PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101(a) - (d) as amended, and the
Subdivision Regulations of Garfield County, Colorado, adopted September l, L972,
and anended April 14, L975, Sections 1.02.17(d) and 3.02.01, the undersigned
SAMUEL S. STALEY III and DORINDA R. STALEY respectfutly petitions the Board of
County Commissioners of Garfield County, Colorado to exempt by resolution a
tract of 2.176 acres into two tracts of 1.796 acres and.38 acres more or less,
more ful1y hereinafter described:
A tract of land situated in Lot B of Secti-on 1, Tovmship 7 South,
Range 89 West of the 6th Principal Meridian described as folLows:
Beginning at a point whence an iron pin with a brass cap marked for
the Southwest Corner of said Lot B (being the same as the Southeast
Corner of Lot 9, said Section 1) bears S. 87"53'45" W. 450.96 feet;
thence N. BBo15r W. 150.00 feet;
thence N. 01"14' E. 982.78 feetl
rhence S. 88o15r E. 150.06 feer;
thence S. 01"14r W. 979.76 feet Eo the point of beginning.
Excepting a parcel of land described in instrumenr recorded May 4,
1,967 in Book 384 at Page 188 as Reception No. 237830 and in instrument
recorded February 4, L969 in Book 399 at Page 257 as Reception No.
242646.
NOTE: Copies of the above described instruments, Reception Nos. 237830
arld 242646, are attached hereto, as well as a copy of an improvement
survey of the above property.
From the definirions of ttsubdivisiontt and "subdivision land" as the terms are used
and defined in C.R.S. (1973) Section 30-28-101(a) - (d) and the Garfield County
Subdivision Regulations, for the reasons stared below:
1) The property is already physically separated into two parcels by an inter-
vening piece of property.
2) The parcel near the road has different commercial characteristics than the
parcel away from the road. ..The parcel near the road is most susceptibl-e to
use based on trafflc flow and easy access from the highway. The pareel-
away from the road is more susceptible to non-traffic development - storage,
light commercial activity or residential.
3) The parcels would be viable as separate propertles with the front parcel
containing some 17r000 square feet, and the rear parcel some 77,000 square
feeL. These sizes would seem sufficient for the uses mentioned above.
4) Both parcels have road access and access to electrical polrer. The front
already has a mobile home on it and power" The rear parcel will have a
one-third interest in the 20 gpm well whj-ch is located on the front parcel.
I presently own a two-Ehirds interest in the welL. One-third interest
would be retained for the front parcel. The reer parcel ls also suscepLi.bLe
to leach l-ines or sept,Lc tank for sewage.

5) At present, I intend to develop the rear parcel for use - either residential
or conmercial - by building on it, and I lntend to sell it.
