HomeMy WebLinkAbout1.0 ApplicationBEFORE THE BOARD OF COUNTY COMMISSIONERS OF GARFIELD COUNTY, COLORADO PETITION FOR EXEMPTION Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a)-(d) as amended, the Subdivision Regulations of Garfield County, Colorado, and Resolution No. 80-65 adopted by the Board of County Commissioners of Garfield County, Colorado, on May 5, 1980, trn]i1liam Turnbu1l, Thomas R. Turnbull and Rosamond Turnbu1l, hereby respectfully petition the Board of County Commissioners of Garfield County, Colorado, to exempt by resolution, the division of a parcel of land containing L6.67 acres, more or less, from their respective properties as described in deeds recorded as Reception No. 242382, and 24L183 of the Garfield County Records (copies of which deeds are attached hereto), from the definitions of "subdivision" and "subdivision 1and" as the terms are used and defined. in C.R.S. (1973) Section 30-28-101 (a) - (d) and the Garfield County Subdivision Regulations, for the reasons stated below: 1. The petitioner, William Turnbull and his wife, Elizabeth Turnbull, constructed a residence on that portion of the subject parcel which is owned by petitioners Thomas R. Turnbull ancl Rosamond Turnbull in L9 70 2. Said William Turnbull and Elizabeth Turnbull are the natural parents of Thomas R. Turnbull. 3. This subdivision exemption is requested in connection with the sale of approximately 580 acres of the adjoining property owned by the petitioners. 4. The property being subdivided has been under the Same ownership for more than five (5) years and the requested division will create only one (1) new tract under 35 acres in size and no earlier division of the subject property has been obtained. l-s by 5. The residence located on the tract to be subdivided currently served by an existing permitted domestic water well' 6. The sewage disposal needs of said residence is served an individual sePtic sYstem. 7. No live stream crosses or joins the tract to be subdivided' 8. In support of this petition, the petitioners also submit the following: (a) Improvement survey map depicting tract to be subdivided and legal descriPtion thereof. (b) copies of deeds showing ownershj.p of the subject property in the Petitioners. (c) Vicinity map showing the propertys location' (d) SoiI conservation analysis of soil types on the property.
