WHEREAS, JAMES L. ROSE has petit'ioned the Boardof County Commissioners of
Garfield County, Colorado, for an exemption under C.R.S. (tSZf1 Sect'ion 30-28-
lOl (10) (a) - (d) as amended, and the Subdivision Regulations of Garfield County,
Colorado, adopted September 'l , 1972 and amended Apri'l .l4, .l975, Sections I .02.17
(d) and 3.02.0.l, for the division of a 30 acre tract into two tracts of
approximately three (3) anO twenty-seven (22) acress more or less, and more
particularly described as fol lows:
A parcel of land situated in Lots 6 and 7 of Section .I2,
Township 7 South, Range 89 West of the Sixth Principal
Meridian, said parcel of land is described as follows:
Beginning at a point on the Westerly right-of-way 'l'ine
of a County Road as constructed and in place whence the
North Quarter Corner of sa'id Section 12 bears: N. 05009' 42" E. 1893.75 feet; thence S. 09o ?Z' 32" E.100.00
feet along said County Road right-of-way line; thences. 800 4l'55" l^I. .l43..I4 feet; thence S. 460 5l',55"
}J. 319.59 feet; thence S. 0Bo 28' 00" E. 302.72 feet;
thence S. B0o 47' 55,' l,J. 177 .18 feet; thence N. 0Bo

581.62 feet, to a point on the l^lesterly right-of-wayline of said County Road, the point of beginning.
The above described parcel of land contains 3.83 acres,
more or less.
WHEREAS, the Petitioner has shown to the satisfaction of the Board of
County Commissioners of Garffeld County, Colorado, that he desires said
exemption for the purpose of re-sale into single-family residentia) acreage, and;
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
that there is adequate ingress and egress to said tracts, that the location of
septic tanks will be permitted by the Colorado Department of Health, that the
requested division is.in accordance with the'general purposes and intent of the
Subdivision Regulations of the State of Colorado and the County of Garfield and
that said division wijl actually restrict the density of housing within said
area and should therefore, be exempted from the definition of the terms "subdivision"
and "subdivided land" as set forth in C.R.S. (.l973) Section 30-28-.l01 (.l0) (a) -
(d) as amended;

acre parcel, all as is more ful'ly described above. A copy of the instrument
or instrurnents of conveyance when recorded, shall be filed with this Resolution.
