Pa¡cel A for the use, operation, maintenance, repair, and replacement of a septic rystem in the

Ease,ment'), and as set forth by meûes and bormds in üe Legal Description - Septic Easoment,

Easemqrt Grantor shafihavethe rigbtto r¡sethe Septic Easeme¡rt in any and all ways that do
not interfere wiú Gra¡tee's enerciso ofthe Se,ptic Easement
4. Reveeetation. Grant€e, at G¡antee's sole expe,nse, shall re-vegetaúe any part of
the Septic Easement excavated by replanting the excavated area with like and similar vegetation.
5. AuthoritvlBindinq Effect Covenant Runnins wift the La¡rd. Each pemon signing
this Agreement repres€nts and warrants he or she is frrlly authorized ûo enter inûo and execute this
Agreement and legally bínd the party he or she represents to the terms and conditions herein.
This Agreement shall be a covenant running with the Property and the rights and obligæions as
contained herein shall bc bindine upon and inr¡re to fte be¡refit of the parties and their heirs,
suc¡cessors and assigns.
6. Se-verability. If any covenant term, condition orprovision contained in this
Agreement is held by a court of competentjurisdictionto bc invalid' illegel' orwrenforceable in
any respec! such covenan! terrl, condition orprovision shall be severed ormodified to the
e:rteirt nec€ssary to make itenforceable, andthe resulting Agree'ment shall remain in full force
andeffect.
7. Cgunterparts. This Grant of Easement may be executed through the use of
separat€ signature pages or in any number ofcounterparts, and each ofsuch counterparts shall,
foi atl purposes, constítr¡æ one blnding Grant of Easement, notwithstanding that all parties are
not signatories to the same cornrterpart
8. Recordation. This Agreement shäll bÕ tËÖüdêd by the CrrantıÉ in the Office of
the Garfield Coun8 Clerk and Recorder. .'r'
g. Amendments. NO ptovislon of this Agrternent may Ûe amended, modifïe{
supplemenûed, changed, waived, discharged or terminate{ except by an instrument in uriting
signø by all parties to this Agreement This provision conce,rning amendments or modifications
e¿nnot bc w¿ive¡| èxoëpt by a witæn documant signed by atl parties to this Agreement which
expressly states that it is an amendment to this Agreement.
