public notice and scheduling. Please review the public notice form for accuracy prior to sending it out. lt will need to be
sent out no later than January 11th. The Attached Public Notice lnformation Form will need to be completed and
returned to the County with your mailing receipts.
The Director's Decision is scheduled for January 26th . I will continue to keep the Building Department up to date on

I. DESCRIPTION OF PROPOSAL. REQUEST
The Applicant is requesting an amended final plat to amend the building envelope on the
lot to return the envelope configuration to the originally platted envelope. The amendment
is necessary to address technical errors associated with improvement location surveys
completed iñ preparation for the design of a new home on the lot. No other changes are
being requested.
II. AUTHORITY . APPLICABLE REGULATIONS
The Amended Final Plat Application is being processed in accordance with Section 5-305,
Amended Final Plat and 4-103, Administrative Review of the Land Use and Development
Code. An excerpt from Section 5-305 (C) containing the Review Criteria for an Amended

An application for an Amended Final Plat shall meet the following criteria:

101 and Table 5-103 and has been completed by the Applicants.

III. STAFF ANALYSIS
1. The Application complies with the Review Criteria contained in Section 5-305 (C)
noted as follows.
o The Application will not result in an increase in the number of lots.
o The Application will not result in the relocation of any major roads and does
not add any new roads.
. The proposed plat amendment will return the building envelope to the
original configuration and will address technical issues with surveying done in
anticipation of a building permit application and current construction on the
property.
2. No changes to the infrastructure or easements serving the property or adjacent lots
within the subdivision will result. All easements will be required to be shown on the plat
and referenced by recording information.
3. The proposed amendment is consistent with current construction on the property
and will bring the property into compliance with building envelope requirements associated
with the PUD.
PUBLIC & REFERRAL COMMENTS
4. public Notice as required by the County Land Use and Development Code was
completed. No public comments were received.
b. Referral comments were received from the Aspen Glen Homeowners Association
supporting the request and outlining the history of Design Review Approvals and previous
plat amendments (see attached). Their comments included three conditions noted as
follows:
1. The adjustment shall return the envelope to the original configuration.
2. A copy of the recorded amended plat shall be provided to the Aspen Glen
DRC.3. The DRC has only approved the plat amendment. Any further improvement
to property shall be submitted for DRC review and approval.
6. Referral responses from the County Building Department indicated no comments.
7 . Referral response from the County Attorney's Office indicated no further comments.
PLAT DETAILS
8. Comments from the County Surveyor are anticipated and will be addressed by a

edits prior to execution of the amended plat.

Staff supports a findíng that the Applicant has completed all public notice requirements and

Land Use and Development Code including the Amended Plat Review Criteria contained in
Section 5-305. The Application is recommended for Administrative Approval by the
Director of the Community Development Department subject to the following conditions of
approval.
1. That all representations of the Applicant contained in the Application submittals shall
be conditions of approval unless specifically amended or modified by the conditions
contained herein.
2. Final review by the County Surveyor's Office shall be required and all edits and
corrections based on his review shall be completed prior to submittal of the plat for
signature by the Board of County Commissioners.
3. The Plat including title, signature blocks, plat notes, certificates, and easement
language shall be subject to final review and approval by the CountyAttorney's Office prior

Thank you for the opportunity to submit this referral letter related to the amended plat for
Lot4i2. Previously the Aspen Glen Design Review Committee (DRC) reviewed the
proposed plat amendment at their meeting December 6,2017. The proposed adjustment
was consiàered to accommodate an error related to the survsy prepared by Divide Creek
Surveyors Inc, the current property owner's surveyor. In2007 an amended plat was
recorded which adjusted the original building envelope on the property. However, the
property was never developed and Tara and Justin Adis recently designed their home,
iecêived Aspen Glen DRC approval for their proposed improvements, and discovered,

did not frt in the amended building envelope.
The DRC approved the adjustment and rscommended approval to the Garfield County
Board of County Commissioners with the following conditions:
1. The adjustment shall return the building envelope to the original configuration.
2. A copy of the recorded amended plat shall be provided to the Aspen Glen DRC.
3. The DRC has only approved the plat amendment. Any further improvements to
property shall be submiued for DRC review and approval.
The DRC noticed property owners within the vicinity of the property, no objections were
noted.
