WHEREAS, DEXIL ROLD, has petitioned the Board of County Commissioners of
Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30-28-
101 (10) (a) - (d) as amended, and the Subdivision Regulations of Garfield County,
Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17
(d) and 3.02.01, for the division of an 8.99 acre tract of land into two (2)
tracts of approximately 4 acres and 4.99 acres, more or less, with the 8.99 acre
tract more particularly described as follows:
A tract of land situated in the SW4SE4 of Section 1,
Township 5 South, Range 93 West of the 6th Principal
Meridian, Garfield County, Colorado, lying Easterly
of the West line of said SW4SE4 and Northerly of the
South line of said Section 1, described as follows:
Beginning at the Southwest corner of said SW1/4SE4, being
the same as the South Quarter Corner of said Section 1,
thence N. 000 17' W. 1174.68 feet along the West line
of said SW4SE4; thence S. 15° 09' E. 66.00 feet; thence
S. 460 44' E. 169.80 feet; thence S. 22o 59' E. 439.95
feet; thence S. 15° 42' E. 231.60 feet; thence S. 06°
39' E. 28.50 feet; thence S. 48° 54' E. 80.80 feet;
thence S. 59° 16' E. 256.50 feet; thence S. 43° 35' E.
210.14 feet to a point on the South line of said Section
1; thence S. 89° 52' W. 799.15 feet along the South
line of said Section 1 to the South Quarter Corner of
said Section 1, the point of beginning.
The above described tract of land contains 8.99 acres,
more or less.
The above described tract of land is adjacent to the
West Rifle Creek Road.
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
of County Commissioners of Garfield County, Colorado, that he desires said
exemption for the purpose of re -sale into single-family residential acreage;
and,
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
of County Commissioners that there is a reasonable probability of locating
domestic water on each of said tracts, that there is adequate ingress and egress
to said tracts, that the location of septic tanks will be permitted by the
Colorado Department of Health, that the requested division is in accordance
with the general purposes and intent of the Subdivision Regulations of the
State of Colorado and the County of Garfield and should, therefore, be exempted
from the definition of the terms "subdivision" and "subdivided land" as set
forth in C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended;
NOW THEREFORE, upon motion of e,y\ (Ey Se , seconded by
?v v' / Oe kSci c 2— , and carried, said 8.99 acre tract of land is hereby
exempted from such definition and transfer of said tract may be made by division
into two (2) tracts of 4 acres and 4.99 acres, more or less, all as is more
fully described above, and further that said exemption is conditioned upon the
Petitioner obtaining a proper legal description of said tracts prior to
conveyance thereof. A copy of the instrumet(s) of conveyance when recorded
shall be filed with this Resolution.
