of the enclosed plat due to relocation of a short portion of
Riverbend Drive, east of Gleneagle Circl-e'
During prel-iminary work on the road a l-arge quantity of dense
rock was encountered at the cut South of Tibbits Point' In order
to achieve the allowable grades and avoid expensive bl-asting it
was decided to shift the road south and move Lots 1- and 2, Bloek
3 to the north side. Both Lots are buildable with a good southern
exposure. The original number of lots remains at 29 and no l-ots
wilf be sold until the amended plat is recorded according to
Mr. Cunningham, and his subdividerrs agreement'

(g) For the purposes of this Stipulation, Stewart Title Insurance
Company of Glenwood Springs sha11 be named as the Escrow Agent and Dean
Gordon of Schmueser and Associates shal1 be named as the Engineer. Any
succesaor Escrow Agent or Engineer sha11 be rnutually agreeable to the
Homeowners and Cunningham and in the event of dispute over the identity of
such successor, the Court shal1 select same.
(h) The improvements specified herein will be ph;"sicalIy adequate, if
constructed in a workmanlike manner, to service only Filing No' 1 (17
single family lots) and 29 single family lots in Filing No. 2' Prior to
any further servj-ce of any kind, the system will require physical upgrading
in accordance with accepted engineering standards.
(i) Any funds deposited or held by the Escrow Agent shall be placed
in federally insured, interest bearing certificates of deposit in a bank
selected by the Escrow Agent.
2. On or before }lay 18, 1984, Cunningham sha11 deposit into escros/
$4,190.00 with Escrow Agent to be utilized for acconpiishment of the items
and services set forth in subparagraphs (a) - (j), inclusive. Draws on
said escrow account shal1 be made so1ely by written certification of
completion by the Engineer.
(a) The concrete foundation beneath the water treatment building
sha11 be enlarged to the r+idth and length dimensions of said building;
(b) The pipe opening in the wa11 of the vault sha11 be sealed;
(c) An adequate chlorine leak test kit sha11 be provided at the water
treatnent building;
(d) An adequate canister for the chlorine gas mask sha1l be provided
at the water treatment building;
(e) An adequate strainer on the chlorine injection line sha11 be
provided;
(f) The electrical disconnect switch in the r.+ater treatnent building
shaLl be relocated so as to meet relevant code standardsl
(g) The electrical control line running between the water treatment
building and the water storage tank shal1 be buried along its entire
length;
(h) Iiater valve boxes in Filing No. 2 shal1 be brought to itre grade
of the existing paved roadwaY;
(i) Ilanhole No. l, being the last rnanhole in the roaciway of the
County Road prior to the treatmeltt ce11s, together with the outlet !riPinq
attached thereto, shall be repaired so that the outlet pipe is belor'' the
grade of the inlet pipe of saicl nanhole and the outlet pipe has a satisfac-
tory slope ar+?ay from said manhole; and
(j) An adequate system of

plated herein will take place prior to the issuarrce of a building permit
