We wish to move the northwest edge of the building envelope out to the edge of the utility easement that is located 20 feet from the northwest property line. Building envelopes in the Midland Point Subdivision are required to be a minimum of 10 feet from property lines. There is a 20 foot utility easement along the northwest property line of Lot M-22. The building envelope currently begins 10 feet from this easement. We have spoken to the engineer of the project at Schmueser Gordon Meyer Consulting Engineers. He found no reason that the building envelope should be located 10 feet from the easement, and explained that it must have been drawn arbitrarily. This became readily apparent when looking at the recorded plat. Lot M-20 of the same subdivision also has a 20 foot utility easement. There is no set back from this easement for the building envelope of Lot M-20. Enclosed please find an Amended Plat Application, a copy of the Plat of the property, a letter from the Midland Point Design Review Committee approving the building envelope extension, and a check for $140.00.
