HomeMy WebLinkAbout2.0 TC Letter 09.04.2018� Garfield County Community Development Department September 4, 2018 Barbara Clifton, Esq. 127 E. 5th Street Rifle, CO 81650 RE: Completeness Review Wilks Subdivision Exemption Parcel A Final Amended Plat (FPAA-08-18-8672) Dear Ms. Clifton, Thank you for the additional submittals to address the completeness items associated with your Final Amended Plat application. This letter is to inform you that your application has been deemed Technically Complete. Please understand that a determination of technical completeness shall not be viewed as a recommendation of approval, finding of an adequate application, or a finding of general compliance with any goal or objective of the Land Use and Development Code or the Garfield County Comprehensive Plan 2030. A date has been set for issuance of the Director's Determination on Thursday, October 4, 2018. Within 10 days of this date, a Determination will be issued to approve, approve with conditions or deny the application. Public notice at least 15 days prior to the Director's Decision is required by written notice by certified mail, to the owners of record of all property adjacent to the subject parcel and within 200 ft. Public notice at least 15 days prior to the Director's Decision is also required by written notice by certified mail with return receipt requested to the mineral owners of record for the Applicant's property. The Applicant shall be solely responsible for the mailing of the notice. You must provide both a completed Public Hearing Notice Information Form (as appropriate for the application) and proof of mailing prior to the Director's Determination on the application (green and white USPS stamped and completed mail receipts). Pursuant to Section 4-103(6)(3) of the Land Use and Development Code, the notice shall include a vicinity map, the property's legal description, a short narrative describing the current zoning and the Applicant's proposal, the contact information for the Community Development Department and the date 108 Eighth Street, Suite 401 Glenwood Springs, Colorado 81601 (970) 945-8212 that the Director will make a decision. Written Notice is required to be sent by certified mail for property owners within 200 feet of the parcel and by certified mail return receipt requested to mineral owners. Enclosed is an appropriate public notice for your convenience. This document is provided to you as a courtesy and the Applicant must verify that all information in the notice is correct and attached including the legal description and vicinity map. It shall be the obligation of the Applicant to correct any deficiencies in the public notice such that proper notice in form and substance can be established. Included for your convenience is an outline of the process from this point. 1. The Director's Decision is set for October 4, 2018. Within 10 days of this date, the Director of The Community Development Department will render a Decision to approve, approve with conditions, or deny the application. 2. Public Notice to adjacent property owners and mineral interests must be sent at least 15 days prior to the decision date. 3. Applicant will provide a completed Public Notice Information Form along with the proof of mailing and return receipts prior to the Director's Decision. 4. Within 10 days of Thursday, October 4, 2018 the Director will issue the determination and notify both the Applicant and the Board of County Commissioners (BOCC) of the determination. The BOCC, the Director, the Applicant or any affected Adjacent Property Owner has 10 days to review the Director's Decision and determine if the application should be called -up for a public hearing in front of the BOCC. Such a call-up is governed by Section 4-112 of the Land Use and Development Code. 5. If the call up time period expires without a request for a hearing from the Board, the Applicant, the Community Development Director, or an adjacent property owner, the decision will become final. 6. The Applicant shall have one 90 days to satisfy any conditions of approval. Please note that as part of the Application review process some items may still require additional information, staff discussion or conditions of approval, in particular where waivers are being requested.
