DANIELSON State Engineer We have reviewed the above referenced proposal to separate 12.94 acres into three lots. Well Permit Number 48977 has been previously issued on the tract. The applicants propose to share this well between the three lots. The well permit has no restriction prohibiting the proposed use. In order to assure that a permanent water supply will be available on an equitable basis to either lot, we recommend the following: 1. The well should be located on an outlot owned in common by all property owners using the well. Access to the well and the right to establish and maintain a pipeline shall be provided by easements where necessary. 2. The well should be jointly owned by the lot owners. 3. Covenants and/or other mechanisms should establish a lot owners association with authority to make decisions concerning management and operation of the well. A joint maintenance agreement is a required part of such an association. If the above provisions are met, we can recommend approval of this proposal. Country Realty Box X Basalt, Co. 81621 Atten: David Tomasetti The following letter is to elaborate on the well test conducted on the Brown property on August 18, 1989. I will also try to answer your questions on what this well could serve and possible systems for this well. If you have any questions please call me Raun Samuelson at 945-6309. The test was conducted with a dole flow control valve to maintain a constant flow to measure the drawdown of the well. From this we can get an indication of the production of the well. I this case we pumped the well at 12 gpm. The 12 gpm is not the production of this well. The fact that we had no drawdown at 12 gpm would indicate a total production much greater than 12 gpm. To answer your question as to whether this well could supply water for 3 homes? The answer is yes, This well should be able to supply the water needs for three homes. We like to see a min. of 5 gpm per residence or a min. of 15 gpm for 3 houses. I would recomend a direct pumping sys. from the well to pressure system located in a pump house. The water lines to the houses would all start from the pump house so each line could be serviced and metered if necessary. Tonlasetti and Roger. Wilde for Subdivision Exemption to subdivide 12.94 acres into three 4.3 acre lots, property located on County Road 100, approximately 8 miles northeast of Carbondale. Dear Commissioners: I own the property (7.98 acres) immediately adjoining the land for which a subdivision exemption is sought. My home is situated on this property and was constructed there in 1978. I am opposed to this subdivision exemption and ask that it be denied for the following reason: The property in question contains a well. I believe this well is tributary to Cattle Creek (as is my own well). As you know, the Cattle Creek drain.,ge has been classified as "overappropriated" since early in the 1970's and continues in that status today. It is reasonable to .ssume that the three lots proposed will ultimately contain at least three residential dwellings. The plan which is part of the subdivision exemption application reveals that it is intended that these three lots be served by the existing well. Applicants assert that a recent test of this well showed a volume of 12 GPN. One can only speculate as to the adequacy of 12 GPM to serve three dwellings. The likelihood is great that this expanded demand upon the existing precarious water supply in this area will have a serious adverse effect uon my well and water supply. That is my primary concern. The fact that this well carries a "domestic" classification which permits irrigation, however limited, further ex;,cerbates the situation. Please bear in mind also that the Tomasetti/Wilde well was constructed in 1971 and, to the best of my knowledge, has never been placed in beneficial use during its 18 -year existence. (There are no structures on the property except a Public Service electric wire tower). Certainly the well has not been in beneficial use during the 11 years that 1 have lived adjacent to it. Hy well was placed in beneficial use in November 1978. • • As stated earlier, I am opposed to this subdivision exemption and ask tht you give serious consideration. to the above statements and to the threat which the proposed subdivision exeml2tion poses for my water supply. I will explain the options available to you in this letter. One option would be for Mr. Tomasetti and Mr. Wilde to vacate or not complete the exemption which they previously had approved. At that time you could adjust the boundaries of your properties to be consistent with the configuration you proposed. Mr. Tomasetti and Mr. Wilde could then apply for an exemption on the new parcel. The reason for this procedure is that the new lot configuration would result in different configuration than previously, which could result in different comments from neighbors and/or review agencies. Another possibility may be for you to request approval of an exemption on your property and then exchange with Messrs. Tomasetti and Wilde. This assumes that you would be able to meet the criteria necessary to qualify for an exemption. I could not remember whether or not you could qualify. These options are not impossible but Mr. DeFord did not think that there were any administrative options. If you have any further questions, feel free to call or write to me, at your convenience.
