the Commissioners' Meetiñg Room at the Garfieltl County Plaza Building, 108 8th Süeet, in
Glenwood Springs, Colorado, on Wednesday, the 26rh day of September,20l8, there were

A RESOLUTION CONCERNED WTTH A LOCATION AND EXTENT APPLICATION FOR
THE MID VALLEY METROPOLITAN DISTRICT DAKOTA RANCH LIFT STATTON
REPLACEMENT
(FILË, NO. LAEA-05-1 8-865 l)
Recitals
A. Garfield County is a legal and political subdivision of the State of Colorado for which the
Board of County Commissioners is authorized to act.
B. Pursuant to law, the Board of County Commissioners of Garfield County has appointed
the Garfield County Planning Commission (the Commission)'
C. Mid Valley Metropolitan District (the Applicant) on behalf of Dakota Meadows
Homeowners Association (the Parcel Owner) applied to the Planning Commission pursuant to File
No. LAEA-05-18-8651 fora Location and Extent Review for the replacement of the Dakota Ranch
Lift Station.
D. The proposed replacement is necessary to provide the District with a facility that can
continue to servè the community for the District's 20-year planning horizon. The parcel is located
on Tract A of the Dakota Subdivision, approximately 5 miles east of the Town of Carbondale on
a parcel approximately 7.361 acres in size.

E. pursuant to Section 4-lll (C) of the Garfield County Land Use and Development Code,
as amended, ancl c.R.s. $ 30-2g-110(1Xa) the Commission is required to review the location and
extent of tho proposed lift station re¡lacement to determine whether the proposed facility is in
general ounfo.*ànce with the County's Comprehensive Plan of 2030, as amentlecl (the
Comprehensive Plan) and its Master Plan.
F. In accordancc with statc law, the Planning Commission has adopted a Master Plan. The
Master Plan applicable to this Petition is the comprehensive Plan.
G. The Commission opened a public hearing on September 26,2018 upon the question of
whether the proposal is in general conformance with the Comprehensive Plan'
H. The Commission closed the public hearing on September 26,2018 to make a decision on
the request.
I. The Commission, on the basis of substantial compctent evidence produced at the
aforementioned hearing, has made the following determinations of fact:
l. That proper public notice was provided as required for the hearing before the Planning
Commission.
2. That the hearing before the Planning Commission was extensive and complete, that all
pertinent facts,
-matters and issues were submitted or could be submitted and that all
interested parties were heard at that hearing'
3. That for the above stated and other reasons, approval of the Location & Extent request by
Mid Valley Metropolitan District is in the best interest of the health, safety, and welfare of
the citizens of Garfield CountY.
4. That the Location and Extent request has been determined to be in general conformance
with the Comprehensive Plan 2030, as amended'
5. That the Location and Extent request is in conformance with the Review Criteria contained
in Section A-tll,Location and Extent of the Garfield County Land Use and Development
Code, as amended'
6. The determination of General Conformance is based on the Applicant's representations in
their Application submittals and at the public hearing before the Planning Commission.
RESOLUTION
NO\ry, THEREFORE, BE IT RESOLVED by the Planning Commissionof Garfield County, as
follows:
A. The foregoing Recitals are incorporated by this reference as part of the resolution.

Exhibit ,.4,' describes the site plan and location of the proposed lift station
C. The Location and Extent requcst for the replacement of the Dakota Ranch Lift
Station Replacement is hereby approved subject to the following conditions of approval:
l. That all representations made hy the Applicant in the Application shall be
conditions åf approval unless specifically altered by the conditions of approval
contained herein.
2. That the Applicant shall obtain all required permits from the State of Colorado and
,o',,pty *iit all applicable requiremgnts of Colorado Department of Public Health
and Eîviro*"rri including all relevant plans for emergency operations and
response.
3. That the lift station shall be operated and maintained in accordance with all
applicable Federal, State and local regulations goveming the operation of the
sPecific tYPe of facilities'
