RESOLUTION NO. 86-76
A RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE GARFIELD COUNTYSUBDIVISION REGULATION FOR JOHN TRAUL.
WHEREAS, John TrauL has petitioned the Board of County Comrnissionersof Garfield county, colorado, for an exemption from the Aeiini.tion of theterms nsubdivision' and 'subdivided landn under c.R.s. Ig73, 3O-2g-I0l(10 ) (a ) - (d ) , as amended, ancl the Subdivision Regulations of GarfieldCounty, Colorado, adopted ApriL 23, 1984, Section 8:00 through g:60 andfor the division of a 7.6 acre tract described in Book 5I4, eales 960 and961, as filed in the office of the Clerk and Recorder of Garfield County,Colorado into two tracts of approximately 4.9 acres and 2.6 acres, more orless, which proposed divided tracts are more practically described asfollows:
TRACT A: see attached J-ega1 description for North parcel-.
TRACT B: see attached legal description for south parcel.
(in the state of colorado and county of Garfield); and
WHEREAS, the Petitioner has demonstrated to the satisfaction of theBoard of County Commissioners of Garfield County, CoIorado, that theproposed division does not fa11 within the purposes-of part 1, Article 29,Title 30, Colorado Revised Statutes 1973r Els amencjed, for the reason thatthe divislon does not warrant further subdivision review, and
WHEREAS, the Petitioner has demonstrated to the satisfaction of theBoard of County Commissioners of Garfield County, Colorado, that there isa reasonable probabilit.y of locating domestic water on each of saidtracts, that there is adequate ingress and egress to said tracts, that thelocat,ion of septic tanks wiLl be permitted by the Colorado Department ofHeaLth, that the requested division is not pirt of an existin| or largerdevelopment and does not fa1I within the general purposes and intent ofthe subdivision regulations of the state of colorido and the county ofGarfieLd, and should, therefore, be exempted from the definition of theterms nsubdivision' and subdivided land' as set forth in C.R.S. 1973,30-28-101 (10) (a)-(d), as amended;

NOW THEREFORE, BE IT RESOLVED that the division of the abovedescribed tracts nA' and nB' from the above described 7.6 acre tract ishereby exempted from such definitions and said tract may be divided intotracts 'A' and nB" all as is more fulIy described above, however, thisexemption is granted on the condition and w:.th the expressed understandingand agreement of the Petitioner that no further ex6mption be allowed onsaid tracts 'An and 'Bn and that a copy of the instrument or instrumentsof conveyance when recorded sha11 be fifea with this Resolution.
