HomeMy WebLinkAbout5.0 Director's Determination & Lien Holder ConsentGaffield Coúlnty RE Community Development Department January 26,2018 Tara and Justin Adis 62 Horseshoe Lane Carbondale, CO 81623 Director's Decision Amended Plat Lot H-22Filing 7, Aspen Glen (FPAA-1 1-17-8597) Dear Tara and Justin This letter is sent to you as the Applicants for the Amended Final Plat request for Lot H22, Aspen Glen Filing 7, to modify the building envelope to return it to its original configuration as shown on the Aspen Glen Final Plat for Filing 7. The property is located at62 Horseshoe Lane, Carbondale CO,81623 and is known by Assessor's Parcel No. 2395 -134-06-022. The Application has been reviewed in accordance with the Administrative Review procedures contained in the Land Use and Development Code as amended. Said provisions require a decision by the Director of the Community Development Department on whether to approve, approve with conditions, or deny the request. The Director's Decision is hereby issued approving your Application with a finding that the Applicant has completed all public notice requirements and that subject to compliance with conditions of approval the 2nd Amended Plat of Lot H22, Aspen Glen, Filing No. 7 meets the requirements and standards of the Garfield County Land Use ãnd Development Code including the Amended Plat Review Criteria contained in Section 5-305. The Director's Decision is subject to the following conditions of approval. 1. That all representations of the Applicant contained in the Application submittals shall be conditions of approval unless specifically amended or modified by the conditions contained herein. 2. Final review by the County Surveyor's Office shall be required and all edits and corrections based on his review shall be completed prior to submittal of the plat for signature by the Board of County Commissioners. 1 cr., b c. 3. The Plat including title, signatnre blocks, plat notes, certificates, and easement language shall be subject to final review and approval by the County Attorney's Office prior to submittal of the plat for signature by the Board of County Commissioners. 4. The following edits shall be made to the plat prior to submittal of the Plat for signature by the Board of County Commissioners. The statement of purpose shall be relocated to a plat note. A plat note shall be added referencing the original Aspen Glen PUD final plat affirming that all plat notes shown thereon shall remain in effect. All required certificates shall be included on the plat including but not limited to the Certificate of Taxes Paid, Title Certificate, and Lienholders Certificate if deemed necessary by the County Attorney's Office. 5. The plat amendment is limited to returning the building envelope to the original configuration as shown on the Aspen Glen Final Plat for Filing No. 7. 6. The Applicant shall comply with the referral comments from the Aspen Glen Homeowners Association outlined in their referral comments dated January 5, 2018 including the return of the building envelope to the original configuration, provision of a recorded copy of the plat to the Homeowners Association, and review by the Aspen Glen Design Review Committee of any further improvements. The Land Use and Development Code requires notification to the Board of County Commissíoners for their review and potential call-up of the Director's Decision. The Board review is for a period of 10 calendar days commencing on the date of the Director's Decision. The call-up period shall expire on February 5th. The Amended Final Plat will be scheduled on the Board of County Commissioner's consent agenda after expiration of the call-up period and once all conditions of approval have been satisfied including editing of the plat and acquisition of all necessary signatures. Please note that you will have 90 days from the date of approval to submit a plat suitable for recording. Extensions of this time period may be requested prior to the expiration of the original time limit.
