LO2 (I'lissouri Heights-El Jebe1 Road). The site consists of a 2O acre parcel. Proposed wells Individual Systems Sewage Disposal Existing access drive off C.R. L02. A/R/RD I. RELATTONSHIP TO THE COMPREHENSIVE PLAN The subject property is located in District B, RuralServiceable Areas/I,linor Environmental Constraints, as designated on the Comprehensive PIan Management Districts' map. rI. DESCRIPTION OF THE PROPOSAL A. Site Description: The site is located in a residentialportion of Ivlissouri Heights. The property is just southwest of and across C.R. L02 from the King's Rowsubdivision. (See page il ) The property is moderatelysloped and partially treed with pinon/juniper typevegetation. The property is currently vacant. B. Project Description: The applicant proposes to dividethe 20 acre parcel into two parcels of ten (10) acreseach. If approved, the applicant is proposing to seII one of the two parcels. C. History: The subject property was originally created by an exemption approved in 1973 splitting a forty (40) acreparcel. The applicant's parents obtained approval tocreate two twenty (20) acre parcels. These parcels wereeventually given to the applicant and his brother wholater sold the eastern 20 acres. This 20 acres was thensplit by approved exemption in L982 by Leonard Riggs. The original parcel now consists of a twenty (20) and twoten (10) acre pieces. This matter was originally scheduled for a public hearingin June but due to noticing problems, was not heard and was rescheduled. -/- III. MAJOR ISSUES AND CONCERNS L. Soil survey information indicates that there are no majorlimitation to homesite development. Some shrink-swelIclays may be found in the area. In addition, occasionalbasalt outcrops and/or shallow layering may be found.This may restrict development of some portions of the proposed parcels. 2. Slopes on the property are moderate, ranging from L0 to 15 percent. No problems related to topography areanticipated. 3. Access to the property is obtained via access easements from C.R. L02. The easement is partially improved as itserves a residence two parcels to the east of thesubject property. From that point, the easement istraversed by an old farm road which extends onto thesubject property. 4. Fire protection will be provided by the Carbondale Fire Department. 5. No water, either domestic or irrigation, is currentlyavailable on the property. In L984, the applicantapplied for and was granted a weII permit for domestic use only on the subject property. No well was everconstructed causing the permit to lapse. A new permit would be required. Since previous exemptions haveoccurred, the issuance of multiple well permits may berestricted. In all likelihood, the applicant will bereguired to augment water through the Basalt Water Conservancy District or some other source. rV. SUGGESTED FTNDINGS L. That proper posting and public notice was provided asrequired by law for the meeting before the Board of County Commissioners. 2. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts,matters and issues were submitted, and that allinterested parties were heard at that meeting. 3. That for the above stated and other reasons, the proposed exemption is in the best interest of the health, safety,morals, convenience, order, prosperity and welfare of thecitizens of Garfield County. V. RECOI,IMENDATTON APPROVAL, with the following conditions: 1. That the following notes shall be included on the Exemption Plat. A. No further exemptions shall be allowed on eitherparcel. B. Foundations and/or individual sewage disposal systems may require design by a registered engineer. 2- That the appricant shaLl submit evidence of a domesticwater source for both of the proposed parcers consistingof well permits prior to any formar resolution creatingthe tracts. 3. That the applicant sharr submit $400 in schoor rmpact Fees. *,5:- 4. 5. That all conditions of approval shall be satisfied and an Exemption PIat filed within 120 days. An extension maybe reguested prior to the expiration date but in no case will an extension be approved for a time period extending beyond one (1) year from the date of conditj.onal approval. That aII representations of the applicant, either in theapplication or in the public meeting, shall be considered conditions of approval.
