The site is located in Subdivision District 1B with central water andsewer and moderate environmental constraints. The site lies withinthis district due to its proximity to the Oak Meadows Subdivision.
II. DESCRIPTION OF THE PROPOSAL
A. Site DescripLion: The site consists of fairly level topographyffi1eCreekwithmoderates1opeswestofthacreek.Vegetation is mainly pasture and lawns with large trees along thecreek and adjacent to existing buildings. Improvements on thesite include a barn and several sheds, one single familyresidence and a small pond all located on the proposed six acreparcel. Land use on the site and in the vicinity are mainlyresidential with some ranching and open space. Four l{iIe Creekruns through the property roughly dividing it in haIf.
B. Project Description: The applicant proposes to divide the eightacre parcel into a six acre parcel and a two acre parcel. Thesix acre parcel will utilize existing access, water and septicfacilities.
C. History: The applicant has received approval in 1980, byEe-d6Gion #!0-321 of a previous exemptior,-iequest on this site.The previous eEmption created two additional iwo acre lots southand west of the current proposal.
TIT.MAJOR ISSUES AND CONCERNS
The applicant proposes use of a well or existing spring for wateron the two acre parcel. The present decree for the spring doesnot a1low for domestic use. Amendment of the decree and/or anaugmentation plan may be required to enabre use of the spring orissuance of a well permit, as recommended by the oivision- ofWater Resources, Glenwood Springs office.

The 100 year floodplain should be shown on the plat along withplat notes limiting all homesites to those areas outside of thefloodplain.
The applicants soil report notes that the soil units found on thesite, while used for homesites, are "poorly suited for homesite
development. " Severe limitations on development, includingdwellings and septic systems, are noted based on slopes,shrink-sweIl soils and stones throughout the profile.
Topographic maps of the site show the proposed lot having
moderate slopes generally less than 168. In addition, a large
drainage swale is located above the proposed Iot draining a largeportiop of the Oak },leadows Subdivision onto the lot. (See map,
pase 4 )
The proposed lot is two acres in size and in compliance with the
minimum lot size of two acres for the A/R/RD zone district.
Access to the proposed lot and the two previously created parcels
is by private road easement. This easement should be a minimumof 50 I in width and be adequate for the construction of a bridgeacross Four MiLe Creek. Due to potential line of sight problems
and proximity to curves on County Road lL7, the access point
should be approved by the County Road and Bridge Department.
IV.SUGGESTED FINDINGS
1. That proper posting and public notice was provided as requiredfor the meeting before the Board of County Commissioners.
2. That the meeting before the Board of County Commissioners was
extensive and complete, that all pertinent facts, matters andissues were submitted and that all interested parties were heardat that meeting.
That for the above stated and other reasons, the proposed
exemption is in the best interest of the heaLth, safety, morals,
convenience, order, prosperity and welfare of the citizens ofGarfield County.
V.RECOMII,IENDATION
APPROVAL, with the following conditions:

3. That the applicant submit proof of a lega1 and adequate source of
water for the two acre parcel including, but not limited to, an
approved copy of an amended decree and/or an augmentation plan
enabling the use of the spring or issuance of a weII permit fordomestic use. Use of the spring wilI require deeding of
appropriate water rights to the new parcel.
