Recitals
A. Vicco,s II, LLC (Applicant) made an application to the Board of Adjustment of Garfield
county, colorado, (the "Board") requestittg tne noard grant a variance from the Land use and
Development code,ìs amended (ruñc¡, rãule 3-z}r,Zıne District Dimensions front yard setback
for the iì.esidential/Urban (RU) Zone District'
B. The Applicant is the owner of the real property as identified in- a Deed recorded at
Reception No. 914419 in the office of the Garfield county crerk & Recorder' known as 45755
Highway 6 &,24,Glenwood Springs, Colorado and further described in Exhibit A'
C. The subject proper¡y is zoned Residential/urban (RU), pursuant to the LUDC and issuance
of the requested variance will not affect the requirement that the parcel complies with the remaining
zone district standards contained within the LUDC'
D. The Applicant requests the Board gtarÍ avariance from the required 50 ft' front yard
setback to allow a reduction io a25 ft. front yaid setback for a proposed storage building, as shown
on the site plan attached as Exhibit B'
E. Garfîeld County is a legal and political subdivision ofthe State of Colorado, forwhichthe
Board of County Commissioners is authorized to act'
F. The Board of county commissioners of Garfield county has appointed the Garfield
County Board of Adjustment'
G. The Board conducted a public hearing on February 25,20lg,upon the question of whetfgr
the requested variance should be approved, deãied, or whether any action should be taken on this
matter, duri'g *tricdfrea"ing the p"Uii. anclinterestecl persons were giventhe opportunityto express
their opinions regarding the request'
H. The Board closed the public hearing on the 25th day of February ' 2019 to make a final
decision.

I. The Board on the basis of substantial competent evidence produced atthe aforementioned
hearing has made the following determinations of fact:
l. That proper public notice was provided as required for the hearing before the Board
of Adjustment.
2. The hearing before the Board of Adjustment was extensive and complete, that all
pertinent facts, matters and issues were submitted and that all interestedparties were heard at
that meeting.
3. That for the above stated and other reasons the Vicco's II, LLC application for a
variance from the front yard setback submitted by Vicco's II, LLC is in the best interest of
the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield
County.
4. That with the adoption of conditions, the application is in general conformance with
the 2030 Comprehensive Plan, as amended.
5. That with the adoptions of conditions the application has adequately met the
requirements of the Garfield County Land Use and Development Code, as amended,
including the Variance Review Criteria contained in Section 4-115 (C)'
RESOLUTION
NOW THEREFORE, BE IT RESOLVED by the Board of Adjustment, Garfield County,
Colorado, that:
A. The forgoing Recitals are incorporated by this reference as part of the resolution.
B. The Vicco's II, LLC Front Yard Setback Variance Request is hereby approved subject to
compliance with the following conditions:
L That all representations made by the Applicant in the application shall be conditions of
approval unless specifically altered by the conditions of approval.
2. Thevariance is granted for the proposed storage building construction only as detailed on the
site plan. The storage building shall maintain aminimum setback of at least 25 ft. fromthe edge
of the right-of-way of Highway 6 &'24.
3. That access to the storage building shall utilize the existing main driveway access to the site
and single family residence, with no direct access from the storage building onto Highway 6 &'
24 permitted.
4. The new construction shall comply with all Building Code requirements, including the 2015
Building Codes for personal (non-commercial) use.
