WHEREAS, Henry. D. and Jane Spaulding have petitioned the Board'. of
County Commissioners of Garfield County, Colorado, for an exemption from

the definition of the terms "subdivision" and "subdivided land under.
C.R.S.1973, 30-28-101 (10) (a) -(d), as amended, and the Subdivision
Regulations` of Garfield County, Colorado, adopted January 2, 1979, Sections
2.02.21 (d) and 3.02.01 for the division of a 0.41 acre tract described
as follows:. a parcel of land in Lot 6, Sec. 3, T. 8S., R.88 W. of the 6th P.M.
into 2 tracts of approximately 0. 17 and a remaining 0.24 acres each, more or
less, which proposed divided tract is more particularly described as foliows:
Tract A: A parcel of land situated in Lot 6, Section 3, Township 8 South,
Range 88 W., of the Sixth P.M. further described as follows: Beginning
at a point on the Easterly line of State Highway number 133, whence the
Town -of Carbondale Town Monument at Forth and Main bears N. 9-17-26
W. 2655.60 feet; thence to the South Westerly boundary of the Sopris
Meadows South subdivision first filing N. 64-24-41 E. 82.75 feet; thence
along said South Westerly boundary S. 26-34-00 E. 92.82 feet; thence along
a line described in Deed. No. 240785, Book 394, Page 46 S. 65-30-00 W 79.30
feet to the Easterly line of said Highway 133, said point also being the
point of beginning of the above described deed. Thence along said highway
right-of-way N. 28-45-00 W. 91.44 feet to the point of beginning and
containing .171 acres The bearings used in this survey were based upon
a bearing of N. 89-57-00 W. being the center of Main Street, Town of
Carbondale in the State of Colorado and County of Garfield; and
WHEREAS, the Petitioners have demonstrated to the satisfaction of the.
Board of County Commisioners of Garfield County, Colorado, that there is
a reasonable probability of .locating domestic water on each of said tracts,
that there is adequate ingr.ess and egress to said tracts, that the location
of septic tanks will be Permitted by the Colorado Department of Health, that
the requested division is not part of an existing or larger development and
does not fall within the. general purposes and intent of the subdivision
regulations of the State of Colorado and the County of Garfield, and should,
therefore, be exempted from the definition of the terms "subdivision and
"subdivided land" as set forth in C.R.S. 1973,. 30-28-101 (10) (a) -(d), as
amended;
NOW, THEREFORE, upon the motion of Larry Velasquez seconded
by:R.C. Jolley
and carried, the division of the above:
described tract "A" from the above described .0.41 acre tract is hereby
exempted from such•definitions'and said tract may be divided into tract
