PRACflCAL LOCATION: The site is located approximately 5 miles north of the town of Silt
at 3919 County Road 237, immediately adjacent to the Harvey Gap State Park. lt is
generally located in Section 16, T5S, R91W.
TYPE OF APPLIGATION: Minor Subdivision
ZONING: Rural (R)
I. GENERAL PROJECT DESCRIPTION
The Applicant owns approximately 35 acres of property and desires to subdivide it into 2
lots. The proposal is to create a new 5 acre parcel at the northwest corner of the property
adjacent to the County Road. The remaining lot would be approximately 30 acres and
would contain the existing single family residence. A new domestic well and new onsite
waste water treatment system (OWTS) would serve the new lot and its' access would be a
private drive directly off of Gounty Road 237. The remainder lot and existing residence is
served by an existing well, existing OWTS, and existing access driveway.
The Applicant has contacted the Division of Water Resources to assess options for a legal
supply of water for the new lot, The Applicant anticipates contracting with the West Divide
Water Conservancy in order to obtain the well permit for the new lot. While the Applicant's
existing well has historically had good production the discussion included difficulties for
surrounding properties to develop adequate wells. Well pump tests and water quality tests
will be required for both lots. Submittal waivers may be requested to delay the testing to
occur as a condition of aPProval.
Submittal requircments, prooessing procedures, and Article 7 standards were all disoussed.
The potential for weiver requests was covered along with the need to address the waiver
criteria and include technical support for the request.
COMPREHENSIVE PLAN . ZONING
The property is designated Residential Medium High (R-MH) with a density
recommendation of 2 - < 6 acres per dwelling unit. The Application should address the
proposals compliance with the density recommendation.
III. REGULATORY PROVISIONS APPLICANT IS REQUIRED TO ADDRESS
The following Sections of the Garfield Land Use and Development Code are applicable to
the proposed application:

each section of Article 7 is recommended.
Referral to the Colorado Geological Survey is also required with an additional
referralfee.

V. REVIEW PROCESS
The review process shall follow the steps contained in Table 5-103 and Section 4-103 for

Mineral lnterest Research
Mineral interests may be scvered from surface right interests in real property, Colorado revised
stah¡lc 24-65.5-103 requires notification to mineral o\rynes wùen a landowner applies for a land
use designation by a local goveíimÉnl. As such, tlæ landowner must research the cunent owr¡e¡T
of mineral interests for the property.
Thc Garfield County Land Use and Development Code of 2013 ('LUDC') Sestion 4-
l0l(EXlXbX4) requires w¡itten notice to orvners of mineral interests in the subject property "as
such owners can be identifìed through lhe records in the ofüce of the Clerk a¡rd Recorder or
Assessor, or through other means."
It is the duty of the applicant fo noti$ mincral inlcrest orvners. The following is a suggested
process to research mineral inte¡ests:
Review thc current ownership deed for fte propcrty (i,e. Warranty Deed, Spccial
Wan'anqr, Quit Claim Deed or Bargain and Sale Deed-NOT a Deed of Trus$. The
ownership deed is usually one or lwo pages. [s there a reservation of mineral interests on
the ownenhip deed? Are there any exceptions to title? A deed may include a list of
rescrvations that reference mineral owners or oil and gos leases.
2. Review your title insura¡lce policy. A¡e there exceptions lo litle listed under Schcdule B-
II? lf so, review for mineral interests fhat were rescrved a¡rd oil and gas leases.
3. Check witt¡ the Asscssor's office to determine if a mineral interest has been reserued
fiom the subjecl property, The Assessor's ofüce no longer documcnls the mineral
rcservalion ownership for ils tax roll records unless ownership has been proven, Therr
are only a limiled number of mineral owners who have provided sueh information to the
Asæssor's office so this may not provide any information, depending on your property.

compuler. You can search fhe Section, Torvnship, and Rangc of the subject property.
You may find deeds for mineral interests for the subject properfy.

side of the screen), Ceneral Recordings, Notice of Mineral Estare Ownership for the

insurance policy, from the Assessor's records or the Clerk and Rccorde¡'s computer, you
need lo determine whether these mineral intercsts li'ere trans!þrred by deed and recordcd
in the Clerk and Recorder's office.
7. Entcr the name of the mineral interest owner as the Grantor in ths Clerk and Recorder's
computer to see if the mineral iltteresl was transfened. If you find a transfer deed, you
need lo repeat this process 1o follorv any transfer of the mineral interest to present day.

Mineral intcrest ¡esearch can be a diffìcult a¡d time consuming process. If you are unabte to
determine mineral righls ownership by yourself, consider hiring an âflomey or landman.
Attorneys and landmen specialize in determining mineral riglrts ornership, but they charge a fee
for their services.

proposed project, it is not possible at this time to ascertain the fullextent of the costs
involved in processing the application. The Applicant agrees to make payment of the Base

ThisfiveAcerparcelislocatedinanareaofSiltthatisnotoriousfordrillingdrywells. TheRoberts
subdivision located behind our land has approximately nine homes that rely on cisterns for their water
source. Out of these nine homes, our section and our neighbor to the south are the only ones who have
wells.
The cost to have a well drilled around the same depth as the one we have starts at approximately
twenty thousand dollars. Very expensive for a possible dry hole.
lf this is not acceptable and a waiver is not possible we have allthe steps in place to drill a well

The Land Use Change shall comply with Article 3, Zoning, including any applicable zone district
use restrictions and regulations.

The Land Use Change is in general conformance with the Garfield County Comprehensive Plan
and complies with any applicable intergovernmental agreement.
7-103. COMPATIBILITY.
The nature, scale, and intensity of the proposed use are compatible with adjacent land uses.
7-tء4. SOURCE OF WATER.

The water situation around Harvey Gap can be a challenge. ln the Roberts subdivision behind us there are I
homes. None of these houses have a well. They use a cistern system for their water needs.
Our parcel and our neighbor to the south are the only ones that have a well. We have been using our existing
well for over 15 years.
ïhe depth of our well is 100 feet, and it sits just off the Harvey Gap road across from the lake. ln extra dry
summers, not every summer, the lake levels can drop lower than the depth of our well.
This causes our well to drain back into the lake. When this happens we haul water from town, to fill our cistern
until the lake levels raise back up and our well starts producing again.
The water quality of our well is adequate for most of our needs. We use it for all our house and yard needs. We
do not drink the well water, it has a bitter taste, but choose to purchase bottled water instead. We don't have a
water softener or a reverse osmoses system for our home as of yet. We have lived in the country for 30 years,
and well water is just something you learn to manage, one of the perks of living ln the country.
lf we are required to drill a well on the new 5 acre parcel, water quantity and quality test will be conducted by the
well drilling company. Poor water quality can always be improved with a home filter system, whether it be a
reverse osmoses system or a water softener system.

lssuance of e permit it is important that complete information be provided. Adequate and complete
information will prevent delays in the plan rev¡ew process. Reviewing a plan and the discovery that
required information has not been provided by the applicanf may result in the delay of the permit
issuence and in proceeding with building construction. The orrrner or contractor may be required to
