garfield County, Colorado, that he desires said
exemption for the purpose of re -sale into single-family residential acreage;
and,
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
of County Commissioners that there is a reasonable probability of locating
domestic water on each of said tracts, that there is adequate ingress and egress
to said tracts, that the location of septic tanks will be permitted by the
Colorado Department of Health, that the requested division is in accordance
with the general purposes and intent of the Subdivision Regulations of the State
of Colorado and the County of Garfield and should, therefore, be exempted from
the definition of the terms "subdivision" and "subdivided land" as set forth
in C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended;
NOW THEREFORE, upon motion of

exempted from such definition and transfer of said tract may be made by division
into five (5) tracts of 5, 5, 5, 5, and 2,880 acres, more or less, all as is more
fully described above, and further, that said exemption is conditioned upon the
Petitioner obtaining a proper legal description of said tracts prior to any
conveyance thereof. A copy of the instrument(s) of conveyance when recorded shall
be filed with this Resolution.

Meridian; thence N. 60°42'40" W. 546.78 feet to a point on the Southerly right-
of-way line of said County Road, the True Point of Beginning; thence along
the Southerly line of said County Road, the following metes and Bounds: S.
72°34'00" E. 246.81 feet; thence leaving said County Road right-of-way and
along the Westerly Boundary of said Document No. 259525 S. 21°02'00" E. 678.28
feet; thence along the Northerly and Westerly Boundaries of said Document No.
