My testimony on December 4 was that I believed the Broadcast FM Translators proposed to be installed on the tower in question could be installed on a nearby tower which Colorado West Broadcasting owns. After significant discussion, I offered to retract my objection to the Land Use Change if I was convinced otherwise by MBC Grand Engineer, Vala Berry. When I spoke with Ms. Berry, she pointed out something that I had not considered up to that point, which I will attempt to communicate to you in this letter. First, it is important to explain the difference between primary stations and translators. A primary station is the station that originates programming. A translator broadcasts that same signal on a different frequency than the primary station. There are two types of FM Translators, Fill -In and Non -Fill -In. A majority of the translators proposed by the applicant, which I referenced in my testimony on December 4 are Non - Fill -In Translators. (Specifically, K262CB, K271 BA and K276A1.) The reason these are Non -Fill -In Translators is because they are outside the main coverage area of the primary stations (referred to as the 60dBu contour, a standardized theoretical measurement of the signal strength of an FM station). As you can read in my attachment from the FCC, there are two very specific rules that apply to Non -Fill -In Translators; They must be fed "over the air." (That is, they must receive their signal from an FM signal or from a primary AM station.) And, they cannot be owned and operated by the Licensee of the primary station. It is the former requirement that I had not considered when I prepared my testimony for the December 4 meeting. Due to the distance from the primary transmitting location in Grand Junction, it will be difficult under any circumstance to receive the signal over the air. Other than distance, one of the biggest impacts to a received FM signal is a strong transmitted signal nearby. FM translators by their very definition create this type of interference because they are transmitting a strong signal very near the signal that is being received. The most effective way to mitigate this interference is to separate the receive and transmit antennas. While there is no formula to determine the minimum separation required between transmit and receive antennas in order to receive a clean over the air signal, I believe that MBC Grand's assessment is correct; our 52 -foot tower on Grass Mesa would not provide enough vertical separation, especially if they intend to increase their power further from what has already been applied for. I could not locate additional filings by MBC Grand, or Professional Antenna, Tower and Translator Service (the actual licensee of the translators I mention above). Finally, I do not take sworn testimony lightly. It is very important to me that it be known that my testimony on December 4 was given in good faith and was, based on my knowledge and belief at the time and to that end, I have provided a number of documents which back up that position. Without the additional knowledge and understanding of what a "Non -Fill -In Translator" is, I am hopeful that you can understand why I would come to the conclusions I did initially and then later withdraw the objection. Sincerely, abe Chenoweth President Non -Fill -In Translators The majority of FM translator stations fall into this category. Service contour requirements. The service contour for a non -fill-in translator station may extend outside the primary station's service contour or, in some cases, lie wholly outside it. Ownership and financial support. In general, commercial primary stations and anyone associated with a commercial primary station may neither own nor provide direct or indirect support to non -fill-in translator stations, both before and after the translator commences operation. See 47 CFR Section 74.1232(d). However, in order to facilitate service to white (or unserved) areas, the Commission is favorably disposed toward waiver of this rule to permit a commercial primary station to support its own translator, or an independently owned translator, which provides service to these unserved areas. The primary commercial FM station may provide "technical support" to the independent translator station, which is defined as: actual services provided by the primary station's technical staff or compensation for the time and services provided by independent engineering personnel. Such support does not include the supply of equipment or direct funding for the translator's discretionary use. We also reiterate that technical assistance by the primary station should occur after the issuance of the translator's construction permit or license in order to meet expenses incurred by installing, repairing, or making adjustments to equipment. For the purposes of translator station applications, "white area" is defined as any area outside the coverage area of any full service aural service (AM as well as FM). Paragraph 23, Report and Order in Docket 88-140, 5 FCC Rcd at 7216 (1990). Where a translator provides both fill-in service and white area service, the procedures applicable to "white area" service should be followed. A showing of the "white area" must be presented in the application with a request for waiver of the ownership requirement. When locating the "white area" boundaries, the service contours for FM stations shall be predicted using the standard method in 47 CFR Section 73.313. If a non -fill-in translator is independently owned, the owner must secure the written permission of the primary station to rebroadcast its programming before commencing operation. This is a statutory requirement. See 47 CFR Section 74.1284(b); see also 47 U.S.C. Section 325(a) and Footnote 52 of the Report and Order in MM Docket 88-140, 5 FCC Rcd 7212, 7245 (1990). Signal delivery. Non -fill-in translators relaying commercial FM stations must receive the signal off the air, unless a waiver has been granted to feed a "white area" translator by other terrestrial means. A showing of the "white area" must be presented in the application for construction permit, requesting waiver of the signal delivery requirement. Noncommercial educational non -fill-in translators operating on Channels 201 through 220 that are owned by the licensee of the primary noncommercial educational FM translator station may use alternate means to receive the primary FM station's signal. Non -fill-in noncommercial educational translators on Channels 221 through 300 are prohibited from any alternative methods of signal delivery, including programming feeds by satellite. Special note for commercial non -fill-in translator stations: The Commission may terminate the operation of a non -fill-in translator station at any time if the circumstances in the community or area have changed such that its application would have been denied if those circumstances had existed at the time of its filing. The notice of termination, when issued, will list a date at least 60 days from the notice date by which operations must be terminated. That information is being provided to the public record for consideration. BACKGROUND: The Board is considering Land Use Change Permit - Limited Impact Review for a Telecommunication Facility – David and Roslyn Hatch. That application was continued from the December4, 2017 meeting. DISCUSSION: An inventory of existing telecommunication towers exists as a component of the Joint Garfield County/Mesa County Broadband Needs Assessment Study and is being provided as additional information to the Board of County Commissioners. On the attached information, the towers are numbered 1 through 45. The towers in the Rifle vicinity are towers 13 through 23C. RECOMMENDATION: There is no recommendation, this information is being introduced as an additional exhibit for the public record. ACTION REQUIRED: This item is for informational purposes only. Spreadsheet Description of Towers 1 through 45 Section 6: Wireless Tower Assessments and Plan A Wireless Tower Assessment, Radio Frequency Wireless Plan and Analysis was conducted by NEO and its consultants for Garfield County. Mesa County and the City of Grand Junction conducted a separate wireless tower assessment and plan. The Mesa County/Grand Junction plan can be found at http://www.gjcity.org/business-and-economic-development/wireless- master-plan/. This plan ("Wireless Plan") is intended to be used as a general planning tool for consideration for wireless broadband deployment in Garfield County. For purposes of this Wireless Plan, a base station and tower are defined as follows: Base Station - Equipment and non -tower supporting structure at a fixed location that enables wireless telecommunications between user equipment and a communications network. Examples include transmission equipment mounted on a rooftop, water tank, silo or other above ground structure other than a tower. The term does not encompass a tower as defined herein or any equipment associated with a tower. "Base Station" includes, but is not limited to: • Any structure other than a tower that supports or houses radio transceivers, antennas, coaxial or fiber optic cable, regular and back-up power supplies, and comparable equipment, regardless of technological configuration; and • Equipment associated with wireless telecommunications services such as private, broadcast, and public safety services, as well as unlicensed wireless services and fixed wireless services such as microwave backhaul and broadband. Tower- Any support structure built for the primary purpose of supporting antennas and associated facilities for commercial, private, broadcast, microwave, broadband, public, public safety, licensed or unlicensed, and/or fixed or wireless services. A tower may be concealed or non -concealed. Non -concealed towers include: • Guyed - A style of tower consisting of a single truss assembly composed of sections with bracing incorporated. The sections are attached to each other, and the assembly is attached to a foundation and supported by a series of wires that are connected to anchors placed in the ground or on a building. • Lattice - A self-supporting tapered style of tower that consists of vertical and horizontal supports with multiple legs and cross bracing, and metal crossed strips or bars to support antennas. This type of tower is designed to support itself without the use of guy wires or other stabilization devices. 42 • Monopole - A style of freestanding tower consisting of a single shaft usually composed of two (2) or more hollow sections that are in turn attached to a foundation. This type of tower is designed to support itself without the use of guy wires or other stabilization devices. These facilities are mounted to a foundation that rests on or in the ground or on a building's roof. All feed lines shall be installed within the shaft of the structure. This analysis began by identifying and assessing existing towers and base stations used for wireless communications including, but not limited to: public safety, microwave, personal wireless service facilities (PWSF), broadband and broadcast facilities. Visiting all known and accessible towers and base stations aids in data collection regarding ownership, equipment and use of the facility by owners and tenants. Theoretical propagation maps based on the assessment data are developed to identify gaps in wireless broadband coverage and solutions are provided to address these coverage gaps. This analysis serves as an illustrative planning tool and guide for developing broadband deployment policies for future infrastructure and identifies county -owned and other public properties that can be part of network deployment solutions for providing wireless broadband. This analysis can help establish policy for minimizing the future number of telecommunication facilities while maximizing network coverage objectives from as few new sites as possible. Existing Wireless Facility Locations Some of the towers within Garfield and Mesa Counties are located on Bureau of Land Management (BLM) or on Forest Service land. Service providers who responded to the Request for Information indicated wanting to use these towers to expand their services. The application process to use towers on Forest Service land is often a 3- to 5 -year process and therefore, is often seen as an obstacle in improving broadband services. Having the elected officials and County staff meet with local Forest Service representatives to streamline this process could help the existing providers expand their wireless reach. Many of the service providers stated they would upgrade their wireless equipment to accommodate higher broadband speeds. CityScape assessed all known wireless communication facilities which consisted of existing tower and base station locations throughout the County to identify the following: 1) location of existing telecommunications facilities currently within and just outside the County; 2) existing tenants on the towers and base stations; and 3) availability of potential collocations on the existing structures. 43 The wireless infrastructure assessment process identified forty-five (45) existing wireless telecommunication sites with a total of seventy-eight (78) towers and base stations within the County. Eight (8) of the sites contain multiple towers which is why the number of facilities exceeds the total number of sites. CityScape was unable to access nine (9) locations due to locked gates, private property restrictions, or inadequate weather conditions and therefore some structures do not have site specific photos. Four (4) of the nine (9) locations have multiple towers at the site which could be seen from either the road or aerial photography. Twenty (20) of the facilities assessed have no identification of ownership or emergency contact information posted on the infrastructure making identification of ownership and tenants arduous. CityScape recommends contacting the local Bureau of Land Management and United States Forest Service offices to inquire about these towers since most of the unidentified towers are on those properties. Table 1 provides a summary of the total number of types of antenna mounting structures found throughout the County as of November 18, 2016. Table 2 summarizes the known height of the infrastructure. Separate companies typically construct and own the monopole, lattice or guyed tower and market that tower for lease space to the service providers. A service provider may also contract with a tower owner to obtain approval to construct a tower in a particular location and once the facility is constructed the service provider will then lease space from the tower owner on the newly constructed tower. There are currently four primary tower companies in the County who own and lease vertical real estate to the service providers: American Tower Corporation, Crown Castle International, SBA Communications Corporation and Vertical Bridge. Table 3 identifies the ownership of the infrastructure at the sites. The total number of sites listed is eighty (80), two (2) more that the seventy-eight (78) total facility locations because while CityScape was unable to access some of the sites the research indicated ownership of the towers and some of those locations have multiple towers. For example, Site number 25 could not be accessed, however research indicates that Garfield County and SBA each have towers at that location.
