Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended, and
the Subdivision Regulations of Garfield County, Colorado, adopted January 2, 1979

respectfully petitioners the
Board of County Commissioners of Garfield County, Colorado, to exempt by resolu-

1. The lots proposed to be exempted possess all of the atributes
of lots subdivided under Garfield County Regulations including
road and utility access, suitability for individual septic
systems and a high probability of obtaining domestic water
supply by individual wells.
2. The property as it presently exists is too large for a one
lot single family dwelling and is not practically usable for
any other purpose than additional residential lots.
3. The property is eminently well suited for additional residential
lots because of it's location.

Gentlemen:
It has been requested by the Garfield County Planning Depart-
ment that I submit in connection with my application for
subdivision exemption, a written explanation of the owner-
ship history of the tract of land which is the subject of
the application.
My former husband, James L. Rose, owned title to all of the
property involved, as well as a substantial contiguous
acreage, for a period of approximately fifteen years, and
during the course of our marriage we resided on the property
for approximately fifteen years. I subsequently received
title to all of the property which is the subject of the
exemption application in connection with a property division
settlement. I have submitted to the planning department
copies of the original deed received by my former husband,
as well as the deed by which I received title from him.
I believe that the foregoing will satisfy the County's
requirement of ownership for a period of at least five years
prior to the date of the application. If you require any
additional information please let me know.

We have received information pertaining to the above mentioned
request for exemption. The applicant intends to divide an 8.91 acre
tract into three tracts. There is one existing house which is ap-
parently served by domestic well permit #21596.
The site is tributary to the Roaring Fork River at a point where
water is available for appropriation. We can therefore recommend
approval. Individual well permits can be issued by this office.

Dear Mr. Ferrar:
Per our discussion on June 8, 1981, I have done some further investiga-
tion concerning the effects of allowing fill on the Rose property located
upstream of the West Bank Bridge. My investigation, is based on HEC -2
computer runs which were performed for the "Roaring Fork River & Colorado
River Flood Information Report" dated November 1977.
This computer data indicates that velocities within the channel increase
less than 1 FPS with encroachments and our calculations indicate that the
water levels will rise only on the order of 6 to 9 inches with the same
encroachments.
The HEC -2 computer output indicates that freeboard beneath the bridge
will be in the range of 3 to 4 feet during the 100 year flood. Based
upon this information and the fact that the bridge is located a dis-
tance downstream from the area of encroachment, I feel that filling a
portion of the Rose property will not cause any more significant pro-
blems, if any, than the unencroached 100 year flood would.
