TRAUL RULING OF REFEREE IN THE ROARING FORK OR ITS TRIBUTARTES TRTBUTARY TNVOLVED: rN GARFIELD COUNTY RIVER FOUR MILE CREEK The above entitled application was filed on April 28, 1980, and was referred to the undersigned as Water Referee for Water Division No. 5, State of Colorado, by the Water Judge of said Court on the 8th day of May, 1980 in accordance with Article 92 of Chapter 37, Colorado Revised Statues 1973, known as The Water Right Determina- tion and Administration Act of 1969 And the undersigned Referee having made such investigations as are necessary to determine whether or not the statements in the ap- plication are true and having become fully advised with respect to the subject matter of the application does hereby make the following determination and ruling as the Referee in this matter, to-wit: 1. The statements in the application are true.. 2. The name of the "tr".t"i-L is Face }lountain Spring. 3. The name of the claimant and address is: John M. Trau] and Gail N. Trauli 6471 County Road 117; Glenwood Springs, Colorado. 4. The source of the water is a spring tributary to Four Mile Creek, tributary to the Roaring Fork River. 5. The spring is located in the Sw1/4581/4 of Section 15, T.75., R.B9W. of the 6th P.M., &t a point whence the South Quarter Corner of said Section 15 bears S.50o09r31tr W. 1340.1 feet. 6. The use of the water is piscatorial, Iivestock water and lawn and garden irrigation. 7. The date of initiation of appropriation is 1929. B. The amount of water claimed is 0.446 cubic foot of water per second of time, absolute. 9. The water is diverted at the spring Lo a ditch and conveyed to a pond. The water is used in the pond for piscatorial and live- stock water purposes. The water is diverted from the pond to irri- gate a small garden and lawn. The overflow from the pond returns to Four Mile Creek.10. The water tr/as f irst applied to benef icial use in 1929. FILLrt) IN WATEI{ COUIT'I Division No. 5 /tUG 2 81!80 STATE OE COLORADC The Referee does therefore conclude that the above entitled ap- plication should be granted and that 0.446 cubic feet of water per second of tirne is hereby awarded to the Face Mountain Spring, for piscatorial, livestock water and irriqation uses, with appropriation date of the 31st of December, 1929t absolutely and unconditionally; subject, however, to arr earlier priority rights of others and to the integration and tabulation by the Division Engineer of such priorities and change sof rights in accordance with 1aw. It is accordingly ORDERED that, this ruling shall be filed with the Water Clerk and shall become effective upon such .filing, subject to Judicial review pursuant to Section 37-92-304 CRS 1973. ft is further ORDERED that a copy of this ruling sha1l be filed with the appropriate Dtvision Engineer and the state Engineer.
