when the following proceedings, among others were had and done, to-wit:
RESOLUTION NO. 81-208
RESOLUTION CONCERNED I.IITIi GRAMING AN E)CEMPTION FROM THE GARFIELD COIINTY SIDDIVISION
REGI]LATIONS FOR HOLLIS AND JEAN TUFLY.
WHEREAS, Hollis and Jean Tufly have petitioned the Board of County Commissioners
of Garfield County, Colorado, for an exenption from the definition of the terms "sub-
division" and "sutdivided 1and" under C.R.S. 1973, 30-28-101 (10) (a)-(d), as amended,
and the Subdivision Regulations of Garfield County, Colorado, adopted January 2, 1979,
Sections 2.02.21 (d) ,rra:.02.01 for the division of a 86.43 acre tract described as
follows:
Ttrat parcel of land as described in Document No. 259197 as filed in the Office
of the Clerk and Recorder of Garfield County, Colorado into 2 tracts of approx-
imately 8.55 and 77.88 acres each, more or l,ess, which proposed divided tracts
are nore particularly described as fol-lows:
Tract A: A parcel of land situated in the SWkNI^Ik of Section 12, Township 6
South, Range 93 West of the 6th Principal Meridian, Garfield County, Colorado,
lying Northerly of the Northerly right-of-way line of U.S. Highway 6 & 24, said
parcel- of land is more ful1y described as follows:
Beginning at a point on sai<l Highlaay rigta-of-way line; whence the tr^Ies-t^Quarter
Corner of said Section 12 bearsi S 33"16'26" w. 865.16 feet; thence N 00"29'00" E.
along a line described by Document No. 172258 as filed in the Garfield County,
Colorado records, 571.70 feet to a point on the Southerly right-of-way line of
County Road No. 22t; thence N 89"33'00" E along said Southerl-y right-of-way line
810.97 feet to a point on the Westerly right-of-way lire of Courty Road No.223;
thence S 00'11'17i'E. along said Westerly right-of-way line, 359.72 feet to a point
in sald l{ighway right-of-way linel thence, along said Highway right-of-way line,
S 76"37'00" I,I. 413.33 feetl rhence 433.11 feet along Ehe arc of a curve to the left
having a radius of 3860.00 feet, the chord of';hich bears: S 73o24t08" W.432'89
feet to the point of beginning, contai.ning 8.55 acres tnore or less'
Tract B: A parcel of land situated in the SWkSW% of Section 1, and glru 59p';914N of
Section 12, all in Township 6 South, Range 93 l^Iest of the 6th Principal Meridian,
Garfield County, Colorado, said parcel of land is nore fully described as follows:
Begirrning aL the Southwest Corner of said Seciion 1; thence N 00'24t15t'W. along
the West line of said Section 1, 1311.85 feec to a point on the Southerly right-
of-way line of County Road No. 210; thence N 89"47'21" E, along said Southerly
right-of-way 1ine, 1-SOS.04 feet to a point on the Westerly right-of-way line of
County Road No. 223; rhence S 00o22'35" E along said Westerly right-of-way line,
1309.10 feet to a poi-nt on the south line of said sLr2strf,z;; thence s 00o19'38" E.
along said Westerly right-of-way line 1288.10 feet to a point on the Northerly
r:ighi-of-way line- of Cou:rUy R-oari No. 221: thence S 89"33100" !tr. along said
Noitherly right-of-way line, 1304.64 feet to a point on the West line of said
Section 12; rhence N bOo19'01" W. along the West line of said Section 12, 1290.80
feet to the Northwest Corner of said Section 12, the point of beginning, containing
77.88 acres' more or less; and

I4IHEREAS, the Petitioners have denonstrated to the satisfaction of the Board of CountyCouurissioners of Garfield County, Colorado, that the proposed division does not fa11 withinthe purposes of Part 1, Article 28, Title 30, Coloraclo Revi-sed Statutes 1973, as amended,for the reason that the impact created does not warrant further subdivision revi-ew; and
I'IHEREAS, the PetiEioners have demonstrated to Ehe satisfaction of the Board of CorgtyCommissioners of Garfield County, Colorado, that there j-s a reasonable probability oflocating domestic water on each of said tracts, that there i-s adequat" irrgr."s and egressto said tracts, that the location of septic tanks will be permitred by the Colorado o.pu.t-ment of Health, that the requested division is not part of an existing or larger devel-opment and does not fa11 within the general purposes and intent of the subdivision reg-ulations of the State of Colorado and the County of Carfield, and should, therefore, beexemPted from the definition of the terms "subdivision" and "subdivided land" as setforth in C.R.S. L973, 30-28-101 (10) (a)-(d), as amended;
N0W, THEREFORE, BE IT RESOL\ED that the division of the above described rracrsttA", ttBt'from the above described 86.43 acre tracE is hereby exempted from such def-initions and said tract may be divided into tracts "A", t'B", all as is more ful1y des-cribed above, and said divided tract may be conveyed in the form of sueh smaller tractswithout further compliance with the aforesaid subdivision statutes and regulations;provided however, that this exeupti-on i.s granLed on the condition, and with the err.lpressunderstanding and agreeBent of the Petitioners that nc furt.her exemptions be allowed onsaid tracts ttAtt, and that a copy of the instrument or instruments of conveyance whenrecorded shall be filed with this Resolution.
