Dear Commissioners:
I am writing to formally request a zoning change for a 10.61 acre parcel described in the
attached plans and specifications. The property is surrounded by: the Colorado River on
the North, NCEC property on the East and West, and the Riverbend Subdivision as well
as RE-2 School District property on the South. I am requesting the same zoning as the
adjacent Riverbend Subdivision.
As you may be aware, I purchased the remaining 20lots in Riverbend Subdivision a few
years ago. I anticipate complete build-out of Riverbend this year. I am requesting the
zoning change to be able to continue supplying the current demand in Garfield County for
affordable to moderate priced housing.

RIVERBEND BY THE RIVER
SKETCH PLAN
INTRODUCTION
Riverbend By The River is located approximately 3 miles east of New Castle on the
south side of the Colorado River in Section 34. Township 5 South, Range 90 West of the
Sixth Principal Meridian. lt lies between County Road No. 335 and the Colorado River
approximately 2.3 miles east of the New Castle interchange. The majority of this 10.61 acre
property slopes gently towards the river at an elevation ranging from 5630 to 5600. On the
northern edge of the parcel, the property slopes fairly steeply down to the river, with a river
bank ranging from 20 to 25 feet high.
Vegetation on this property is sparse, consisting primarily of bunch grass and sage
brush. A few juniper trees, ranging in size from six inches in diameter to twelve inches in
diameter are located near the northeast corner of the property. Several small natural
drainages cross the property from South to North and drain into the river. Because of the
relatively steep river bank, only the area immediately adjacent to the Colorado River will be
subject to flooding during a 1OO year flood.
This property is a part of the Riverbend PUD approved in the 1970's. The applicant
is requesting an amendment of a portion of the P.U.D. to allow for subdivision into 16 lots,
each having an area of approximately one-third of an acre. Five of the lots are designed for
two-family units, and eleven would be single-family lots. Nearly four acres will be retained
as Open Space giving an average density of 0.51 acres per unit. These lots would be similar
in size to the adjacent Riverbend Subdivision, Filing No. 1, and would be served by the
existing water and sewer facilities for Riverbend Subdivision.
Riverbend Subdivision, Filings No. 1 and 2, which were subdivided in the late 1970's,
lie south of the county road just east of this property. The existing filings contain 46 lots
which range in size from 0.36 of an acre to 0.82 of an acre with an average lot size of 0.51
of an acre. This is the same density as the proposed subdivision. Riverbend Ranchettes
which is composed of three lots averaging 1.95 acres is located to the north and east of
Riverbend Subdivision.
This application is designed to take advantage of the relatively flat grade of the
property and the availability of central water and sewer facilities. The overall density is
designed to be consistent with the adjoining Riverbend Subdivision, both having a density of
0.51 acres per unit.
Five two-family lots are incorporated in this plan near the north side of the property.
These units will be designed so that the overall scale and character of the buildings will blend
with the single-family homes in the subdivision, rather than being obtrusive. Having the
higher density on some of the lots will allow the developer to offer these units for sale at a
moderate price, making them available to a larger number of area families. Current trends in
the area have shown that there is a market for this type of homesite. lt is expected that the
existing lots in Riverbend will be built out this year and, given the availability of central water
and sewer, this area becomes the next logical area for development.
Homeowners in this subdivision would become members of a new Homeowner's
Association which will be created for this subdivision. The association will provide such
services as road maintenance, and maintenance of the open space. Protective Covenants for
the subdivision will address dog control, architectural control and administration of the
Homeowner's Association.
ACCESS
The access to this property is from County Road No. 335 from the New Castle
interchange with lnterstate 70. This road is a two lane paved road which serves the existing
Riverbend Subdivision and then ends immediately past that subdivision. The proposal includes
a new interior loop road which will provide access to all lots in the subdivision. This road will
be constructed to the standards of a "RuralAccess Road", and willinclude two 1 1 foot lanes
with 6 foot shoulders in a 50 foot wide right of way. The surface will be chip and seal. No
on street parking will be allowed.
UTILITIES
Domestic and lrrioation Water
Water for domestic and irrigation use will be provided by RB Water and Sewer
Company, the owners and operators of the water system which currently serves Riverbend
Subdivision, Filings No. 1 and 2 and Riverbend Ranchettes. This system is fed by Riverbend

Wells No. 3 and 4 which were decreed in water court under Case No. W-2125 on July 23,
1974. ln addition, three additional wells, Rivr:rbend Wells 1, 2 and 5, which were decreed
in the same case, have been drilled and will be put into service as the demand for water
dictates. Each well has a decreed right of 0.67 cubic feet of water per second. The decree
provides for municipal use, including domestic, irrigation incidental thereto and sewage
treatment, recreation, fish and wildlife propagation and all other beneficial purposes, including
storage for each of the above purposes. Pre'vious pump tests for these wells have yielded
240 gallons per minute for Riverbend Well No. 3 and 260 gallons per minute for Riverbend
Well No. 5. Water usage requirements, as shown in Exhibit A, are well below the capacity
of these wells.
Water storage for Riverbend Subdivision in currently provided by a 3O,000 gallon water
storage reservoir located on the hill above Filing No. 2atan elevation of 5960. This storage
will be augmented by the construction of an additional storage tank by RB Water and Sewer
Company. The size of this tank will be determined based on fireflow requirements of the
Burning Mountain Fire Protection District. The existing water lines within Riverbend
Subdivision will be extended and looped through this subdivision to provide service for the
new lots. Fire hydrants will be provided, and will be located as required by Fire District
Regulations.
wastewater Treatment
Wastewater treatment for this subdivision will be provided by BB Water and Sewer
Company. The existing treatment ponds are being relocated to an area closer to the river and
the facility is being upgraded in order to bring the system into compliance with current
Department of Health regulations. The new facility will consist of two aerated partial-mix
lagoons and a settlement basin and will provide secondary treatment to the wastewater. The
final effluent will be chlorinated and then discharged to the Colorado River. The new system
will have the capacity to serve the additional 21 units. New technology in aeration has
created systems which are much more efficient than systems used in the past. subsurface
aeration works to eliminate most of the odor from the lagoons. Even units located in close
proximity to the new ponds should not find the odor objectionable. The subsurface aeration
eliminate airborne particles from the ponds. An earthen berm will be built and landscaped to
reduce the visual impact to adjoining lots. The old treatment lagoons will be abandoned and
reclaimed under criteria established by the Colorado Department of Health.
Electric Service
Electric service for this area is currently provided by Public Service Company. An
existing overhead line is located along County Road No. 335. New service will be installed
underground from the existing overhead line to serve this subdivision.
Telephone Service
Telephone service is provided by US West to this area. An existing line is located on
the south side of County Road No. 335, and has adequate capacity to serve this development.
The new service will be extended underground using a joint trench agreement with Public
Service Company.
Natural Gas Service
Natural gas is not available in this area at this time, and there are no plans for
extending service in the near future. Homeowners in this subdivision can choose to use
propane to heat their homes through individual agreements with the gas company, or they can
choose to have all electric service in their homes.
Cable Television Service
TCI Cablevision provides cable service to residents in the New Castle arca, but at this
time does not have cable service this far outside of town. The cost of extending cable for this
number of lots would be prohibitive, so it is unlikely that cable television service will be made
available to this subdivision. However, newer technology such as Primestar satellite systems
are available at a relatively low cost. This will probably be the option of choice for this
subdivision.
OPEN SPACE AND PARKLAND
Two areas of Open Space will be created on this property. The first and largest area
will be an area of 3.32 acres along the Colorado River. A 25' river access easement will be
dedicated to the public along the western side of the property to provide for public access to
the river for fishing and other recreational uses. An area at the top of the river bank in this

site will be used for the wastewater treatment facility for this subdivision which will be built
on an easement within the Open Space. Berms will be built around the treatment ponds to
screen them from the view of the adjoining lots. The site will also be properly fenced to keep
people and animals away from the treatment facilities.
The second area of Open Space will be in the middle of the subdivision so it can be
easily accessible to everyone who lives there. This area, approximately 0.64 of an acre in size
will be owned and maintained by the Homeowner's Association. Because of its central
location, it will function very well as a playground for small children or as
a playing field for the families who will live here.
!n addition to the Open Space being dedicated as a part of this filing, a school site has
already been dedicated. lmmediately across the County Road from this site is a ten acre parcel
which was dedicated to Garfield County as a school site when the first filings of Riverbend
were developed.
SOILS
The soils on this site are Heldt clay loam on three to twelve percent slopes. (See soils
mapping and classification tables attached as Exhibit D). Heldt clay loam is a deep, well
drained, gently sloping soil on alluvial fans and sides of valleys. The soil formed in fine
te*ured alluvium derived from shale and sandstone. Typically the surface layer is grayish
brown clay loam about 8 inches thick. The subsoil is light brownish gray clay loam about 13
inches thick. Light gray clay lies below this at a depth of 60 inches.
This soil is suitable for irrigated crops and hay, which can be effectively irrigated using
flood irrigation. Surface runoff is medium, and the erosion hazard is moderate. Native
vegetation on this soil is generally wheatgrass, sagebrush and low rabbit brush. Habitat may
be provided for small animals such as rabbits, squirrels, mourning doves and pheasants.
Buildings and roads can be designed to compensate for the shrink-swell potential
associated with clay material. Soils testing will be done at Preliminary Plan to determine
appropriate design criteria. The slow permeability severely limits septic tank absorption f ields,
making a municipal sewage treatment facility much more desirable than individual sewage
disposal systems.
DRAINAGE
Two relatively small drainage channels cross this property from south to north. The
largest of the two lies primarily east of this property, but flows into this property near the
northeast corner and then continues north to the river. This drainage will remain undisturbed,
except for minor modifications which may be necessary in Lot 9 to divert the water around
the building envelope. The other drainage is located near the west side of the property and
flows towards the east around the existing wastewater treatment ponds. A small swale will
be created along the west side of the property to divert the flow from this drainage around
the building sites and to direct it towards the river. Drainage easements will be created along
the lot lines as necessary to drain water from the roadside ditches to the river. Standard
drainage components can be utilized to prevent runoff created by this development from
exceeding historic flows.
IMPACT
This development will have a limited impact on the Colorado River because of its
location on the river bank some twenty- five feet above the river. As previously discussed,
drainage into the river will be limited to historical flows, so no direct impact as a result of
increased flows will occur. lt is expected that foot traffic will occur in the river access
easement as this area is opened up to public access. Some impacts to the river bank can be
expected because of the increase in the number of people fishing and playing in the river.
However, the river bank in this area is quite rocky, and there is no wetland or riparian
vegetation along the river bank that needs to be protected.
It should be noted that the outflow from the new wastewater treatment plant will flow
into the river near the northeast corner of this property. The effluent from this plant will be
treated and then chlorinated prior to release according to standard practice and State Health
Department regulations. The changes which are currently being made to this wastewater
treatment facility are required to bring the plant into conformance with current State Health
Department regulations.
lmpacts associated with this change should be associated with the current
development of Riverbend Subdivision, and are not created by the development of this new
property.
The primary impact to the topography will be from the construction of a road to serve
the new lots on this site. Because the site is fairly flat with a relatively uniform grade, roads
can the built at grade with minimum cuts and fills. This will also allow easy access for
driveways, minimizing their impact as well. Excess fill materials from building excavations will
be used on site to optimize drainage around the buildings and also to create some variety in
the landscapes through the use of berms, etc. No large scale over lot grading is proposed.
On the western side of the property an existing drainage will be rerouted in a newly created
swale along the westernmost property line. The effects of this grading will be minimized,
however, when the lots are developed and landscaping is completed around the new homes.
RADIATION HAZARD
This property has been used as the site for the Riverbend wastewater treatment plant
since the subdivision was developed in the late 1970's. lt is intended that the site of the
existing water treatment facility will be cleaned up and reclaimed. The site will be
overexcavated to remove any contaminated materials, and the existing ponds will be filled in
with clean fill material. No other industrial or commercial use has occurred on this property.
Previous excavations on this property and in the adjoining Riverbend Subdivision have not
uncovered any soil conditions that would indicate this property has been used for any
industrial dumping, or that any other types of hazardous materials exist. No radiation hazard
is expected to exist, although this will be verified when soils testing is done prior to the
preparation of the preliminary plan.

deep, well drained, genfly sloping soil is on alluviat fansand sides of valleys. Elevation ranges from 5,000 to6,000 feet. This soil formed in fine textured alluviumderived from shale and sandstone. The average annualprecipitation is about 14 inches, the average innual airtemperature is about 48 degrees F, and the averagekost-free period is about 120 days.
Typically, the surface layer is grayish brown clay toamabout I inches thick. The sylsoil ii tignt brownish grayclay loam about 19 inches thick. The Jubstratum is ignlgray clay to a depth of 60 inches.
lncluded with this soil in mapping are small areas ofOlney. Aryada, and Kim soils that hive slopes of 3 to 6percent. These areas make up 5 to 10 percent of themap unit.
Permeability is slow, and available water capacity ismoderate. Effective rooting depth is 60 inches or mbre.Surface runoff is medium-, and the erosion hazard ismoderate.
This soil is used for irrigated crops and hay. Some

34-lldefonso stony loam, 25 to 45 percent stopes.
This deep, well drained, hilly to steep soil is on mesa
breaks, sides of valleys, and alluvial fans. A small portion
of this unit is on very steep to extremely steep mesa
escarpments. Elevation ranges from 5,000 to 6,500 feet.
This soil formed in mixed alluvium derived primarily from
basalt. This soil has a thin intermittent cap of reddish
eolian material. The average annual precipitation is about
14 inches, the average annual air temperature is about
46 degrees F, and the average frost-free period is about
125 days.
Typically, the surface layer is brown stony loam aboutI inches thick. The underlying material is white, very
strongly calcareous very stony loam to a depth of 60
inches.
lncluded with this soil in mapping are small areas of
Potts and Ascalon soils on less steep and depressional
positions. These areas make up about 5 to 15 percent of
the map unit.
Permeability is moderately rapid, and available water
capacity is low. Etfective rooting depth is more than 60
inches. Surface runoff is medium, and the erosion hazard
is severe.
lldefonso soil is used mainly for grazing and wildlife
habitat.
The native vegetation on this soil is mainly pinyon and
Utah juniper. The understory consists of lndian ricegrass,
wheatgrass, junegrass, serviceberry, bitterbrush, and big
sagebrush.
When the understory vegetation deteriorates, grasses
almost disappear and forbs and shrubs increase. Proper- :
ly managing the vegetation maintains wood production
and ground cover. The value for grazing is low because ,
of steep slopes and tree cover. Firewood, posts, and
;
Christmas trees can be harvested on the more gently i
sloping areas. i
This soil is suited to production of pinyon and Utah
juniper. lt can produce 9 cords of wood per acre when
trees more than 4.5 feet tall reach an average diameter
(at one foot) of 5 inches. The low available water capac-
ity affects survival of tree seedlings. Steep slopes and
severe erosion hazard affect harvesting.
Mule deer, chukar,.wild turkey, gray squirrel, and cot-
tontail rabbit find habitat on this soil.
Community development is limited by large stones and
steep slopes. Structures to divert runoff are needed for
roads.
This soil is in capability subclass Vlle, nonirrigated.

Garfield County Zoning Resolution as it pertains to the Sketch Plan Submittal for
"Riverbend BY the River".
Prooosed Water Source
water for domestic and irrigation use will be provided by RB Water and sewer
Company, the owners and bperators of the water system which currently serves
Riverbend subdivision, Filings No. 1 and 2 and Riverbend Ranchettes' This system is
fed by Riverbend wells No. 3 and 4 which were decreed in water court under case
No. W-2125 on July 23, 1974. ln addition, three additional wells', Riverbend wells 1'
2 and 5, which were decreed in the same case, have been drilled and will be put into
service as the demand for water dictates. Each well has a decreed right of o'67 cubic
feet of water per second. The decree provides for rnunicipal use, including domestic'
irrigation incidental thereto and sewage treatment, recreation' fish and wildlife
propagation and all other beneficial prrpot"t, including storage for the above
purposes. Previous pump tests for these wells have yielde d 24O gallons per minute
for Riverbend well No. 3 and 260 gallons per minute for Riverbend well No' 5' Water
usage requirements, as shown on the attached Exhibit A, are well below the capacity
of these wells.
Water storage for Riverbend Subdivision is currently provided by a 30'000 gallon
water storage reservoir located on the hill above Filing No' 2 at an elevation of 5960'
This storage will be augmented by the construction oi an additional storage tank by
RB Water and sewer company. The size of this tank will be determined based on fire
flow requirements of the durning Mountain Fire Protection District' The existing water
lines within Riverbend Subdivision will be extended and looped through this
subdivision to provide service for the new lots. Fire hydrants will be provided' and will
be located as required by Fire District Regulations'
SEWAGE TREATMENT
Wastewater treatment for this subdivision will be provided by RB Water and Sewer
company. The current facility is being upgraded in order to bring the system into
compliance with current Department ;f H&tt6 regulations. The new facility will
consist of two aerated partial-mix lagoons and a settlement basin and will provide
secondary treatment to the *urt"*it"r. At preliminary plan the design capacity of
in.r. ponds will be verified based on measurements of B'O'D' load and flow rates'
The site application will be modified accordingly'

Two relatively small drainage channels cross this property from south to north. The
largest of the two lies primarily east of this property, but it does cross the northeast
corner and then continue north to the river. This drainage will remain undisturbed,
except for minor modifications which may be necessary in Lot 9 to divert the water
around the building envelope. The other drainage is located near the west side of the
property and flows towards the east around the existing wastewater treatment ponds.
A small swale will be created along the west side of the property to divert the flow
from this drainage around the building sites and to direct it towards the river. An
earthen berm located south of the new wastewater treatment ponds will divert natural
drainage around the ponds and allow it to flow towards the river. Drainage easements
will be created along the lot lines as necessary to drain water from the roadside
ditches to the river. Standard drainage components can be utilized to prevent runoff
created by this development from exceeding historic flows.
NATURAL HAZARDS
There are no natural known hazards on this site relative to avalanches, landslides or
flood plains. Site specific soils testing will be done as a part of the preliminary plan
application for this subdivision. Recommendations of the soils engineers will be

OBJECTIVES OF THE P.U.D.
The primary objective of Riverbend by the River is to provide affordable homesites for
families with a moderate income. Because central water and sewer service is available in this
area, lot sizes consistent with the existing Riverbend Subdivision are appropriate. The
relatively flat terrain and lack of other physical restrictions will make these lots easily
buildable.
The proposed plan includes sixteen lots, five of which are zoned for two-family homes.
The two-family homes are grouped together near the north side of the property so that they
can be developed as a "neighborhood". These buildings are planned to be consistent in scale
and character with the single family homes so that they will not form an objectionable barrier
on this side of the property. The single- family lots are grouped on the southern half of the
property, and will promote building styles which are consistent with the existing Riverbend
Subdivision.
The existing wastewater treatment facility is currently being upgraded to comply with
current State Health Department Regulations. This upgrade involves construction of new
treatment lagoons which are located immediately north of the proposed two-family lots. Alt
of the area surrounding these new lagoons wilt be maintained as Open Space. This Open
Space includes a river corridor with public access to the Colorado River along the full width
of this property.
lnterior to the residential lots will be another Open Space area which will be developed
as a playing field or playground. This will allow easy access for all of the residents of this
development. Because of its central location, it will provide a good "gathering ptace" for
residents to play, socialize or to just relax.

Dear Mr. Boat:
The Water Quality Control Division has reviewed and evaluated your site application and supporting
documentation for a domestic wastewater treatment works to be located in the SW 1/4 of the SW 1/a ot
Section 34, T5S, R9OW to serue Riverbend Subdivision and to discharge to the Colorado River.
Prior to the operation of the facility, a discharge permit will be required which will specify the final
conditions and limitations of the operations of the facility. Enclosed is an application for the permit.
We find your application to be in conformance with the Water Quality Control Commission's "Regulations
for Site Applications for Domestic Wastewater Treatment Works". Therefore, the site application is
approved with the following conditions listed below.
1. Based upon application information, the system design will be for:
Average Daily Flow Capacity - 19,950 gpd
Organic Loading Capacity - 33 lbs. BODu/day
Treatment Processes to be used - Lined 3 cell aerated lagoon with chlorination
2. Preliminary Effluent Parameter Values:
BOD' - 3ola5 mg/l
SusPended Solids - 75/110 mg/l
Chlorine Residual - 0.5 mg/l
Fecal Coliform - 6,000/12,000 organisms/100 ml.
Design for values in excess of those contained in conditions 1 and 2 above or failure to comply with any
other conditions contained herein will render this approval void and another site application will have to
be processed.
3. This site approval will expire one year from the date of this letter if the construction of
the project has not commenced by that date. lf expiration occurs, you must apply for a
new site approval. Construction is defined as entering into a contract for the erection or
physical placement of materials, equipment, piping, earthwork, or building which are to
be a part of a domestic wastewater treatment works.
4. The design (construction plans and specifications) for the treatment works must be
approved by the Division prior to commencement of construction and all construction
change orders initiating variances from the approved plans and specifications must be

approved by the Division.
5. The applicant's registered engineer must furnish a statement prior to the
commencement of operation stating that the facilities were constructed in conformance
with approved plans, specifications, and change orders.
6. At such time as service by a regional wastewater treatment facility becomes available to
this property, use of this system shall be discontinued and connection made to the
regional system.
ln accordance with Colorado Water Quality Control Commission regulations, this approval is subject to
appeal as stated under Section 2.2.5 (Z) of "Regulations for Site Applications for Domestic Wastewater
Treatment Works".
This approval does not relieve the owner from compliance with all county regulations prior to
construction nor from responsibility for proper engineering, construction, and operation of the facility.
