I,IHEREAS, Ri chard Lee Stamp has peti t'ioned the Board of County Commi ss'ioners
of Garfield County, Colorado, for an exeprption from the defjn'ition of the terms
"subdivision" and "surbdivided land" under C.R.S. .l973,30-28-l0l (.I0) (a)-(A),
as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted
January 2,1979, Sections 2.02.21 (d) and 3.02.0.l for the division of a 37.0
acre tract described as follows:
A parcel of land situated in the Sl,lO Section .l4, Tournship 7 South,
Range 88 llest of the Sixth Principal Meridian, Garfield County,
Colorado more particularly described as follows:
Commencing at the StJ corner of said Section .I4, the true point
of beginning; thence N. 000.I.l,00,, 1.,J. 2639.4g feet; thence
S. 89044'.l5" E. 6.1.l.74 feet; thence s. 00oll'00,, E. 2630.96
feet; thence S.89033'30" l.l. 6.l.l.73 feet to the true point of
beginning; containing 37.00 acres more or l:eSS into 3 tracts of
approximately 8.0, 8.0, and 21.0 acres each, more or less, which
proposed divicied tracts are more particularly described as

WHEREAS, the Petitioner has dernonstrated to the satisfaction of the
Board of County Commiss'ioners of Garfield County, Colorado, that the proposed
division does not fal'l within the purposes of Part l, Article 28, Title 30,
Colorado Revised Statutes 1973, as amended, fcr the reason that the impact
created is not'large enough to proceed through the full subd'ivision review; and
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
of County Commissioners of Garfield County, Colorado, that there is a reasonable
probability of locating domest'ic water on each of said tracts, that there is
adequate ingress and egress to said tracts, that the location of septic tanks
will be permitted by the Colorado Department of Health, that the requested
division is not part of an existing or larger development and does not fall
within the general purposes and intent of the subdivision regulations of the
State of Colorado and the County of Garfield, and should, therefore, be
exempted from the definition of the terms "subdivision" and "subdivided land"
as set forth in C.R.S..l973,30-28-l0l (.l0) (a)-(O), as amended;
WHEREAS, the division of the above described tracts trArr, "8", and "C"
from the above described 37.0 acre tract is hereby exempted from such definitions
and said tract may be divided into tracts "A", "B", and "C", all as is npre
fu]ly described above, and said divjded tract may be conveyed in the fornr of such
smaller tracts without further compliance with the aforesaid subdivision
statutes and regulations; prov'ided, however, that this exenrption is granted on
the condition and with the express understand'ing and agreement of the Petitioner
that no further exemptions be allowed on said tracts "A", "8", and "C", and
