Dear Commissioners:
I am writing to formally request Preliminary Plan approval for Riverbend, Filing #5,
A zone district and text amendment and Sketch Plan for this project were approved by the
Board of County Commissioners on June 5, 1995.
This project, as proposed, includes 1 1 single-family lots and five 2-family lots. The property
is located immediately west of the existing Riverbend Subdivision near New Castle.
I anticipate build-out of the existing Riverbend lots this year. I am requesting approval of this
subdivision so I can continue to supply the current demand in Garfield County for moderately
priced housing.

RIVERBEND FILING #5
PRELIMINARY PLAN
INTRODUCTION
Riverbend Filing #5 is located approximately 3 miles east of New Castle on the south
side of the Colorado River in Section 34, Township 5 South, Range 90 West of the Sixth
Principal Meridian. lt lies between County Road No. 335 and the Colorado River
approximately 2.3 miles east of the New Castle interchange. The majority of this 10.61 acre
property slopes gently towards the river at an elevation ranging from 5630 to 5600. On the
northern edge of the parcel, the property slopes fairly steeply down to the river, with a river
bank ranging from 20 to 25 feet high.
Vegetation on this property is sparse, consisting primarily of bunch grass and sage
brush. A few juniper trees, ranging in size from six inches in diameter to twelve inches in
diameter are located near the northeast corner of the property. Two small natural drainages
cross the property from South to North and drain into the river. Because of the relatively
steep river bank, only the area immediately adjacent to the Colorado River will be subject to
flooding during a 1O0 year flood.
This property is currently zoned Planned Unit Development. On June 5, 1995, the
Board of County Commissioners approved a zone district and text amendment to the existing
Riverbend P.U.D. as it affected this property. This change was made in order to clarify some
rather ambiguous information contained in the original P.U.D documents, and to establish the
zoning regulations for this property. Under that approved zoning, the applicant is now
requesting preliminary plan approvalto allow for subdivision into 16 lots, each having an area
of approximately one-third of an acre. Five of the lots are designed for two-family units, and
eleven would be single- family lots. Nearly four acres will be retained as Open Space giving
an average density of 0.51 acres per unit. These lots would be similar in size to the adjacent
Riverbend Subdivision, Filing No. 1, and would be served by an extension of the existing
water and wastewater facilities which now serve Riverbend Subdivision.
Riverbend Subdivision, Filings No. 1 and 2, which were subdivided in the late 1970's,
lie south of the county road just east of this property. The existing filings contain 46 lots

which range in size from 0.36 of an acre to 0.82 of an acre with an average lot size of O.51
of an acre. This is the same density as the proposed subdivision. Riverbend Ranchettes
which is composed of three lots averaging 1.95 acres is located to the north and east of
Biverbend Subdivision.
Homeowners in Biverbend #5 will automatically become members of a new
Homeowner's Association which will be created for this subdivision. lt is intended that the
existing water and wastewater facilities now operated by RB Homes, lnc. will be transferred
to and managed by the Homeowner's Association. The Homeowner's Association will provide
additional services such as road maintenance, and maintenance of the open space. Protective
Covenants for the subdivision will address such issues as dog control, architectural control
and administration of the Homeowner's Association.
ACCESS
The access to this property is provided by County Road No. 335 from the New Castle
interchange with lnterstate 7O. This road is a two lane paved road which serves the existing
Riverbend Subdivision. The road dead ends immediately past that subdivision. Riverbend
Filing #5 will include a new interior loop road which will provide access to all lots in the
subdivision. This road will be constructed to the standards of a "Rural Access Road", and will
include two 1 1 foot lanes with 6 foot shoulders in a 50 foot wide right of way. The surface
will be chip and seal. No on street parking will be allowed.
UTILITIES
Domestic and lrriqation Water
Water for domestic and irrigation use will be provided by the same water system which
currently serves Riverbend Subdivision, Filings No. 1 and 2 and Riverbend Ranchettes. This
system is fed by Riverbend Wells No. 3 and 4 which were decreed in water court under Case
No. W-2125 on July 23, 1974. ln addition, three additional wells, Riverbend Wells 1,2 and
5, which were decreed in the same case, have been drilled and will be put into service as the
demand for water dictates. Each well has a decreed right of 0.67 cubic feet of water per
second. The decree provides for municipal use, including domestic, irrigation incidental
thereto and sewage treatment, recreation, fish and wildlife propagation and all other beneficial
purposes, including storage Jor each of the above purposes. Previous pump tests for these
wells have yielded 24O gallons per minute for Biverbend Well No.3 and 260 gallons per
rninute for Riverbend Well No. 5. Water usage requirements, as shown in Exhibit A, are well
below the capacity of these wells.
Water storage for Riverbend Subdivision in currently provided by a 30,000 gallon water
storage reservoir located on the hill above Filing No. 2atan elevation of 5960. This storage
will be augmented by the construction of an additional 30,000 gallon storage tank by RB
Water and Sewer Company. The size of this tank was recommended by the Burning Mountain
Fire Protection District and exceeds that needed for domestic use. The existing 6" water lines
within Riverbend Subdivision will be extended and looped through this subdivision to provide
service for the new lots. Fire hydrants are provided at spacings of less than 5OO feet as
required by the Burning Mountain Fire District.
Wastewater Treatment
Wastewater treatment for this subdivision is currently provided by RB Water and Sewer
Company. This facility will be transferred to the Homeowners Association under a separate
agreement. The existing treatment ponds are being relocated to an area closer to the river
and the facility is being upgraded in order to bring the system into compliance with current
Department of Health regulations. The new facility will consist of two aerated partial-mix
lagoons and a settlement basin and will provide secondary treatment to the wastewater. The
final effluent will be chlorinated and then discharged to the Colorado River. An application
for a discharge permit has been applied for and is being reviewed by the Colorado Department
of Health. The new system has been designed to accommodate the addition of an additional
21 units. The old treatment lagoons will be abandoned and reclaimed under criteria
established by the Colorado Department of Health.
It should be noted that the outflow from the new wastewater treatment plant will flow
into the river near the northeast corner of this property. The effluent from this plant will be
treated and then chlorinated prior to release according to standard practice and State Health
Department regulations. The changes which are currently being made to this wastewater
treatment facility are required to bring the plant into conformance with current State Health
Department regulations. lmpacts associated with this change should be associated with the
current development of Riverbend Subdivision, and are not created by the development of this
new property.
The wastewater treatment facility has sufficient capacity to handle the proposed 21
additional units. Based upon current information, there are approximately three persons per
dwelling unit in Riverbend. Using this occupancy, and 80 gpcd, equates to an average daily
flow of 240 GPD/unit. The 68 total units would have a total flow of 16320 GPD. This is
81.8o/o of the new capacity.
Transfer of Water and Wastewater Facilities
The water distribution system and wastewater treatment facilities currently serving the
existing Riverbend Subdivision will be extended to serve Riverbend Filing #5. Ownership of
these systems will be transferred pursuant to and coincident with the formation of a
Homeowners Association as governed under the Colorado Common lnterest Ownership Act.
Coincident with the above transfer of title, said Homeowners Association will assume the
obligations currently being performed by RB Water and Sewer Company to provide water and
sewer service to the homeowners in Riverbend Filings #1 and #2 and Riverbend Ranchettes.
The Homeowners Association for Riverbend Filing #5 shall be structured to enable owners in
Filings #1 and #2to join and, thus, obtain proprietary rights in the water and sewer system.
Documents to facilitate this transfer are currently being drafted.
Electric Service
Electric service for this area is currently provided by Public Service Company. An
existing overhead line is located along the north side of County Road No. 335. New service
will be installed underground from the existing overhead line to serve this subdivision.
Teleohone Service
Telephone service is provided by US West to this area. An existing line is located on
the south side of County Road No. 335, and has adequate capacity to serve this developrnent.
The new service will be extended underground using a joint trench agreement with Public
Service Company.
Natural Gas Service
Natural gas is not available in this area at this time, and there are no plans for
extending service in the near future. Homeowners in this subdivision can choose to use
propane to heat their homes through individual agreements with the gas company, or they can
choose to have all electric service in their homes.
Cable Television Service
TCI Cablevision provides cable service to residents in the New Castle area, but at this
time does not have cable service this far outside of town. The cost of extending cable for this
number of lots would be prohibitive, so it is unlikely that cable television service will be made
avaitable to this subdivision. However, newer techriology such as Primestar satellite systems
are available at a relatively low cost. This will probably be the option of choice for this
subdivision.
OPEN SPACE AND PARKLAND
Two areas of Open Space will be created on this property. The first and largest area
will be an area of 3.32 acres along the Colorado River. A 25' river access easement will be
dedicated to the public along the western side of the property to provide for public access to
the river for fishing and other recreational uses. The wastewater treatment facility for this
subdivision will be built on an easement within this Open Space area. Landscaped berms will
be built around the treatment ponds to screen them from the view of the adjoining lots. The
site will also be properly fenced to keep people and animals away from the treatment facilities.
The second area of Open Space will be in the middle of the subdivision so it can be
easily accessible to everyone who lives there. This area, approximately 0.64 of an acre in size
will be owned and maintained by the Homeowner's Association. Because of its central
location, it will function very well as a playground for small children or as
a playing field for the families who will live here.
ln addition to the Open Space being dedicated as a part of this filing, a school site has
already been dedicated. lmmediately across the County Road from this site is a ten acre parcel
which was dedicated to Garfield County as a school site when the first filings of Riverbend
were developed.
GEOLOGY AND SOILS
The soils on this site are Heldt clay loam on three to six percent slopes. The site was
evaluated by CTL/THOMPSON, lNC., Consulting Engineers during July, 1995. They believe
the site is suitable for residential construction. The dense to very dense silty gravels will
provide excellent support properties for the proposed roads and buildings. (See Preliminary
Geotechnical lnvestigation attached).
DRAINAGE
The new lots and roads will have minimalimpact on historic drainage patterns. Off-site
runoff from the south is collected by County Road 335 and diverted eastward into an existing
24" culvert. The outlet channel for this culvert, which currently flows through Lot g, will be
relocated within the County right-of-way for approximately 100 feet.
Drainage from the new roads and lots will be collected in roadside ditches which flow
to a 15" CMP at the low point. This culvert discharges into a grassed swale which will flow
eastward to the same natural drainage path as the 24" culvert. From there runoff will flow
to the Colorado River, which is only a few hundred feet away.
VEGETATION AND WILDLIFE
Vegetation on this property consists of native grasses and weeds. The only trees
within the property are some fairly large juniper trees located near the northeast corner of the
property. These trees range in size from six to twelve inches in diameter. Since these trees
are located in the open space area to the east of the proposed wastewater treatment facility,
they should not be impacted by this development.
This area is not an important habitat for wildlife. The Colorado Division of Wildlife GIS
files, 1993 indicate that critical habitat and severe winter range for elk is located on the
hillsides to the south and west of this property, and atso on the hillsides north of the Colorado
river. Although mule deer may be seen here, their critical habitat and severe winter range is
also located primarily on the hillsides to the west of this property.
Bald eagles and other raptors can be seen flying over this property occasionally.
However, because of the lack of large trees and other suitable nesting sites on this property,
it is unlikely that this development will disturb important habitat for these birds. ;

We have per{ormed a preliminary geotechnical investigation for the planned
Riverbend By The River development in Garfield County, Colorado. We believe this
propedy can be developed for residentialconstruction. This letter presents a description
of general site conditions, subsurface conditions found in our test pits and our opinions
from a geotechnicalviewpoint and map showing interpreted Soils Conservation Service
(SCS) soil type boundaries with a table of soils types. We understand that residential
buildings will be built and approximately 900 linear feet of road.
The subject site is approximately 10.6 acres located on a alluvial terrace above
and to the south of the Colorado River. Access to the site is from County Road 335 from
the New Castle/l-7O interchange which is approximately 2 miles to the west. The existing
Riverbend Subdivision is across County Road 335 to the southwest. Land to the south,
east and west has not been built on. Three excavated pits for a planned wastewater
treatment facility are on the property adjacent to the north with the Colorado River
beyond. Ground surfaces at the site slope down to the noilh at grades measured and
visually estimated at 2 to 6 percent. We were told an existing sewage disposal pond
approximately 360 feet by 160 feet in plan dimension that is on the central part of the site
is to be removed. Vegetation consists of native grasses and weeds.
Four (4) test pits were excavated at the locations shown on the attached Figure
1 to investigate subsudace conditions. Excavation was directed by our engineering
geologist who logged the soils and obtained samples. Our test pits TP-l through TP-3
penetrated a 0.5 foot layer of soft, organic, sandy clays underlain by stiff to very stiff, silty
to sandy clays. Our test pit TP-4 penetrated 1.0 foot of medium stiff, sandy clays with
scattered gravels and some roots and vegetation underlain by dense to very dense, silty

to sandy gravels. No free groundwater was found in our test pits during our field
investigation. Exposures of the Cretaceous aged Mancos Shale were obselved in the
riverbank north of the site at approximately elevation 5580 feet. Assuming a generally
horizontal bedrock surface, which is consistent with the geologic environment aithe site,
we believe bedrock will be encountered at a minimum depth of 20 feet below north parts
of the site and likely in excess of 40 feet below south parts of the property.
The dense to very dense silty gravels will provide excellent support properties for
the proposed roads and buildings. The stiff to very stiff, silty to sandy clays may be
expansive. Building foundations may need to be designed to resists potential swelling
of the clays. The removal of the existing sewage pond will resuh in fill being placed on
lots 10, 11, 15 and 16. We do not recommend founding buildings partially on fill and
partially on natural soils. Fill placed below foundations witl need to be moisture treated
and densely compacted if it is to be below new construction. A design level geotechnical
investigation will be needed to determine geotechnical criteria for building foundations
and road design.
SCS identifies the soils at the site as map unit 29 Heldt clay loam 3 to 6 percent
lbpe. lnterpreted SCS soils boundaries and a table of SCS soils types are shown on
Figure 1.

Dear Commissioners:
I am writing you in regards to the waste water facility presently under construction as well
as anticipated flows. I have attached a copy of the Colorado Department of Health
discharge permit issued for the Riverbend waste water treatment facility.
I have had discussions with Dwain Watson of the Colorado Department of Health in
regard to average density. They currently use 3.5 people per dwelling unit to estimate
flows. He mentioned there is current census information available suggesting this number
to be closer to 2.5 people per dwelling unit. Currently in Riverbend there are 135 people
living in 47 homes which equates to 2.872 people per dwelling unit.
Using this density at total build out of all 68 units, both existing and proposed , at 80
gallons per person per day equates to a total flow of 15624 gallons per day or
78 percent of permitted flow. There is an additional 5550 gallons per day designed into
the system. However, this additional volume would need to be reviewed and confirmed
by the Colorado Depariment of Health prior to exceeding the flows defined in the
current discharge permit.

significant upstream discharges to the Colorarlo River between smtion number 47 and the Riverbend

D. Biosolids Treatmcnt and Dbposal:
Since the treatmentfacility consbts of aerated lagoons, biosolids removal witt probabty be infrequent (once
every 5 to I0 years) and only take place if the ponds are drained and cleaned. If biosotids are removed
from the lagoons for any reason ihey must be tlisposed of in accordance with local, State and Federal
regulations.
E. Indwtrial Wasrc Management Requirements
Due to the lack of identfied industrial users in the se.rvicc arca, and thefact that the perminee does not

a. Thc name, address, and descriptive tocation of the facility aloug with an accompanying USGS map, or a
map of similar quality, u/hich shows the location of all unit processes;
b. The uame, address, and phone uumber of the owner and of the certified operator in responsiblc charge;
c. The name of water(s) receiving the dischargds) and a listing of any downstream wat€6 into which the
receiving stream flows within five miles of the point of discharge;

G) If, for any reason, the pcrmittee does not comply with or will be unable to comply with any
maximum discharge limiffiess, stadards or oonditions specified in this p€rmit,-the per6iuee shall,
at a minimum, provide the Water Quality Conhol Division and EPA with &e following information:
(l) A description ofthe discharge and cause ofnon- comptiance.
(2) The period of noncompliance, including cxact dates and times and/or thc anticipatcd time rryhen
the discharge will return to compliance; and
(3) Steps being taken to reduce, eliminate, and prevent rocurrcnce of the noncomplying discharge.
(ii) The following instances of noncompliance shall be reported orally within twenty-four O4) hours
from the time the permittee becomes aware of the circumstances, and 8 wriuen report naUed within
five ($ days of the time the permitee becomes aware of the circumstances.
(l) Any instaace of noncompliance which may en&nger human health or the envircnment,
regardless ofthe cause for the incident.
(2) Any unanticipatcd bypass, or auy upset or spill, which causes any permit limiation to be
violated.
(3) Any suspected significant discharges of toxic pollutants or hazardous substances, rvtich are
listed in Part m. of this permit, rcgardless of the cause for the incident.
(iii) The permiuee shall rcport all other instances of noncompliance, which are not required to be
reported within twenty-four @4) hours, at the time Discharge Monitoring Reports are submitted,
exc€pt as required in (iv) below. The reports shall contain the informatioh listed in
'Noncompliance Notifi cation' (paragraph (i) above).
(iv) If the permittee knows iu advance of the need for a bypass, it shall submit written notification to
the division of the need for such bypass at least ten days before the date of the contemplated
bypass.
c) Submission of lncorrect or Incomplete Information
Where rhe permicee becomes awarc that it failed to submit any rclevant facts in a permit application, or

Upsets
a) Effect of an Upset
An upset constitutes an affirmative defense to an astion bmught for noncompliance with technology$ased
permit effluent limitations if the requirements of paragraph (b) of this section are met. No determination
made during administrative review of "l"irs that-noncompliance was caused by upsel, and before an
action for noncompliaoce, is final administrative astiou subject to judicial review.
b) Conditions Necessary for a Demonstration of Upset
A permittec who wishes to establish the affirmative defensc of upset shall demonitratc through properly
signed contemporaneous operating logs, or other relevant evidence that:
(D An upset occurred and that the permittee can identify the specific cause(s) of the upset;
(ii) The permined facilfty was at the time being properly operated; and
(iii) The permittee submitted notice of the upset as required in Part I, Section C of this Prmit (24-hour
notice).
(iv) The permittee complied with any remedial mq$ures required under 40 CFR 122.7(d)'
c) Burden of proof
In any enforcement proceeding the permittee seeking to establish the occurrence of an upset has the burden
of proof.

For all domestic wastewater treatment works, the permittee shall dispose of sludgc in accordance with Statc andFederal regulations.
5. Minimizatioo of Adverse [moacts
Thc pcrmittcc shall takc all reasonable steps to Einimizc any advcrsc inpact to uratffs of thc Statc rcsultingfrcm noncomnliaagc with any effluent limitations specified ia this permit. As neccssary, acceleratcd oradditional monitoriug of the influent or effluent wili be required to determine thc naturc and impact ofuoncompliance.
6. Discharee point
Any discharge to the waters of the State from a point source other than specifically authorized herein isprohibited.
7. Insoections and Rieht to Entry
The permittee shall allow the Director of the State Water euality Control Division, the EpA RegionalAdministrator, and/or their authorized rcpresentatives, upon the presentation of credentials:
a) To enter upon the permittce's premises where a rcgulated facility or activity is located or in which anyrecords are required to be kept under lhe terms and conditions oi Uir permit;
b) At reasonable times to have acccss to inspect and copy any records required to be kept under the termsand conditions of this permit and to inspect aay monitoring equipment or monitoring method required inthe permit; and

As required by the Federal cleau water Act, effluent data shall not be cousidered confidential. Knowinglymaking any false state-ment on any su,ch rcport may result in rhe imposition of criminal penalties as provided forin section 309 of the Federar crean water Act, ani section 25-g-610 c.R.s.
10. Transfer of Ownership or Control
A permit may be transferred to a new permittee only upon the completiou of the foltowing:
a) The current permittee notifies the division in writing 30 days iu advance of the proposed transfer date;
b) The notice includes a written agreement between the existing and new permittees containing a specific datefor transfer of permit responsibility, coverage and liability benreen them; and
c) Fec rcquircments of the State Discharge Permit System Regulations, section 6.16.0 have been met.
11. Contract Reouirements
The perminee shall include pertinent terms and conditions of this permit in all contracts for receipt by thepermittee of auy effiuent not required to be received by the permittee.

(Oil and llazardous Substance Uability) of the Clean Water Act, except as recogdzed by federal law.
7. Property Rishts
The issuance of this permit does not convey any property or water rights in either real or personal proprty or
stream flow or any exclusive privileges, nor does it authorize any injury to private property, any invasion of
personal rights, nor auy infringement of Federal, State, or local laws or regrlations

(ii) Obtaining such certification by misrepresentation or failing to disclose any fact which is material to
the granting or denial of the certification or to the establishment of terms or conditions of the
certification; or
(iii) Materially false or inaccurate statements or information in the application for the permit; or
(iv) Toxic effluent standards or prohibitions (including any schedule of compliance specified in such
e_ffluent standard or prohibition) which arc established under Section 3f/lr1) of the Federal Clean
Water Act for a toxic pollutant which is present in the discharge and such standard or prohibition is
more stringent than any limitation for such pollutant in this permit.
b) This permit may be modified in whole or in part due to a change in any condition that requires either a
temporary or permaneot reduction or elimination of the permitted discharge, such as:
(i) The water quality staudards applicable to such waters; or
(ii) Effluent limitations or other applicable requirements pursuant to the State act or Federal
requirements; or
c) This permit may be modified in whole or in part to include any condition set fo(h in the approval of the
site location for the facility per Regulations for Site Applications for Domestic Wastewater Treatment
Works, 5 CCR IC{J,Z-L2,sections 2.2.0 througb 2.2.7.

9. Permit Renewal Aoolication
If the permittee desires to continue to discharge, a permit renewal applicatioa shall bc submitted at least one
hundred eighty (180) days before this permit expires. If the perminee anticipates there will be no discharge
after the expiration date of this permit, the divisiou must be promptly notified so that it can terminate the lermitin accordance with Part tI Section B.g.
10. Confidentialitv
Any information relating to any secret process, method of manufacture or productioD, or sales or marketing
data, which may be acquired, ascertained, or discovered, ufrether in any sampling investigation, emergency
investigation, or otherwise, shall not be publicly disclosed by any member, ofE""r, o, ".lloy". of the
commission or the division, but shall be kept confidential. Any person seeking to invoke the protection of this
Subsection (ll) shalt bear the burden of proving its applicability- This section shall never be interpreted aspreventing full disclosure of effluent data.
11. Fees
The permiuee is required to submit an annual fee as sa forth in the 1983 amendments to the Water eualityControl Act, Section 25-8-502 0) O), and State Discharge Permit Regulations sCCR \(r,Z-Z,Section 6.16.0 asamended' Failure to submit the required fee when due and payable is a violation of the permit and will result
in enforcement ection pursuant to Section 25-8-601 et. seq., C.R.S. 1973 as amended.

In derermining whether the faciliry is eligible for canifrcation under the general permit, the Division will
daermine f thefacility can naet the 25 mg/l linitfor total annonia. If the 25 mgll limit can be nut, the
permit writer will compare truruhly background conccntratians, above the dbcharge point, to the values
listed above and cenifrcation will be attowed where no actual monrtIy background values sceed rte
allowable background value. If there are one or nnre montls where the background concentration
exceeds the listed value, then the DivLsian will determine if the ditation ratio for that month b greater than
1N:1. If the ratio is greater than 100:1, then the Division will calculate the albwable background
concentration based on the actual ruio and compare thot value to the actual concentration. And, f the
calculated value is greater than the actual value, thefacility wiV be cmifiedfor coverage under the
general permit. Where there are no data that can be used to estabtish a background total orunonia
concentration above the dischuge point, the Division will norrnatty assun'E a background concentration of
