RESOLUTION NO. Bz-j04
A RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE GARF'IELD COUNTY
SUBDIVISION REGULATIONS FOR MICHAEL AND CAROL TRULOVE.
WHEREAS, Michael and Carol Trulove have petitioned the Board of
County Commissioners of Garfield County, Colorado, for an exemption from
the definition of the terms "subdivisionn and nsubdivided land' under
C.R.S. I973, 30-28-101 (10) (a)-(d)r as amended, and the Subdivision
RegulaLions of Garfield County, CoIorado, adopt.ed ApriL 23, I984, Sectlon
8:00 through 8:60 and for the division of an I8 acre tract as described in
Book 516, Page 336, as filed in the Office of the Clerk and Recorder of
Garfield County, Colorado into three tracts of 5 acres, 5 acres and 8
acres, more or less, which proposed divided tracts are more practically
described as follows:
TRACT A: See attached legal description for Parce1 1.
TRACT B: See attached lega1 description for Parcel 2.
TRACT C: See attached legal description for Parcel 3.
(in the State of Colorado and the County of Garfield); and
WHEREAS, the Petitioners have demonstrated to the satisfaction of the
Board of County Commissioners of Garfield County, CoIorado, that the
proposed division does not fall within the purposes of Part 1, Article 28,
Title 30, Colorado Revised Statutes 1973r ds amended, for the reason that
the division does not warrant further subdivision review, and
WHEREAS, the Petitioners have demonstrated to the satisfaction of the
Board of County Commissioners of Garfield County, Colorado, that there is
a reasonable probability of locating domestic water on each of said
tracts, that there is existing ingress and egress to said tracts, that the
Iocation of septic tanks will be permitted by the CoLorado Department of
HeaIEh, that the requested division is not part of an existing or larger
development and does not fall within the general purposes and intent of
t,he subdivision regulations of the State of Colorado and the County of
Garfield, and snouta, therefore, be exempted from the definiEion of the
terms "subdivision' and "subdivided landn as set forth in C.R.S. L973,
30-28-10I (10) (a)-(d) r as amended;
NOW THEREFORE, BE IT RESOLVED Eha[ the division of the above described
tracts 'An, nB', and 'C' from the above described IB acre tract is hereby
exempted from such definitions and said tract may be divided into said
tracts nA', 'B', and 'Cn and may be conveyed in the form of such tracts
'A', nB", and 'C', all as is more fuIJ.y described above; however, this
exemption is granted on the condition and wiEh the expressed understanding
and agreement of the petitioner that no further exemption be allowed on
said tracts nAn, nB', and nC' and that a copy of the instrument or
instruments of conveyance when recorded shalI be filed with Ehis
Resolution.
