IJI-IEREAS, the Petitioner has denronstrated to the satisfaction of the Board
of County Commissioners of Garfield Cor-rnty, Colorado, that the proposed divis'ion
does not fall within the plrrposes of Part l, Article 28, Title 30, Colorado
Revised Statutes .I973, as a.mended, for the reason that the irnpact created 'is
not great enough to warrant a full subdjvision revjer.v; and
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of
County Comrriissioners of Garfield County, Colorado, that there is a reasonable
probability of locating domestic vrater on each of sa'id tracts, that there is
adequate ingress and egress to said tracts, that the location of septic tankswill be pernritted by the Colorado Department of Healtli, that the requested div'i-
sion is not part of an existing or larger development and does not fall within
the general purposes and intent of the subd'ivision regulations of the State of
Colorado and the County of Garfield, and should, therefore, be exempted from the
definition of the terms "subdfvision" and "subdivided land" as set forth in
C. R.S. I 973, 30-28-l 0l (l 0) (a)- (d), as amended;
N0t'1, THEREF0RE, BE IT RES0I-VED that the division of the above described
tracts "A" and "B" from the above descrjbed 7.55 acre tract is hereby exempted
from such definitions .rnd said tract nray be divided into tracts "A" and "B", a.ll
as is nrore fully described above, and said divided tract may be conveyed in the
form of such smaller tracts without further comnl'iance v.ith the aforesaid sub-
division statutes and regulat'ions; provided, however, that this exemption is
granted on the condition and with the express understandinq and agreement of the
Petitioner that no further exemptions be allowed on said tracts "A" and "B",
and that a copy of the instrument or instrunients of conveyance when reccrded
shall be filed with this Resolution.
