CONTINUED FOR AN Exemption from
the Definition of Subdivision.

1. Comments from the State Division of Water Resources have been
received and are attached. (See Page
2. Further discussion with the Division has indicated that the
domestic wells do include the allowance for irrigation of not
more than one acre of lawns and gardens and the watering of
non-commercial domestic stock. This allowance would be shared
between the three lots sharing the well.
RECOMMENDATION:
APPROVAL, with the conditions as noted in the Staff Report date
1/15/90, with the addition of the two following conditions:
7. That a plat note be included on the exemption plat
stating that "all construction shall be in accordance
with the recommendations of the Colorado State Forest
Service, Wildfire Safety Guidelines for Rural
Homeowners".
8. That easements for access and maintenance of the well
and waterlines be included on the exemption plat. That
a homeowners association or covenants be established
which address administration of the well use, including
a joint maintenance agreement and shared use outside
irrigation and stock watering rights. Verification that
the well will be jointly owned by the three lots shall
also be provided.
