II. DESCRIPTION OF THE PROPOSAL
A. Site Description: The site is located in a residentialportion of lvlissouri Heights. The property is just
southwest of and across C.R. L02 from the King,s Rowsubdivision. (See page 7 ) The property is moderatelysloped and partially treed with pinon/juniper typevegetation. The property is currently vacant.

III. MAJOR ISSUES AND CONCERNS
1. SoiI survey information indicates that there are no major
limitation to homesite development. Some shrink-swell
clays may be found in the area. In addition, occasionalbasalt outcrops and/or shallow layering may be found. This may restrict development of some portions of the
proposed parcels.
2. Slopes on the property are moderate, ranging from 10 to
15 percent. No problems related to topography areanticipated.
3. Access to the property is obtained via access easements
from C.R. 102. The easement is partially improved as itserves a residence two parcels to the east of thesubject property. From that point, the easernent istraversed by an old farm road which extends onto thesubject property.
4. Fire protection will be provided by the Carbondale Fire
Department.
5. No water, either domestic or irrigation, is currentlyavailable on the property. In 1984, the applicantapplied for and was granted a weII permit for domestic
use only on the subject property. No well was everconstructed causing the permit to lapse. A new permit
would be reguired. Since previous exemptions haveoccurred, the issuance of multiple well permits may berestricted. In all likelihood, the applicant will berequired to obtain additional water through the Basalt
Water Conservancy District. No formal response from the
Department of Water Resources has been received.
IV. SUGGESTED FINDINGS
1. That proper posting and public notice was provided asrequired by law for the meeting before the Board of
County Commissioners.
2. That the meeting before the Board of County Commissioners
was extensive and complete, that all pertinent facts, matters and issues were submitted, and that aIIinterested parties hrere heard at that meeting.
3. That for the above stated and other reasons, the proposed
exemption is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of thecitizens of Garfield County.
V. RECOMI{ENDATION
APPROVAI, with the following conditions:
1. That the following notes shall be included on the
Exemption PIat.
A. No further exemptions shall be allowed on eitherparcel.
B. Foundations and/or individual sewage disposal
systems may require design by a registered engineer.
2. That the apprj-cant shalr submit evidence of a domesticwater source for both of the proposed parcers consistingof werr permits prior to any formal resorution creatingthe tracts.
3. That the appricant shalr submit $400 in schoor rmpactFees.

4.
5.
That, all conditions of approval shall be satisfied and an
Exemption Plat, filed within 120 days. An extension maybe requested prior to the expiration date but in nocase will an extension be approved for a time period
extending beyond one (1) year from the date ofconditional approval.
That all representations of the applicant, either in theapplication or in the public meeting, shalI be consideredconditions of approval.
