APPLICATION FOR BASIC CORRECTION EXEMPTION
RESPONSE TO SECTION 5.204 (C) - REVIEW CRITERIA
5.204.C. Review Criteria.
1. The proposed land use is generally in compliance with the requirements of the applicable zone
district and the code. Single family residential is a permitted use within the Rural Zone District.
2. The single family residential proposed land use is generally in conformance with the
Comprehensive Plan.
3. The application will not change the existing character of the development.
4. The application will not alter the basic relationship of the development to adjacent property.
5. The application demonstrates that extraordinary and exceptional special circumstances or
conditions exist that are unique to the Applicants properties. (See Section 1.C.)
6. The special circumstances and conditions have not directly resulted from any act of the
Applicants. (See Section 1.C.)
7. The strict application of the regulation would result in peculiar and exceptional, practical
difficulties to, or exceptional and undue hardship on, the owners of the properties. (See Section 1.C.)
8. The Basic Correction Exemption is necessary to relieve the owners of the peculiar and
exceptional, practical difficulties or exceptional and undue hardship. (See Section 1.C.)
9. Granting the application will not cause substantial detriment to the public good.
10. Granting the application will not substantially impair the intent and purpose of this Code.
11. The application presents evidence of a legal, physical, adequate and dependable water supply
for each lot. (See Section 3)
12. The application presents evidence of legal and adequate access. (See Section 11)
13. All identifiable hazards have been mitigated, to the extent practicable.
14. The application presents evidence of a legal, physical, adequate and dependable water supply
for each lot. Septic permits have been issued and the systems have been operational for decades. (See Section
3)
15. The Applicants understand that the BOCC may include conditions of approval or plat notes
to address limitations associated with Article 7 Standards including provision of adequate water.
16. The Final Plat for this application meets all the requirements per section 5.402.F.
