RESOLUTION CONCERNED I^IITH GRANTING AN EXEl\lPTION FROM THE GARFIELD COUNTY
SUBDIVISlON REGULATIONS FOR RAYMOND C. STETD
I,IHEREAS, Raymond C. Steed has petitioned the Board of County Commissioners
of Garfield County, Colorado, for an exemrrtion from the definit'ion of the terms
"subdiv'ision" and- isubd'ivided land" uncler C.R.S. 1973, 30-28-lcl (.l0) (a)-(d)'
as amencled , and the Subdi v'is'i on Requl ati ons of Garf j el d County, Col orado, adopted
January 2, 1979, Sectjons 2.02.21 (d) and 3.02.01 for the division of a 40.0 acre
tract described as fcllcivs: that parcel of land as described in Document No.
300522 as filed in the 0ff"ice of the Clerk and Recorder of Garfield County,
Colorado into 4 tracts of approximately .l0."I9, .l0.20, .l0.23, and 10.2? acres eaclt,
more or less, wh'ich proposed divjded tracts are more narticuiarly descrihed as

WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
of County Commissioners of Garfield County, Colorado, that the proposed djv'ision
does not fall withjn the purposes of Part l, Art'icle 28, Title 30, Colorado
Revised Statutes 1973, as amended, for the reason that the impact created is not'large enough to proceed through the full subd'ivsion review; and
UIHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
of County Commissioners of Ga.rfield County', Colorado, that there js a reasonable
probability of locating domestic water on each of sa'id tracts' that there is
idequate ingress and egress to sa:d tracts, that the location of septic tanks
will'be perniitted by tie Colorado Department of Health, that the requested d]vi-
sion is not part of an existing or larger c!e,,relopment and cloes not fall within
the general purposes and intent of the subdivision reguiat'ions of the State of
Coloiado and the County of Garfield, and should, therefore, be exemoted from the
defin'ition of the terms "subd'ivis'ion" and "subdivided land" as set forth in
C.R.S. .i973, 30-2d-l0l (.l0) (a)-(d), as amendeo;
NoW, THEREF0RE, BE IT RES0LVED that the division of the above described
tracts "A", "8", rrnrr and rrDrr from the above described 40.0 acre tract is
hereby exen:pted frcm definitions and said tract nray be divided'into trac+-s "A",
rrgrr, ;rC", and "D", a1l as is more fu11y described above, and said divjded tract
may be conveyed in ttre form of such smaller tracts without further comp'liance with
thl aforesaid subd'ivision statutes and regulat'ions; provided, however that this
exemp+"ion'is granted on the cond'!t'ion and with the express understandino and
agreenrent of ihe Petitioner that no further exemptions be allowed on said tracts
