Cerise EarI Rhodes Mildred Alsdorf when the following proceedings, among others $,ere had and done, to-wit: RESOLUTION NO. 83-130 A RESOLUTION CONCERNED WITH GRANTING AN EXEIUPTION FROM THE GARFIELD COUNTYSUBDTVISION REGULATIONS FOR HOWARD AND LISA TINGLEY & RALPH AND'CONNIE HUBBELL. WHEREAS, Howard and Lisa Tingley & Ralph and Connie HubbeII havepetitioned the Board of County Commissioneri of Garfield County, Colorado,for an exemPtion from the definition of the terms "subdivisioni and"subdivided land" under c.R.s. 1973, 30-28-I0l (Io) (a)-(d), as amended,and the Subdivision Regulations of Garfield County, Colorado, adoptedJanuary 2, L979, sections 2.02,2L (d) and 3.02.0r for the purpose of aboundary line adjustment for those parcels of land described in Book 62Land Page 833 and U.S. Patent No. 05-83-0008 as filed in the Office of theCIerk and Recorder of Garfield County Colorado. The above describedboundaries are hereby amended and more particularly described as follows: Tract A: Those portions of Lots 10, 12 and 19 Section 27, Township 7South, Range 88 West of the 6th Principal !4eridian described asfollows: Beginning at .a point on the southerly right-of-way rine of stateHighway No' 82, whence the East quarter corner of said Section 27bears N.78o33r8. 3228.90 feet; thence south 450.00 feet to thecenter of the Roaring Fork River; thence lrlest 230.88 feet alongthe center of the Roaring Fork River to the West line of said f,ot12; thence North 35r.80 feet arong the west line of said Lots L2and 10 to the southerly right-of-way rine of said state HighwayNo. 82i thence Northerly and Easterly along the southerlyright-of-rday line of said state Highway uo. 82 Eo the poLnt ofbeginning, containing 2.L55 acres more or 1ess. (in the State of Colorado and County of Garfield); and WHEREAS, the Petitioners have demonstrated to the satisfaction of theBoard of County Commissioners of Garfietd County, Colorado, that theproposed division does not fall within the purposes of Part 1, Article 28,Title 30, Colorado Revised Statutes L973r Ers amended, for the reason thatthis property adjustment is solely for the purpose of adjusting property boundary rines and no. new lots are created by this actionr EDd NOW, THEREFORE, BE IT RESOLVED that the boundary line adjustment ofthe above described tracts rrArr and rrBrr are hereby exempted from suchdefinitions and said tract may be divided into tracts nAtr and "B", all asis more fu1ly described above. In addition, a copy of the instrument orinstruments of conveyance when recorded shaIl be filed with thisResolution.
