HomeMy WebLinkAbout2.0 Resolution 78-26• • RESOLUTION ./i-78-16, WHEREAS, THE UPPER COLORADO COMMUNITY CENTER BOARD has petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17(d) and 3.02.01, for the exemption of a 1.878 acre tract of land more particularly described as follows: A parcel of land situated in the NW4NW4, Section 27, Township 6 South, Range 89 West 6th Principal Meridian, County of Garfield, State of Colorado, more particularly described as follows: Beginning at a point whence the witness corner to the North Quarter Corner of said Section 27 bears N. 89° 53' 43" E., a distance of 1217.93 feet; thence S. 81° 00' 00" W., a distance of 30.00 feet; thence S. 03° 53' 00" '4., a distance of 77.00 feet; thence S. 82° 04' 00" W., a distance of 127.13 feet; thence S. 050 51' 00" W., a distance of 175.57 feet; thence S. 82° 18' 00" W., a distance of 88.48 feet; thence S. 270 46' 00" E., a distance of 175.00 feet; thence N. 81° 00' 00" E., 251.43 feet; thence N. 09° 00' 00" W., a distance of 406.09 feet to the point of beginning, and containing 81,824.5 square feet or 1.878 acres, more or less. WHEREAS, the Petitioner has shown to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that it desires said exemption for the purpose of use as a school facility; and, WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners that there is a reasonable probability of extending central water and sewerage service to the said tract, that there is adequate ingress and egress, and that the requested division is in accordance with the general purposes and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. (1973) Section 30-28- 101 (10) (a) - (d) as amended; NOW THEREFORE, upon motion of - } seconded by and carried, said 1.878 acre tract of land is hereby exempted from such definition and transfer of said tract may be made in • • 1.878 acres, more or less, all as is described above, and further, that said exemptionLis conditioned upon obtaining central water and sewer service from the City of Glenwood Springs, and further, said exemption is conditioned upon receiving a variance from minimum lot size from the Garfield County Zoning Resolution November 27, 1973 as amended.
