Cornrnissioner Smith made a motion that the Chairman be authorized Lo sign the
contract with the StaLe Department of HeaLth for Lhe County Nursing program.
Commissioner Schmueser seconded the motion; carried.
Conrnissioner Smith made a motion that the Chairman be authorized to sign the
contract with the State Department of HeaIth for the EPSDT program.
Commissioner Schmueser seconded the motion; carried.
ROAD AND BRIDGE CULVERT BID AWARD
King stated the lowest bidder was in compliance with the specs of the bid
reguest and Commissioner Schmueser made a nrotion that the Board award the bid
for the contract for Road and Bridge culverts corrugated pipe to Wheeling not
to exceed $8r059.99. Commissioner Smith seconded the motion; carried.
Conrnissioner Schmueser made a motion that the Board go into Executive Session
for the purpose of discussing the Puma Paw litigation. Comrnissioner Smith
seconded the motion; carried.
Conrnissioner Schmueser made a motion that the Board come out of Executive
Session and reconvene as the Board of County Comrnissioners. Commissioner Smith
seconded the motion; carried.

BAITS IN BEHALF OF THE CITY OF GLENWOOD SPRINGS.
Chairman Richardson swore in Director of Building, Planning and Sanitation Mark
Bean, 109 Bth St., Glenwood Springs and Bob Baits, 530 North FieIC Road,
Colorado Springs, Colorado 80919. Attorney Don DeFord stated the public
notices appeared to be adequate and Mark presented the exhibits as follows: A)
Proof of publication from the Glenwood Post, B) Appiication and supporting
documentation, C) Staff conrnents. Exhibits t'A'r through "C" were accepted into
the record. Mark reviewed the staff cornments anC after discussion,
Connnissioner Schmueser made a motion that the Public Hearing be closed.
Conrnissioner Snrith seconded the motion; carried. Conrnissioner Schmueser made a
motion that the Board approve the Zone District Text Amendment to Section
3.02.03 Uses SpciaL to Add "Commercial Recreational EaciLity Park" for Lincoln
Earhart and Robert Baits in Behalf of the City of Glenwood Springs according to
the reconrnendations within the staff comments dated June 15, 1987.
Conrnissioner Smith seconded the motion; carried.
PUBLIC HEARING - SPMIAL USE PERMIT; COII4VIERCIAL RECREATIONAL FACILITY/PARK

134; APPLICANT, LINCOLN EARHART AND ROBERT BAITS IN BEHALF OF THE CITY OF
GLENWOOD SPRINGS.
Chairman Richardson reminCed the applicant he was stilL under oath and Attorney
Don DeEord stated the public notices appeared to be adequate. Ivlark presented
the exhibits as follows: A) Application along with a map of the project and a
brochure describing a similar project, B) Proof of publication, C) Mail
receiptsr D) Staff comments. The Board accepted Exhibits "A" through "D" into
the records. Mark revieweC the staff conrnents and there was discussion with
Mr. Baits regarding the parking lot size, the size of the property involved and
the road to the top of the slide. Mr. Baits stated the parking lot would hold
200 cars and that the road going to the top of the slide was an existing road
and they planned to improve what is now just a jeep trail. Mike Copp, City
Manager of the City of Glenwood Springs was present and stated the City had
approved the project. There being no other comments from the audience,
Commissioner Schmueser made a motion for the Public Hearing to close.
Conrnissioner Smith seconded the motion; carried. Commissioner Schmueser made a
motion that the Board approve the Special Use Permit for a Commercial
Recreational Facilrty/Park for Lincoln Earhart and Robert Baits in Behalf of
the City of Glenwood Springs with conditions as presented in the stafE comments
dated June 15 | 1987. Connnissioners Smith seconded the motion; carried.

After discussion with Lyle Beattie and County Planner Glenn Hartrnann, it was
determined that there was no conflict of interest for Conrnissioner Schmueser.
Attorney Don DeFord stated the public notices appeared to be adeguate. Glenn
Hartmann reviewed the staff comments stating bhat the Planning Department
recommended denial on the basis that the exemption would be in non-compliance

OIL AND GAS CONDITIONAL USE PERMIT REQUIREME}OI CHANGESThe Board discussed with Mark Bean and Glenn Hartmann the possibility ofchanging the procedure necessary for a Conditional use permits for oiI and gaswells due to the standardized requirements and methods involved. Mark statedit could be done administratively without taking it to the Board by nnking anamendment to the exisling text in the resolution and the Board directed him tomake an amendment and bring it back to the Board for approval on June 29.
Conrnissioner Schmueser made a motion that the Board go into Executive Sessionfor the purpose of discussing an oiI ShaIe Trust Fund matter. CommissionerSmith seconded the motion; carried.
Connnissioner Schmueser made a motion that the Board come out of ExecutiveSession and reconvene as the Board of County Commissioners. Commissioner Smithseconded the motion; carried.
OIL SHALE TRUST FUND RIFLE DEMAND LETTER/RESPONSE
Commissioner Schmueser made a motion that County Attorney Don Deford beauthorized to draft a reply to the Rifle oil shife Trust Fund demand letterstating the Board's intentions of forming a committee to primarily resolve therecipients of the funds and the guidelines for applications for the funds, thatthe conrnittee consist of the six mayors from the communities in Garfield tountyand superintendenLs from the three school districts, that a meeting date be setwithin two weeks and the acting Chairman be the President of the RE-2 SchoolBoard. conrnissioner smith seconded the motion; carried.
