T0: The Record
FROM: Garfield County Planning Department
RE: Alex Urquhart S.B. 35 Exemption Request
DATE: February 24, 1986
On Friday, February 20, 1986, Alex Urquhart visited the Planning
Department office to discuss the domestic water source for his proposed
S.B. 35 Exemption and submit a letter addressing the question.
Mr. Urquhart was advised that previous exemptions granted on his
properties have utilized certain wells for domestic purposes which are now
proposed to service his new parcels. Mr. Urquhart was advised that unless
these wells were approved by the Division of Water Resources for domestic
use and authorized to serve multiple dwelling units, they may not be
adequate.
Mr. Urquhart has indicated that he is pursuing clarification of the status
of his well permits from the Division of Water Resources and he would
propose the use of a cistern should the well permit issue not be resolved.
A copy of his letter is attached.

The Planning Department requests your legal opinion regarding this
proposed SB 35 exemption and whether the allowable number of property
splits, 3 new lots for a total of 4 lots since January, 1973, have been
utilized on the subject property.
The applicant is proposing to split a 2 acre parcel out of a 40 acre tract
labeled as Sections A & B on the enclosed map. The applicant's request is
presently scheduled for a November 4th public meeting.
