Submitted is a copy of the Prel'imjnary Plan proposal for the above
mentjoned property, which is being submitted to you at the directjon of the
Board of County Commissioners of Garfield County, Colorado in accordance
with the Garfield County Subdivision Regulations.
This submittal amends the Preliminary Plan of the Riverbend Planned
Unit Development. It involves the addition of three (3) lots with existino
house and the enlargement of a commercial lot and pnivate stable area. The
ex'istingJ structures are presently served by wells and septic systems, but
will be connected to the central water and sewage treatment systems of the
Rjverbend Metropolitan District. The soils investigation done in 1973 for
the original R'iverbend Development should be adequate for review by the
Geol ogi ca"l Survey.

Comments: Water Quality Control_: The Water Quality Control Division has no ob-
jection fo this proposal in that water and sewer service r^r111 be available through
the Riverbend Metropol-itan District. Please note that, in aecordance with Senate
Bill 35, aoy development serving more than 20 people must receive site plan appro-
val from the Water Quallty Control Commlssion before construction will be aLlowed
to commence on the sewer extensions. In addition, any construction undertaken
should strLctly adhere to an approved erosion and sediment control plan incorpora-
ting measures designed to minimize possibl-e contamination of area waters. For
like reason, we advise against permitting devel-opment to encroach upon the 100
year floodplain

Dear Ms. Andreasen:
We have revlewed the preliminary plat of Ri-verbend Ranchettes and found
that easements within the roadway will be adequate.
May we suggest the following phraseology be used in the dedicatlon of
easements within said subdivi-sion.
"And hereby dedicate to the public all the streets, avenues and roads as
shown on the accomPanying plat, forever, and dedicate to the UTILITIES
those portions of real property which are labeled as utility easements on
the accompanying plat, as easements for the installation and rnaintenance
of utilities and drainage facilities, including, but not limited to,
electric lines, gas lines, telephone lines; together with the right to
trim interfering Erees and brush; together with the perpetual right of
ingress and egress for installation, maintenanee and replacement of such
lines; said easements and rights shall be utilized in a reasonable and
prudent manner.tt
trIe believe all preliminary, as well as final, plats should show the ded-
ication or reference to the particular "Protective Covenants" which will
run with the property. Also, all "Prj-vate Roads" should be dedicated to
the utilities for the installationo maintenance and operation of gas,
lights, power and telephone lines. No easements should be dedicated to
the properry owners, cities or counties exclusively; all easements should
be dedicated to the utility companies.
The above request is in accordance with C.R.S. LO6-2-34 (3) (d) (viii) and
the Colorado Land Use Corunission's Paragraph 5-2, Item llc-7 .

We have reviewed the arnended Prelirninary PIan of the Riverbend
Planned Unit Developrnent (SE+, S. 34, T. 5 S. , R. 90 w. , 6 P. M. )
and have the following cornrnents to rnake.
Lot D, which contains a cornrnercial stable, could present a possible
future source of water pollution if provisions are not rnade for continuing
adequate waste disposal. We therefore recornrnend that a stipulation
either be noted directly on the Prelirninary Map or in the developrnent
perrnit to assure that stable wastes are not allowed to accurnulate and
degrade land and water.
Thank you for the opportunity to cornment on this PUD arnendment
proposal.

I,lle have reviewed the preliminary map of Riverbend Ranchettes and our oldfile for the Riverbend Development. The subdivision in question appearsto have few constraints and is essentially comp'letely developed at this timewith existing bui'ldings. The on'ly concern which could be a problem in
the future would be the increased runoff due to development updrainage
from Lot B.
In conclusion, there appears to be no geologic reason why Riverbend
Ranchettes should not be approved. Apparently, Filings 1 and 2 of
Riverbend Development have already been submitted and approved. l,le
have no record of these filings being submitted to this office for
review. As you know lre had a number of concerns about the Riverbend
Development which are stated in our December 4, t973 letter. [^le
sincere'ly hope that these concerns have been adequately addressed and
appropriate changes made in the development p1an. In addition we believe
that the potential for geothermal space heating in this development may
exist at the hot springs on the property. ll.le recommend that this be fu11y
evaluated as soon as possible.

gent upon the developer obtaining a written commitment for service from
the District.

Dear Bob:
As you know, Hamilton Duncan is preparing to divide a subdivision of
approximately four lots for his property adiacent to mine.
Ham and I have discussed in great length this subdivision, but I feel
it is necessary to put some of my thoughts in writing. I would like
to see some protective covenants on that property so that nothilS
could happen'that would be derogatory to the subdivision which I am
presently'building. I am sure that a subdividers agreement wi.l1 be
in effect on that property and perhaps some coordination could be
done there with respect tb the extension of roads, the extension of
water lines, and the extension of utilities.
These are my areas of main concerno and I would appreciate your keeping
me posted as you progress with Duncan's application.
